Terms and Conditions of Sale 1. The highest bidder for each lot shall be the buyer. If any dispute arises as to the bidding or between two (2) bidders, the auctioneer has the final discretion to determine the successful bidder. 2. Livingston’s Estate Services/Auction accepts absentee bids including internet bids, live auction internet bids and telephone bids. Although our absentee bidding system is 100% honest, it is not foolproof. Livingston’s Estate Services/Auction is not responsible for failing to execute any absentee bid or internet bid. Please call (405) 858-1914 or 405-590-2777 to place an absentee bid. 3. All property is sold “AS IS”, and neither the auctioneer, auction staff, nor any consignor makes any warranties or representations of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty of descriptions of genuineness, authorship, attribution, provenance, period, culture source, origin or condition of the property, and no statement, oral or written, made at the sale or in the catalogue, bill of sale or invoice or elsewhere shall be deemed such a warranty or representation or an assumption of liability. All perspective buyers should personally inspect or have their agent inspect property before bidding. In no event will our liability to purchaser exceed the purchase price actually paid. 4. The auctioneer at her discretion may reject any bid not commensurate with the value of the article offered. We reserve the right to reject any bid or withdraw any lot from the sale. 5. We accept payment for all sales by cash, Money order, Visa, Master Card, Discover, and business or personal check (with valid ID). 6. Buyers are required to pay local state and local sales tax unless exempted by law. IF EXEMPT, buyers must file a tax exemption form with Livingston’s Estate Service before any exemption can be made. Oklahoma residents will be charged 8.375% or prevailing Tax rate, unless exempt. 7. A buyer’s premium of 5% of the successful bid price will be added to the total purchase price of all properties as part of the total purchase price on any lot sold through an absentee, telephone, or live eBay bid. 8. We are not shippers however we will arrange for your item to be shipped through a local reputable packing and shipping company. At our discretion we will ship small and most unbreakable items bought at our auctions. The Cost of Packaging, Handling & Shipping will be the Responsibility of the Buyer. Items MUST be paid for before Shipping can be arranged. Items will be insured for their Purchase Price and Shipping. An Estimate of shipping will be given at the time of invoice however, Livingston’s Estate Services will invoice for any unforeseen increase in the shipping charge should it occur. Please note that the buyer will be responsible for the cost for packing, handling, postage and insurance on all merchandise. Shipping cost will be billed at cost. Shipping costs will not be refunded under any circumstances. Arrangements for shipping furniture will be the responsibility of the Buyer but we will provide names on request. In the event of loss or damage, the Buyer shall make necessary claim against shipper. Livingston’s Estate Services is in no way responsible for the acts or omissions of independent contractors, packers or carriers of purchased merchandise and will bear no liability for any loss or damage to such items, and the cost of shipping shall be paid by the buyer including all packaging expenses, including labor, materials and postage and carrier fees and all insurance charges as billed to Livingston’s Estate Services. 9. All items are sold "AS-IS". All sales are final. No returns or refunds. 10. Presale estimates are intended as guides and may not be reflective of actual gavel price. Some of the items in this auction are subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Livingston’s Estate Services/Auction. Absentee bidders should call or email for an updated condition report. This report supersedes the catalog description. We can answer questions until 24 hours before the start of the first session. We encourage all patrons to take advantage of the preview hours scheduled for the auction for personal inspection of any item they wish to bid on. 11. Arrangements for all Absentee bids and Telephone bids must be made not later than 24 hours before the start of the sale. 12. Bidding on any item indicates the bidder’s acceptance of the terms and conditions of Livingston’s Estate Services/Auction as stated either in writing or announcement at the time of sale, whether bidding in person, through a representative, by phone, by Internet, or other absentee bid.
