Terms & Conditions Buyer/Seller Registrations: 1.) All dealers must be licensed by their state and registered with this auction. 2.) Public must furnish proof of I.D. which corresponds with the title. 3.) Checks will only be written in title name. 4.) Please submit pictures and a detailed description with your consignment form. 5.) Owner has a right to accept or reject any and all bids (registration fees remain). Auctioneer must be informed by seller prior to the vehicle being announced sold. 6.) Once a vehicle is registered it must go through the lane. NO OFF BLOCK SALES or solicitation of vehicles allowed on premises...Anyone attempting to solicit will be prosecuted. 7.) Please bring your mileage to the office with key and title. 8.) All titled vehicles must have titles turned in by time of consignment. 9.) Dealers have the privilege of selling "Title Delay" and will be charged an additional $50.00 processing. Dealer has 21 days to produce title or purchaser may have a refund. Buyer may choose to wait longer for title. Sellers will be charged for lost fees for title delays on late titles. 10.) Seller will not be paid for any vehicle until Wilson's Auction is paid by buyer and all titles and paperwork must be in proper order in office. Buyers (private or dealers) are cautioned not to sell or make repairs, until title is received. We will not be responsible for repairs or any other expenses incurred by a title delayed vehicle. Wilson's Auction Sales, Inc. will not be responsible for returned condition. Seller Fees: 1.) Registration fee of $100.00. 2.) 5% Auction Fee will be charged to both Buyer & Seller. 3.) There will be a minimum fee of $250.00 per consignment. Buyer Fees: 1.) A $200.00 cash deposit must be submitted in office prior to bidding, refundable or deductible upon honoring your bid. 2.) 5% Auction Fee will be charged to both Buyer & Sellers. 3.) Internet bidders - see E-bay terms. Payments: 1.) Terms of payment are credit cards, cash(in house only), certified funds, checks with letter of guarantee from your bank. Preapproval letters are accepted from J.J. Best Banc & Co., apply online at www.JJBEST.com or 1-800-USA-1965. Titles will be held 3 weeks on checks written. Preauthorization of checks must be made prior to bidding. All checks are to be made payable to Wilson's Auction Sales, Inc. 2.) "Stop Payments" will not be honored and will be prosecuted by the fullest extent of the law at purchaser's expense. 3.) A 5% processing fee will apply to all credit card transactions. General: All Sales are "As-Is, Where-Is" with no expressed or implied warranty. 1.) Anyone tampering with vehicles or properties not belonging to them on these premises will be prosecuted. 2.) We will not be responsible for title serial #'s that do not correspond to serial #'s on vehicle (seller's responsibility). We do not assume responsibility for mileage disputes or other statements made by either party. We are not responsible for statements written on windows. 3.) Vehicles must have serial # plate. Auction will not be responsible for years of foreign cars, boats, trailers, campers, or motorcycles. 4.) Vehicles must be removed from the premises within 24 hours. Purchasers are responsible for any costs that will be incurred. We are not responsible for theft. Leave at your own risk. A storage fee per day may be imposed. 5.) Cars and trucks left without key will be towed at owner's expense. 6.) Temporary tags are available with proof of liability insurance. It is the purchasers responsibility to call your insurance company within 24 hours of your purchase and add your vehicle to policy. 7.) All titles will be mailed certified within 21 days after payment. 8.) Buyer must check serial # on vehicle before leaving premises. Transactions are between buyer and seller only. 9.) In all cases of disputed bids, the lot shall be resold, but the auctioneer will use his judgment as to the good faith of all claims and his decision is final. The auctioneer will accept bids from the bidders present in the room, absentee bidders by telephone, or absentee bidders who leave written bids in advance of the auction, and Ebay bidders. The auctioneer has the right to place a bid for the consignor up to the reserve amount. Under no circumstances will the auctioneer place a bid on behalf of the consignor at or above the reserve. Further the consignor has the right to "lift" the reserve price whereupon it will be sold to the highest bidder at the hammer. When the reserve has been lifted, the auctioneer will duly announce it. Shipping: International & Domestic shipping is available. Absentee/E-bay Bidder terms: Please ensure that you have read and understood these terms and conditions prior to bidding at this Wilson's Auction Sales, Inc. auction. You must be pre-registered to bid. No bids will be taken from unregistered bidders. Wilson's Auction Sales, Inc. must be in receipt of a minimum of 10% (ten) of the maximum dollar amount the bidder is willing to bid on any consignment prior to 48 (Forty-eight) hours before the date of sale. Said monies must be received in good funds (cash, certified check, cashier check, money order or standard check with irrevocable bank letter of guarantee). If the bidder is not the successful bidder, monies will be returned within 7 (seven) working days. The deposit will not be refunded during the sale under any circumstances. If the absentee bidder is the successful bidder, the remaining funds due to complete the transaction MUST BE RECEIVED by Wilson's Auction Sales, Inc.; by wire transfer or other means, within 1 (one) working day. 1. All sales are final. No bidder may retract a bid made during the sale for any reason. 2. Final bid price does not include 10% buyer's premium or applicable taxes on each lot purchased. 3. All sales are "as is" and "where is". Bidder is responsible for inspections and verification of condition, authenticity, and completeness of any item purchased. No warranties or representations of any type whatsoever are made by Wilson's Auction Sales, Inc. Buyers are strongly encouraged to conduct their own evaluation and inspection. Any announcements made at the time of sale supersede any earlier printed information. 4. Bidder authorizes Wilson's Auction Sales, Inc. to authorize the credit card number provided for $2000US to register for auction. Should a bidder default on payment in any manner whatsoever, without limiting any recourse Wilson's Auction Sales, Inc. may have, bidder agrees to pay Wilson's Auction Sales, Inc. all lost auction fees (which is the maximum published rates for (1) the seller's commission, (2) the buyer's premium, and (3) the entry), this amount is due and payable without relief. 5. Person bidding online must be 21 years of age or older. No minors are allowed to bid. 6. If buyer is picking up items or using another shipping company other than the Wilson's Auction Sales, Inc. recommended company, Buyer is responsible for removing items from the auction location by Sunday, May 4th at 2:00 p.m. Buyer is responsible to pay for the removal of items from the site, packing, shipping, handling and insurance of any items purchased. 7. The auctioneer reserves the right to rearrange, separate, exclude or withdraw any lot without giving a reason. 8. If buyer sues Wilson's Auction Sales, Inc. and does not prevail, buyer will reimburse Wilson's Auction Sales, Inc. for all legal fees and expenses in connection with said suit. 9. All terms of sale posted on the auction premises, printed in sale brochures or forms, publicly announced, communicated via the eBay bidding applet or otherwise published are incorporated herein by reference.
