This auction is sold as is, where is. Carbone & Sons makes no warranties or guarantees or representation on the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no written descriptions made during the auction, or in the bill of sale, or invoice, or in the catalog, or elsewhere shall be deemed such a warranty of representation or an assumption of liability.
This auction has "NO reserves.” (A "reserve" means that there is a minimum price that the bidding must reach to sell.) We have starting prices, but if there is a bid at the starting price or above, the item will sell.

The conditions set forth below constitute the terms and conditions on which all personal property is offered for sale. Bidding at auction, whether present, by absentee bid or online, the buyer agrees to be bound by these terms. Your bid is a contract. It is the responsibility of the buyer to obtain all possible information on interested lot prior to bidding. It is highly encouraged that bidders contact Carbone & Sons for more detailed photos, description, and condition, if needed. There is no in-person preview at this time.
If you are not completely satisfied with an item before you bid, please DO NOT BID.
Prospective bidders should consult the bid increment scale to ensure their bids conform to our printed bidding increments. Carbone & Sons are not responsible for incorrect bidding.

You agree to pay a buyer's premium of 20% and a 3% credit card charge plus any applicable taxes and shipping.
Each lot will be sold AS IS, WHERE IS with all defects and faults. No warranties or guarantees of any kind will be given by Seller or Auctioneer including any warranty of fitness, merchantability or suitability.
Detailed condition reports are not included in this catalogue. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. It is the responsibility of prospective bidders to contact us regarding condition reports. Requests for condition reports with additional photographs can be made by emailing carbone.sons@gmail.com. Or for verbal reports, call our office at 860-412-0486. Any condition report given, as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. All counts, weights and measurements are approximate. Any electrical devices are assumed not in working order unless otherwise stated. Carbone & Sons shall bear no responsibility for any error or omission. Please rely on the catalog or statements as guides not statements of authenticity of fact.
Invoices must be PAID IN FULL, before items can be released to Buyer, or Buyer’s representative or to a shipper. Carbone & Sons reserves the right to hold merchandise purchased until your funds have cleared.
All merchandise must be removed from the auction premises within 20 business days of the auction, unless the state and/or country are “sheltering in place.” Carbone & Sons will have no liability for any damage to property left on its premises for more than 20 business days after the sale, unless the state and/or country are “sheltering in place” and items cannot be removed due to mandated law. On Day 21, if the personal property is not picked up, Carbone & Sons may place the merchandise in a subsequent auction. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Carbone & Sons may exercise all of its rights and remedies under the law.
Invoices will be sent out on Monday, March 30th. If you have a credit card on file with LiveAuctioneers, it will be charged the balance on the invoice within 72 hours after the invoice is sent.
***If the state of Connecticut and/or the United States goes into “lockdown” or “shelter in place,” and items can’t be mailed out or picked up immediately, we will hold items at our site for no charge until the ban is lifted and for up until 30 days after the ban is lifted. But payment must be made by Saturday, April 11th.
All items are sold to the highest bidder, subject to a starting bid. Should there be any dispute after sale, the record of final sale shall be conclusive. All sales are final. If the top bidder defaults on any lot, the backup bidder would be given the option to purchase the lot at their last recorded bid.
A 20% buyer's premium will be added to the hammer price of each lot sold through Liveauctioneers in our ONLINE sales. Buyers are required to pay sales tax on the total sales price, including the buyer's premium as well as a 3% credit card processing fee. All purchases are subject to the Connecticut Tax of 6.35% as applicable, unless the purchaser possesses a Tax Exemption Number that shows they are a reseller of the type of goods purchased. All invoices must be paid in full before any items are released, no partial payments on select items allowed. Please note: if you pick up your item at our location in Connecticut, and you are a dealer, you must have a copy of your CT resale number, and you will be required to sign a CT State Sales Tax Exemption Form.
Payment can also be made at our office in person only from Tuesday, March 31st - Saturday, April 11th by appointment only by Cash, Credit Card or PayPal. No Checks Accepted. (If “shelter in place” is in effect, then payment will be through LiveAuctioneers.)
Carbone & Sons will NOT ship items. Buyers may utilize a third-party shipper. Carbone & Sons may list options for shippers, but we do not endorse any one in particular. All items must be picked up, or shipping arrangements made by Saturday, April 11th unless the state or the country is in lockdown and no shipping is available. All bidders must email (carbone.sons@gmail.com) notification back to Carbone & Sons regarding their chosen shipper. Pick-up times are by appointment only. The purchaser must pay the shipper in advance for all packaging expenses, including labor, materials, postage, and, if applicable, insurance fees. If the property purchased is subject to laws governing export from U.S. or laws restricting imports into foreign countries, the granting of licensing for export and/or import of such goods is the responsibility of the buyer.
Please be aware that framed works of art are costly to pack/ship, it is not uncommon for the price of packing/shipping to exceed the purchase price. Returns will NOT be accepted as a result of packing/shipping costs. We will not be held responsible for choosing a shipper in the event of any act and/or omissions in packing. We do not assume responsibility for damages. Regardless of shipping method, Carbone & Sons must have received cleared funds to release property.
If a loss or damage should occur during shipment, it is incumbent upon the buyer to file for recovery of any losses incurred. Under no circumstances can the claim exceed the hammer price (not including the buyer's premium). PLEASE NOTE: Shippers refuse to acknowledge the buyer's premium as a requisite part of the sale amount.
YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO CONSUMMATE A PURCHASEWILL BE BANNED FROM BIDDING AT ALL FUTURE SELLER AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS.

Please note: If Connecticut or the United States is in “lock down” or “sheltering in place,” we will hold your items until the lockdown is lifted and 30 days thereafter. There is no extra fee to hold your items in storage. However, you must pay for all items by Sat. April 11th and may have to do so through LiveAuctioneers and not at the pickup location in Brooklyn, CT if the state or country is “in lockdown.”
DELIVERY:
Carbone & Sons will deliver within 150 miles of Brooklyn, CT. Please call our office for estimated delivery cost. Delivery based on number of items, weight of items and mileage. Again, this is subject to change and in accordance to mandated state and federal regulations, if any after March 29th. And again, buyer must pay for all items by Sat. April 11th and not at time of delivery. Delivery fee only can be paid for upon delivery.
