Description
A 1753 early colonial court document issued by Judge Joseph Wilder (1683 -1757), Judge of Probate of Wills for Worcester County, "within his Majesty's Province of the Massachusetts-Bay in New England" dated September 20, 1753 in Worcester, Massachusetts Bay. The estate administration bond order is signed by several important colonialists including Gaythorn & Mary Makepeace, Obadiah Wood, John Russell, Judge Joseph Wilder and others. The Makepieces, Obadiah Wood and John Russel are granted administration rights as to Josiah Wood's Estate (Obadiah Wood's father).The probate Judge, Joseph Wilder, Esq., required the Administrators to pay "a hundred pounds" in lawful money to the court during the pendency of the probation of the Estate. The Administrators were further obligated & bound, jointly and severally, to the Court to complete "a true and perfect" inventory of all of the goods, chattels, rights and credits of the said deceased / decedent. Signed / Sealed 20th day of September, 1753. Contains the signatures of all of the parties as well as two witnesses. Document is a good example of English common law being used and applied in the colonies.Notes: Judge Joseph Wilder was born in 1683 and died in 1757 Lancaster, Middlesex County, Massachusetts. He was second son of Thomas Wilder (1644 – 1716) and Mary (Houghton) Wilder (1646 – 1716), brother of Colonel James Wilder, Esq. In 1732 he was appointed a judge of the court of common pleas for Worcester county, and from 1741 until his death he served as chief justice. In 1739 he was made judge of probate for Worcester county, which office he also held until his death. In 1702 Judge Joseph Wilder married Lucy Gardner, daughter of Captain Andrew Gardner, of Lancaster, who was born in 1679. She was the sister of Rev. Andrew Gardner who was accidentally killed by being mistaken for an Indian during the time bf the massacres. The sentinel heard the approach of a man in the bushes, and receiving no reply to his command, fired his musket and killed the clergyman just on the eve of the latter's ordination. The soldier was exonerated by the authorities, but he never recovered from the effects of the tragedy. Judge Joseph and Lucy (Gardner) Wilder had four sons. Josiah Wood was born (a twin of Elizabeth) in 1658, Charlton, Middlesex County, Massachusetts Bay Colony. Was the Son of Josiah Wood and Lydia Bacon. Husband of Abigail Wood. Father of Josiah Wood; Abigail Simonds and Samuel Wood. He passed away in 1740.
