This is an internet and telephone bid auction only. There will be no live in house bidding.
Please let me know if you as soon as possible if you are contemplating a phone bid on a specific item as I have a limited number of staff and can not guarantee the ability to accept every phone bid request.

SHIPPING
Handling can take one to two weeks. We do not offer in house shipping. I will endeavor to get your item out as fast as possible after payment.
Bidder is responsible for all shipping and packaging costs. Here are a few recommended local professional shippers:

I will be happy to drop off your item at either of the two shippers above, Postal Annex and The Fallbrook UPS Store but you will have to make contact with them first. Other shippers will have to pick up the item from the Gallery, after making telephone arrangements with me. You are welcome to come to the gallery and pick up the item in person after payment has been made but you will have to call me and make arrangements first. I can be reached at 760-731-9355.
Blue Heron Auctions LLC is not liable for any damages incurred by shippers or by pickup and delivery agents or in shipping and delivery of items.
Items must be shipped or picked up within 10 days of auction. On the 11th day Blue Heron Auctions has the option to charge storage fee of $10 per item per day. On the 31st day Blue Heron Auctions has the option to resell the item, under bidder's name, at 35% commission, no minimums, no reserves.
PAYMENT
The highest bidder on a lot shall be the buyer of the lot. All sales are final.The purchase price shall be the sum of 1) the price at which the item is sold, plus 2) The buyers premium of 28% (this included a 3% CC processing fee). Payment must be submitted within 3 days of close of auction to Live Payments. If you wish to pay me directly through either a wire transfer, cash or cashiers check I will deduct three (3) % from the buyer?s premium and you will pay 25% in those instances. If necessary contact us for wire transfer details. All payments must clear prior to shipping or pickup. On any cash transactions or series of transactions exceeding $10,000, Treasury Form 8300 will be filed.
*California residents pay 10.25% unless we are provided Sales Tax documentation.

PREMIUM: Buyer's premium of 28% for internet bids, phone and left bids added to the hammer price of each lot and will be considered as part of the total purchase price.
PAYMENT: All payments besides wire transfers and cashiers checks must be made through Live Auctioneers payment system using "Pay Now" option on invoice.
SHIPPING: If your item(s) are damaged in shipping, you will need to contact the shipper to file a claim.

There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. Blue Heron Auctions LLC strives to describe all items to the best of our knowledge, however we are not liable for errors or omissions, authenticity, signatures, origin, materials, quality, rarity or other discrepancies. All measurements are approximates. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. This is a sight sale. Each bidder must rely on his or her own judgment of grade. Blue Heron Auctions LLC reserves the right to withdraw any lot at any time before the auction without liability. Blue Heron Auctions, LLC and/or Auctioneer reserves the right to reject a bid from any bidder. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the item in dispute. No employee or agent of Blue Heron Gallery Auctions LLC is authorized to make on our behalf or on that of the consignor any representation or warranty, oral or written, with respect to any property.
Internet bidding is offered as a service to our customers, and prospective bidders shall not hold us responsible for any errors or failures in executing bids, nor shall they hold us responsible for any failure due to the loss of the auction applet supplied to us by LiveAuctioneers. Internet bids are bid electronically by the computers of LiveAuctioneers and compete against live bids on our auction floor, telephone bids, and absentee bids by bidders who are not participating in the internet component of the auction. Internet bids are announced competitively by a member of our staff at the time of the live auction. Blue Heron Auctions LLC may be offered other bids of the same value as your internet bid. It is at the auctioneer's discretion which of these bids it chooses to accept during the auction.
Acceptance and Rejection of Bids. Blue Heron Auctions LLC reserves the right to accept or reject any bid for any reason whatsoever. The highest bidder acknowledged by Blue Heron Auctions LLC will be the actual buyer. In the event of any dispute between bidders, or in the event of doubt on Blue Heron Auctions LLC part as to the validity of any bid, Blue Heron Auctions LLC will have the exclusive final discretion to determine the successful bidder, cancel the sale, or to re-offer and resell the item in dispute. Blue Heron Auctions LLC is not responsible for any errors or omissions in connection therewith. Blue Heron Auctions LLC shall be the sole arbitrator in case of any disputed bid.
Reserves. It is the policy of Blue Heron Auctions LLC to act as agent on behalf of the sellers; Blue Heron Auctions LLC does not permit a seller to bid on his or her own lots unless expressly so stated or except as herein set forth. Unless advertised otherwise, some lots may be offered subject to a reserve. A reserve is the minimum price that the seller is willing to accept for the lot, which may or may not be disclosed, and which may be determined or modified at any time by written or verbal communication between the seller and Blue Heron Auctions LLC through conclusion of the auction sale for that lot. If a reserve is established, it is generally at a percentage of the low estimate and will not exceed the low estimate for the lot. It is important for all bidders to know that Blue Heron Auctions LLC may open the bidding on any lot by placing a bid on behalf of the seller, and may continue to bid on behalf of the seller up to the amount of the reserve price, either by placing consecutive bids or by placing bids in response to other bidders. Blue Heron Auctions LLC will not place consecutive bids on behalf of the seller above the reserve.
Withdrawal of lots. Blue Heron Auctions LLC reserves the right to withdraw any lot before or during the sale and shall have no liability whatsoever for such withdrawal. No participant in the auction sale shall have a right to claim any damages, including consequential damages if a lot is withdrawn.
INTERNET BIDDING: It is the sole responsibility of the Internet bidder to be familiar with the Internet bidding process. The uploaded results of the auction take precedence over any and all messages of high bids during online or live bidding.

If you have not contacted Blue Heron Auctions LLC to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
