Conditions of Sale 1. All items is sold as is, and neither the auctioneer nor the Sisters of Mercy of the Americas make any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the items. No statement made at the sale, or in the bill of sale, or invoice shall be deemed such a warranty or representation or an assumption or liability. 2. The highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser. The auctioneer also has the right to resell the lot in dispute. In the event of a dispute after sale, the record of final sale shall be conclusive. All sales are final. 3. Some lots will be sold choice and privilege (c/p) and will be noted in the catalog or announced at time of sale. Any lot that is being offered c/p will have multiple items of the same. When you are bidding, you are bidding on one, if you are the successful bidder the auctioneer will ask how many you would like at that time, you may multiply and take as many as you want. If any items from the lot are remaining the auctioneer will start the bidding over. 4. All merchandise purchased must be paid for day of sale and removed from the premises as soon as possible or make arrangements with Auction Company. 5. D.A. Folsom Auction Service, Inc. accepts cash, check with a letter of credit, MasterCard, Visa and Discover Card. D.A. Folsom Auction Service, Inc. reserves the right to hold merchandise purchased until payment has cleared. 6. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest bidder, D.A. Folsom Auction Service, Inc. may exercise all of its rights and remedies under the law including, without limitation (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchasers breach and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. 7. Shipping is the responsibility of the purchaser. 8. All items are subject to Maine's 5% sales tax unless they are a Dealer and have a resale number. All dealers must forward auction company a copy of their resale certificate via email, fax or by mail. 9. A Buyer's premium of 15% of final bid will be charged on cash or approved check sales and a 17% buyer's premium will be charged on all MasterCard, Visa or Discover Card purchases. 10. Bidding on any item indicates you accept these Terms & Conditions and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, by Internet or other absentee bid.

5% Maine Sales Tax. Dealers with a resale number are exempt. Dealer's must provide auction company with a copy of resale certificate via email, fax or mail.
