TERMS OF SALE
LECLERE auction house is a public auction company governed by the law since July 10, 2000. LECLERE auction house acts solely as an agent between buyer and purchaser. The relationship between LECLERE auction house and the purchaser are subject to these terms and conditions:
PAYMENT
The sale will take place specifically in cash (In House Only).
The highest bid and the highest bidder will be the successful bidder and and will be required to pay cash (In House Only). Purchased lots will be available only after payment has been made and our accounts credited. For payments up to 3000 euros fees and taxes are included for French nationals, for payments up to 7600 euros fees and taxes are included for foreign nationals upon presentation of their papers and valid identity - cash (In House Only) payments may be made by cheque or bank transfer. The cheques drawn on a foreign bank will be allowed Only after the prior approval of LECLERE auction house. It is required that buyers provide a letter of credit from their bank showing a balance greater than the item they intend to purchase. Bank charges will be borne by the purchaser.
The sale will be conducted in Euros. In addition to the hammer price, purchasers pay a buyer's premium of 22.5% plus VAT of 4.31 %.
LACK OF PAYMENT
In accordance with Article 14 of Law No. 2000-642 of 10 July 2000,
If payment for an item by the successful bidder after due notice is unsuccessful, the property is put on sale at the seller's request. If a seller makes no request within one month of the auction, the sale is determined by operation of law, without prejudice to damages owed by the defaulting contractor
RESERVE
The lots in this auction are bound by a set reserve price, determined by the auctioneer prior to the sale. French law states that a lot can not be sold below the reserve price.
GUARANTEES
The information provided by LECLERE auction house on the existence or restoration of an accident affecting the lot, expressed to facilitate its inspection by the prospective buyer and remain subject to his personal appreciation. The absence of an indication of the restoration of an accident in the catalogue, reports or verbally, in no way implies that the property be free from defects in the present, past or repaired. Conversely, mentioning some fault does not imply the absence of all other defects. The dimensions are given for guidance only. Attributions were made in view of scientific and artistic knowledge at the date of the auction. Some difference may appear between the original work and its catalogue and online reproductions. However, there will be no claims in such matter. Measurements are given only as an indication.
BIDS
The highest and last bidder will be the buyer.
Should the auctioneer recognize two simultaneous bids on lot, the lot will be put up for sale again and all those present in the saleroom may participate in this second opportunity to bid.
PAYMENT
The buyer must pay the full amount due (including the premium as stated in the conditions of the sale) within ten days of the sale. This applies even if the buyer wishes to export the lot and an export license is, or may be, required. The buyer may pay by bank wire transfer. Personal checks, Paypal and credit cards will not be accepted. The buyer will not be allowed to retrieve or have the lot shipped until all amounts due to us have been received by us and/or credited to our bank account.
COLLECTION OF PURCHASES
The lots not taken the day of the auction can be retrieved at the auction house in Marseille April 6th 2008 after 10 am. Buyers are advised to collect purchased lots as soon as possible to avoid handling and storage costs which may be incurred at their expense. Purchases, which have not been removed within ten days of the sale will be transported to a place of conservation at the expense of the successful bidder. If payment is made by bank wire transfer, lots may not be withdrawn until the payment has been cleared. From the moment the hammer falls, sold items will become the exclusive responsibility of the buyer. The buyer will be solely responsible for the insurance, LECLERE assumes no liability for any damage to items which may occur after the hammer falls.
SHIPPING & PACKING
We do not assume responsibility for shipping lots. Under certain conditions, we may be willing to assist the buyer by providing an estimate from an International shipping company of our choice. Estimates are given in accordance with the size and weight of the object, as well as the shipping destination only after the lot has been purchased. Additional packing costs may be incurred. If agreed upon in writing before the auction, we may agree to work with other shipping services. We may not be held responsible for damages incurred during shipment.
