Burns White Galleries and all associated parties including but not limited to, Bidders, Buyers and Sellers agree to be bound by the following terms & conditions for this Auction. These terms & conditions supersede all previous catalogs, announcements, advertisements, and published information however distributed or implied.
REGISTRATION
All bidders, including phone bidders, must register with Burns White Galleries and have a bidders number before bidding. Proper identification such as a valid Driver's License or other official identification is required in order to register. Burns White Galleries reserves the right to refuse to register any prospective bidder for any reason without recourse or liability.
CATALOG DISCLAIMER
Catalogs, brochures and other descriptions are guides only based on information from sources believed to be reliable, but their accuracy cannot be guaranteed or warranted. Pre-sale estimates are intended as guides and may not be reflective of actual hammer price. Some of the items may be subject to a reserve defined as a confidential minimum price agreed upon by the consignor and Burns White Galleries. The reserve will never be higher than the low estimate. We reserve the right to bid on behalf of a consignor with reserved lots by placing successive bids on behalf of the consignor, or bids in response to buyers' bids. Auctioneers reserve the right to invoke Auctioneers discretion at any time during the bidding process and reserves the right to withdraw any lot, or portion of a lot, from the Auction or to cancel the entire Auction without notice or liability to Auctioneer, Buyer, Bidder or Seller.
BUYER'S PREMIUM TEN PERCENT 10%. INTERNET BIDDERS 15%.
A buyer's premium of ten percent (10%) of the hammer price will be charged. Under Florida State Law, both hammer price and buyer's premium are subject to state tax. Anyone with tax exemption status must register beforehand with a copy of the current valid certificate.
PHONE / ABSENTEE BIDS
We offer this as a convenience to pre qualified bidders on items estimated at $ 300 or greater. You will be called by staff approximately 2 minutes before your lot. While we try to accommodate all interested phone bidders, we cannot guarantee or be held responsible for a missed call therefore we suggest that you leave a back up absentee bid in the event we cannot contact you.

Bid increments are at the sole discretion of the Auctioneer. The auctioneer, at his/her sole discretion may not follow the bid increment table at all times.
PAYMENT:
For your convenience, cashiers will be open during the sale for early check out. For those in attendance, all purchases must be paid for in full and picked up within one hour after the conclusion of the Auction. Forms of payment include Cash (In House Only), MasterCard, Visa, Discover, American Express and Bank Wire Transfer. Checks either personal or business, will be accepted at the sole discretion and with prior approval of the Executive Office. Any items not retrieved at the conclusion of the sale, or where no arrangements have been made will be moved to a local warehouse at the purchasers risk and expense.
INTERNET:
Internet sales must be paid for within 5 BUSINESS DAYS of the sale or Seller may void sale. Please do not make payment until you have received an official invoice from Liveauctioneers.com. Acceptable forms of payment include Paypal, MasterCard, Visa, Discover, American Express and Bank Wire Transfer. Charge Cards may also be accepted via the internet through PayPal Non-Paying Bidder Alerts are issued with resulting negative feedback if not resolved.
SHIPPING AND PACKING: BUYER ARRANGES & PAYS FOR SHIPPING! ALL SHIPPING IS OUTSOURCED. Arrangements and costs are the sole responsibility of the buyer. Buyer will pay packing, shipping and insurance costs as charged directly to the professional company of his/her choice. We can ship jewelry within the US for a fee of $30.00. International shipping of jewelry can be arranged on an individual basis.
BURNS WHITE GALLERIES DOES NOT PROVIDE SHIPPING SERVICES OR ESTIMATES. However, we can recommend the following independent shipping services: Small items or items out of town: UPS Store 813-251-9593, Pak Mail, (813) 319-5478, Pak Mail, (813) 960-4006, For larger furnishings local, Matt Anderson, 727 501-3461. Clients are welcome to pick up their items from our location or make their own shipping arrangements. However, please be aware that items not picked up or shipped within one week following an auction are subject to forfeiture.
LIMITATIONS AND ASSUMPTIONS
Each lot will be sold AS IS, WHERE IS with no warranties or guarantees of condition, fitness, merchantability or suitability. It is the responsibility of potential bidders to carefully inspect each lot to determine condition and contents. All weights, counts and measurements are approximate and measured to the nearest 1/4 inch. Ceramics and glass lots are represented as being free of major damage or repairs, unless otherwise stated but may not cover superficial damage or manufacturing defects and where possible, visible damage is shown in photograph. This Warranty does not cover normal wear on furniture, unless otherwise stated. Pieces that are, in our opinion, refinished, are described as such.
The description of clocks and lighting devices, may be incomplete and may not identify every mechanical replacement, repair, or defect. The absence of reference to the condition of a clock or lighting device does not imply it to be in working condition or without defects, repairs, restorations, or replacement parts. Bidder acknowledges that all lots were accessible for on hand inspection prior to the Auction and that he or she relied solely on their own inspection of the lots and not any information listed in the catalog or otherwise provided by Auctioneer, the Auction staff or Seller. All other guarantees of authenticity of authorship, expressed or implied, are hereby disclaimed.
It is the responsibility of prospective buyers to consult with a restorer or conservator of your choice to provide an unbiased professional opinion of condition. Prospective buyers should inspect each lot to satisfy themselves as to condition and must understand that any statement made by Burns White Galleries is merely a subjective opinion.
