1. STATEMENTS OF CONDITION: W h i l e Randy Inman Auctions, Inc. has endeavored to accurately describe in this catalog each item being sold, all pro p e rty herein off e red for sale is strictly "as is." The bidder has the re s p o n s ib i l i t y, whether bidding in person, by mail, or by telephone, to determine the exact condition of each item. NO STATEMENT IN THIS CATA L O G , BILL OF SALE, INVOICE, OR ELSEWHERE BY ANY REPRESENTATIVE OF, OR PERSON IN THE EMPLOYMENT OF RANDY INMAN AUCTIONS, INC. SHALL BE DEEMED TO BE A REPRESENTATION, ASSUMPTION OF LIABILITY, OR AN EXPRESS OR IMPLIED WA R R A N T Y, INCLUDING THE IMPLIED WA R R A N T Y OF MERCHANTABILITY OR FITNESS FOR A PA RTICULAR USE, WITH RESPECT TO AGE, CONDITION, SIZE, Q U A L I T Y, VA R I E T Y, IMPORTA N C E , PROVENANCE, OR HISTORICAL RELEVANCE OF ANY OF THESE ITEMS. ANY SUCH STATEMENTS ARE STRICTLY M ATTERS OF OPINION. If a potential bidder wishes to use an independent agent, both parties are bound by the same Te rms of Sale stated here .
2. ABSENTEE BIDS: A. Mail or fax: As a service to our customers who cannot attend the sale in person, Randy Inman Auctions, Inc. will execute bids if so authorized by mail or fax. All lots purchased for absentee bidders will be done so at the lowest possible price re g a rdless of the amount of the order bid. We cannot execute "buy" bids. In the event of tie bids between absentee bidders and those p resent at the auction, pre f e rence will be given to the attending bidder. In the event of identical bids from absentee bidders, pre f e re n c e will be given to the first received. Absentee bidders should use the enclosed form and clearly mark the lot number, title and maximum bid. B. Deposit: A 20% deposit will be re q u i red with all absentee bids. In the event that items p u rchased by absentee bid are not fully paid for within 15 days, the 20% deposit will be f o rfeited and the item will be resold. C. Shipping: Packing, shipping, and insuring any items purchased by absentee bids can be a rranged by Randy Inman Auctions, Inc. and will be billed separately. UPS is the standard mode of shipping. Any other requests should be communicated in writing. D. Telephone Bids: As an added courtesy to our absentee bidders, Randy Inman Auctions, Inc. will have telephone lines available for absentee bidders who would like to participate by phone during the auction. To qualify for a phone line, the same pro c e d u re for absentee bids must be followed (see above). The absentee bid form must be completed and mailed or faxed with lot number, title, maximum bid ord e red and a request for “PHONE.” If the item has re a c h e d m o re than your bid ord e r, you may at that time continue the bidding by phone. If it sells for less than your bid price, then like all absentee bids, it is yours for the hammer price re g a rd l e s s of the amount of your bid. A 20% deposit must accompany the absentee bid form for us to execute the bid. Please Note: Randy Inman Auctions, Inc. cannot guarantee that all phone requests will be honored. Due to heavy demand at certa i n segments of the auction, it may be impossible to have a line available. Although Ra n d y Inman Auctions, Inc. will try to accommodate each and eve ry request, we cannot assume responsibilities for any missed call due to human or technical erro r. In the eve n t of a missed call, the written absentee bid will still be executed.
3. PROTESTED BIDS: The Auctioneer will be the final judge as to which bidder is the highest b i d d e r. In the event of any dispute in this m a t t e r, the auctioneer shall at his discre t i o n decide to reopen the bidding or not.
4. RESERVES: This is basically an unre s e rv e d auction, only a few items in the sale carry c o n s e rvative re s e rves. Please Note: Re s e r ves on an object are e xecuted by the Auctioneer who will compete against the audience until th e re s e r ve is exceeded, just the same as he wo u l d e xecute an absentee bid. Actual re s e r ve fi g u res cannot be divulge d .
5. TITLE: Title to all merchandise shall pass to the highest bidder at the fall of the Auctioneer’s “hammer.” The purchaser shall assume full risk and responsibility of the lot p u rchased once title has passed.
6. SALES TAX: The buyer shall be re q u i red to pay Pennsylvania Sales Tax (6%) unless exemption is allowed under the laws regulating such t a x .
7. BUYER’S PREMIUM: A 15% buyer’s p remium (for cash or check payments) will be added to all successful bids through eBay and payable as part of the total purchase price.
8. ALL SALES ARE FINAL .
9. PAYMENT: All accounts are to be settled by the end of the sale unless other arr a n g e m e n t s have been made beforehand. Payment may be made by personal check if credit has been established with Randy Inman Auctions, Inc. or a letter of bank guarantee from your local bank. We re s e rve the right to hold all merc h a ndise paid for by check until such check has c l e a red the bank. Please Note: ALL SALES ARE FINAL. In consideration of Randy Inman Auctions, Inc. acceptance of payment by a bidder in a medium other than cash or cert i fied funds (i.e., credit card or check), if Randy Inman Auctions, Inc. must collect payment because p ayment is stopped, canceled or oth e rw i s e not honored, the bidder here by agrees th a t Randy Inman Auctions, Inc. is entitled to collect from the bidder any and all costs Randy Inman Auctions Inc. may incur to collect payment from the bidder including, but not limited to, attorney’s fees and legal c o s t s .
10. INTEREST: Payment is due upon receipt of invoice. Interest will be charged on all balances not paid at the rate of 1 1/2% monthly (18% APR) effective 15 days from the date of p u rc h a s e / a u c t i o n .
11. DEFAU LT. Should the buyer not comply with any of the Te rms of Sale, the damage recoverable from the defaulter shall include any loss arising on the resale of the lot, together with the charges and expenses in respect of both sales, and any money deposited in part payment shall be held by Randy Inman Auctions, Inc. on account of any liability on the defaulted item(s). The customer is also liable for any legal fees incurred in the collection of this account.
12. WITHDRAWAL: We re s e rve the right to withdraw any pro p e rty before the sale and shall have no liability whatsoever for such withdrawal.
13. ACCEPTANCE OF TERMS: Bidding on any lot indicates your acceptance of these Te rms of Sale. Randy Inman Auctions, Inc. and their re p resentatives re s e rve the right to refuse admission or request the depart u re of any person/persons that are acting in a manner unbecoming to the success of the auction p review or auction.
