Huamao Action House Terms and Conditions
All properties offered and sold through Huamao Action House shall be offered and sold on the terms and conditions set forth below. By bidding at the auction, whether present in person or by agent, by absentee bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions.
1. ALL SALES ARE FINAL. ALL PROPERTIES SOLD AS IS. NO RETURNS. NO EXCEPTIONS.
2. A 20% buyer's premium will be added to the hammer price of each lot for bidders.
3. We recommend Internet bidders register at least 48 hours prior to an auction to give enough time to process and approve their registration.
a. Individual clients must provide photo identification (such as Driver's license, National ID Card, or passport) and if not shown on the ID document, proof of your current address.
b. Corporate clients must present a Certificate of Incorporation or equivalent documents verifying identity. Returning Bidders may be asked for current identifications.
4. All descriptions and evaluations are our opinions, and neither the auctioneer nor the consignor provides any guarantee for the authenticity of the product. In any description, Huamao Auction House does not make any form of guarantee regarding physical conditions, dimensions, quality, rarity and neutrality. The material, age, authenticity, provenance, culture, origin or historical significance of the properties, or any other any conditional statement are out of courtesy to the customer, they are just only an opinion, should not be regarded as a factual statement. Huamao Auction House is not responsible for any errors or omissions. The status report and any other statements are just our opinions and should not be used as a basis for facts. No employee has the right to make any form of guarantee on behalf of Huamao Auction House. Any statement from anywhere, whether in oral or written, should not be regarded as a guarantee or statement. Any conditional statement is out of courtesy to the customer, it is only an opinion, and should not be regarded as a statement of fact. Huamao Auction House is not responsible for any errors or omissions.
Buyers or potential buyers must rely solely on themselves to evaluate the goods. Any bid you make indicates and guarantees that you have read and agree to accept the sales terms and conditions of Huamao Auction House. Any bid you make will indicate that you have fully inspected the bidding item, or choose not to check it.
Huamao Auction House offers free previews and high-resolution photos for potential buyers to review and make their own conclusions about. All items sold as is, no returns, no refunds.
5. All successful online Buyers will receive an emailed invoice within (24) hours of the end of a sale. If the Buyer does not receive notification within (24) hours Buyer remains responsible for all items purchased and retains the responsibility of providing payment. If Buyer fails to provide cleared funds within seven business days of the sale, they will receive a negative feedback report associated with their online auction profile and will not be permitted to registration for future sales.
6. All payments shall be made in US Dollars. Buyers can only collect lots after their balance due is paid in full. Should payments be made by check or draft, lots will only be released after bank clearance. PAYMENT MUST BE RECEIVED WITHIN 7 DAYS OF THE AUCTION. If the buyer fails to pay within 7 days, Huamao Auction House reserves the right to cancel the sale and reoffer the items and will hold the bidder responsible for any loss or other fees or damages incurred (Buyers are required to pay a 10% of the hammer price as Liquidated damages). Title transfers only when Huamao Auction House receives full and clear payment of the purchase price and any associated fees.
Auction purchases must be paid in full within 7 days of the auction. International orders and all orders of $5,000 or more must be paid for by Certified Check or Money Transfer. Invoices not paid within 7 days we will attempt to reach out one time as a courtesy and then we will file a dispute the next business day. Please let us know if you have a problem making payments as we will work with buyers.
A bank transfer is only considered complete after Auctioneer receives the FULL amount due according to the buyer?s invoice. When making a wire transfer, all fees, exchange rates and other administrative procedures are borne by the buyer and do not include all fees payable by the auctioneer. All sales and remittances should be conducted in US dollar currency. Auctioneer may, at their discretion, hold merchandise until payment has been cleared.
7. All items are sold to the highest bidder acknowledged by the auctioneer. The auctioneer is the arbiter of any disputed bid. He may reopen bidding at his discretion and reject bids deemed inappropriate. The auctioneer reserves the right to withdraw any item and to reoffer the item at another time. Every effort is made by the auctioneer to execute all bids, including floor, absentee, telephone and internet bids. We are not responsible for any missed bids. Huamao Auction House reserves the right to cancel any sale or bid before, during, and after the auction.
8. Some properties sold at auction may include materials from protected or endangered species subject to laws governing imports and exports to or from the United States or other countries. Obtaining of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of receiving an import/export license will not constitute grounds for cancellation or delay in payment for the total purchase price of lots. Buyer is responsible to ensure payment is processed and completed.
