CONDITIONS OF BUSINESS The Auction House warrants the authenticity and conformity of catalogue description with actual conditions. All statements made during the sale supplement the catalogue. The Auction House has sole discretion to withdraw any lot from the sale without any consequences. The Auction House reserves the right to prevent any person from participation in auction. The Auction House disclaims all responsibility for any latent physical and legal faults. All claims, which may arise, will be settled according to the Polish law regulations. The original and only legally binding version of the General Conditions is in Polish. The Auction House is not responsible for any failure of online bidding resulting from Internet connection failure or software malfunction. Conditions of buying All items put up for auction are on view in The Auction House Gallery and directly before the sale in the auction room. The Auction House suggests to avail this opportunity to examine the items, their catalogue description and condition. Taking part in bidding is possible for persons who are known to the Auction House. Clients who are not known to the Auction House have to be authorized either by submitting credit card information or providing references acceptable by the Auction House. The bidder's personal data is known to the Auction House only. The auction is conducted by an authorised person called the auctioneer. The auctioneer determines the progress of bidding, settles all disputes and names the Buyer of the item. The highest bidder is the Buyer. The 23% commission (premium) including VAT shall be added to the hammer price. Lots marked with * will have premium of 31% unless exported immediately after sale to countries out of the European Union.Full amount of the purchased items should be paid within 7 days from the date of the auction. If the contract is breeched by the Buyer the deposit and account will be forfeited to the Auction House's advantage. In such case the Auction House reserves the right to accomplish the contract at court and to charge all expenses to the buyer. Persons unknown to the Auction House wishing to make considerable purchases are kindly asked to contact the Auction House before the sale to discuss the terms of payment.

We are obliged to transfer a percentage of hammer price to the artists or authorised families - during the artist's lifetime and 70 years after his the death . The basic rate is 5% and it decreases starting from the amount of 50 000 euro. Please consider this charge prior to bidding.

IMPORT VAT SURCHARGE Some lots that had been imported from the outside of EU will have an additional surcharge of 8% added to the premium. Ex.: Premium: 23% + 8% = 31% This rule applies to buyers who intend to bring the lot to the EU country. If the lot is to be exported to the other country, that the 8% VAT will be returned after the import is effected. The lots in question will be marked in the catalogue description by the mention:"additional 8% Vat apply".

EXPORT RESTRICTIONS Some lots - for example oil paintings older that 50 years or valued more then 40 000 pln may be shipped outside of Poland subject to export licence. The export licence requirement depends on value and medium - please investigate on our website for more info. The licence (if applicable) is free of charge for the Buyer, but the procedures can last up to several months. Some lots (of high value to the Polish State) may not be allowed for export - please check with us prior to bidding. PLEASE CONSIDER THE ABOVE LISTED RESTRICTIONS PRIOR TO BIDDING. THE ADMINISTRATIVE DELAYS FOR EXPORT LICENCE DELIVERY CAN TAKE EVEN 6 MONTHS OR MORE.
