Terms and Conditions Please read carefully prior to bidding. The below terms and conditions of Auction constitute the entire agreement with the successful bidder relative to the property purchased at auction. In bidding with Elite Shopping.TV you are agreeing to be bound by the following terms: 1. All items offered at auction are sold as is, where is, no refunds, no returns and without recourse. All descriptions are based on the opinion of Elite Shopping.TV. Descriptions including photographs, condition, weights, authenticity, provenance, manufacturer, artist, origin and measurements are believed to be accurate, however, neither, Elite Shopping.TV, the auctioneer nor consignor makes any warranty or representations of any kind to the merchandise being offered. All measurements and weights are approximate. Elite Shopping.TV encourages in person previews or contacting us prior to bidding for additional information on desired lots. 2. Elite Shopping.TV is not responsible for any omission or errors in the description or further verbal descriptions given by the auctioneer(s) the day of the auction or by any employee preceding or following the auction. 3. Elite Shopping.TV encourages all potential bidders to preview our items in person. We hold several days of previews before each auction at our studio located at 157 Kimbles Road, Hawley, PA 18328. Please call our office on 570-390-7800 to arrange a preview. 4. Elite Shopping .TV reserves the right to withdraw lots prior to the commencement of each auction. 5. Estimates published, showing the high and low ranges for each item, are the opinion of the appraiser of Elite Shopping.TV as to the fair auction value for each item. Elite Shoppin.TV makes no warranties as to the finite value for item(s) sold. You as the bidder decide the final price. 6. While lots are listed at times without reserve prices, Elite Shopping.TV or its consignors may assign minimum selling prices to select lots in each auction. Elite Shopping.TV may execute bids on the behalf of our consignors due to reserve prices. 7. Elite Shoppin.TV reserves the right to refuse admission to our facility, reject a bid or refuse to acknowledge certain bidders. The highest bidder, whether in the studio, absentee, on the telephone or online will be acknowledged and recorded by the auctioneer. 8. No auction lot may be removed from the gallery until payment has been accepted and cleared. Please see our payment, pickup and shipping section for further details. All items won must be paid within 5 (5) days or a dispute will be filed and opened. 9. The purchase price payable by the buyer shall be the sum of the final bid plus a buyer's premium of 25%. 10. All items must be picked up, or have shipping arranged, within 8 days following the auction date. A storage fee of $25. Per lot per day applies on the 9th day. Elite Shopping.TV is not responsible for items left at the Studio for more than 8 days. After 8 days, all unclaimed lots may be re-listed for sale and any payment, is gratefully accepted as a tax-deductible donation to a charity of the Elite Shopping.TV's choice. 11. Purchases are subject to 6% Pennsylvania sales tax with the following exceptions: (a) Items shipped outside of PA by a trucking or shipping company are exempt from PA state taxes. (b) Registered re-sellers are exempt from PA state taxes, however a completed resale certificate must be provided to Elite Shopping.TV prior to the time of purchase. 12. We do not have an in-house shipping department. We are not equipped to assist with the pickup of items from our studio. All items and lots are signed out by your selected shipper. Elite Shopping.TV is not liable for damaged or missing items after they are signed out and removed from our studio. Elite Shopping.TV is not responsible for or liable for any lots paid for and not picked up within 8 days of the auction date. By departing the pick up sit you or your agent acknowledges that you have all your items and that you are satisfied with them. No claims are permitted after removing items from the studio, as condition issues cannot be validated once items are released into your possession. Elite Shopping.TV is open Monday through Friday 10AM to 4:30PM for pick-up. We are in the secured gated complex of MX1. There is a call box of the left side of the driveway for your or your pick-up agent to ring to gain access to Elite Shoppin.TV. 13. Elite Shopping.TV is not responsible for damages or mis-deliveries made by the services hired and paid for by successful bidder. Items picked up by a third party must have prior approval for pickup from the purchases and it is the purchases responsibility to notify Elite Shopping.TV who and when the shipper is going to pick up. We are not responsible for your shipper not picking up the lots when requested. 14. All glassware is sold as is. Elite Shopping .TV is not responsible for damage of glass covering paintings, drawing and other works or art, or frames, regardless of cause. Elite Shopping.TV will not guarantee the authenticity of any signature unless so stated at the time of auction. We are not responsible for typographical errors. 15, By providing your credit card information to pay an invoice, you authorize Elite Shoppin.TV to charge the cost of the product and/or service to your credit card wither through the payment portal or as indicated on signed, paper authorization form. This payment is for goods/services won at auction and certifies that you are an authorized user of this credit card and that you will not dispute the payment with your credit card company; so long as the transaction corresponds to the terms indicated. By registering to participate and providing credit card information, you are accepting all responsibility for the transaction to ensure full payment to the merchant and acknowledge that all sales are final. You will inform Elite Shopping.TV immediately if use of this card is no longer valid.
