Details:
Horace Gray autographed three-page handwritten letter (ALS), dated August 16, 1858, from 39 Court Street, Boston, Massachusetts. Addressed to Lemuel Shaw, Chief Justice of the Massachusetts Supreme Judicial Court, the letter concerns several pending judicial opinions and the preparation of official court reports. Written entirely in Gray's hand and signed "Horace Gray Jr." at the conclusion.
At the time of this correspondence, Gray was serving as the official Reporter of Decisions for the Massachusetts Supreme Judicial Court, a position he held before becoming a justice of that court and eventually an Associate Justice of the United States Supreme Court.
In this lengthy and detailed letter, Gray discusses a number of cases heard before the Massachusetts court, requesting outstanding judicial opinions from Chief Justice Shaw and reviewing the status of several decisions awaiting publication.
Gray opens by explaining that he is forwarding a list of opinions that he has not yet received from Shaw, extending through the court's summer vacation of 1858. He proceeds to identify various cases individually, discussing their procedural status, whether opinions had been written or delivered, and which decisions remained outstanding.
The correspondence offers an interesting firsthand glimpse into the preparation and publication of judicial decisions in mid-19th-century Massachusetts, as well as the professional relationship between two prominent figures in American legal history.
The recipient, Lemuel Shaw (1781–1861), served as Chief Justice of the Massachusetts Supreme Judicial Court from 1830 to 1860 and was one of the most influential American jurists of the 19th century. Shaw's decisions helped shape American commercial, labor, and constitutional law. He was also the father-in-law of celebrated American novelist Herman Melville, author of Moby-Dick.
Accompanied by a handsome 19th-century engraved portrait of Horace Gray, depicting the jurist seated in judicial robes. The portrait bears a printed facsimile of Gray's signature beneath the image. The accompanying manuscript letter contains Gray's original handwritten signature.
The three-page letter measures approximately 8 x 9.75 inches, and the engraved portrait measures approximately 7.75 x 10.5 inches. Very good condition with original mailing folds, scattered age toning, staining, and handling wear. Some discoloration and minor paper loss are present along the edges of the manuscript. The accompanying engraved portrait is in fine condition with minor age toning.
Horace Gray (1828–1902) was an American jurist who served as an Associate Justice of the United States Supreme Court from 1882 to 1902. Appointed by President Chester A. Arthur, Gray served on the nation's highest court for two decades and participated in numerous significant constitutional decisions.
Born in Boston into a prominent Massachusetts family, Gray graduated from Harvard College and Harvard Law School before beginning his legal career. In 1854, he was appointed Reporter of Decisions for the Massachusetts Supreme Judicial Court, overseeing the preparation and publication of the court's official opinions.
In 1864, Gray was appointed an Associate Justice of the Massachusetts Supreme Judicial Court, succeeding his former mentor, Chief Justice Lemuel Shaw's successor on the bench. He became Chief Justice of Massachusetts in 1873, serving until his appointment to the United States Supreme Court in 1882.
During his tenure on the United States Supreme Court, Gray participated in important cases involving citizenship, immigration, constitutional interpretation, and federal authority. He authored the majority opinion in United States v. Wong Kim Ark (1898), a landmark decision affirming birthright citizenship under the Fourteenth Amendment for children born in the United States to Chinese immigrant parents.
Gray's distinguished judicial career, spanning nearly four decades on the Massachusetts and United States Supreme Courts, established him as an influential figure in the development of American constitutional law.
