Terms & Conditions
In order to participate in a GMIL Fine Art auction, the bidder must accept the following terms:
1 All bidding is made in US$ and a Buyer's Premium of 28% will be added to the hammer price in order to determine the total amount to be paid for the auction item...Canadian sales tax is applicable to all bidders in Canada. Applicable sales taxes will be charged to any state requiring them under the new internet sales laws....to the total price includes the hammer price; the buyer's premium; any applicable taxes.
2 Online bidding is done only by registering in advance.
GMIL Fine Art will not be held responsible for errors or failure to execute bid(s). Absentee bids may be made prior to the auction through Live Auctioneers.
3 Absentee and phone bidding may also be placed directly with GMIL Fine Art. Those who wish to make a phone bid during the live auction must register for that in advance as we only have a limited number of phone bidders at one time.
4 Shipping and packing charges will vary with each lot and lots will be combined for the best shipping rate. All shipping will be done by our 3rd party shipper PakShip. Their phone number is 905-470-6874 in Markham, Ontario.
5 Payment of purchases shall be made upon notification of a successful bid and shall be done no later than 5 days after the auction date. No shipments will be made and title will not pass to the buyer until payment has been made in full. All packing/shipping/insurance charges are to be to the account of the purchaser. Please note that there are no taxes due on art from Canada to the US.
6 Payment may be made in the form of credit card up to $10,000. Amounts over $10,000 must be made by wire transfer only. ALL bidders outside of North America must make payment by wire transfer only.
7 The highest bid recognized by the auctioneer shall be considered the winning bidder. If any dispute arises between two or more bidders, the auctioneer shall determine the winning bidder.
8 Questions regarding any lot in the auction may be made prior to the auction date by email or by calling our phone number 1-905-534-0057.
9 GMIL Fine Art reserves the right to withdraw any lot before the sale and will assume no liability for such withdrawal
10 All items in the auction are sold as described and all sales are final. Prospective bidders may ask for additional photos prior to the sale. No statement or condition, genuineness, attribution, provenance, authenticity, value or quality shall be construed to be an expressed or implied warranty, representation or assumption of liability by GMIL Fine Art. If an item is materially different from the description of the lot, the buyer shall have 48 hours from the date of receipt of the property to notify the seller; after which the item(s) will be considered "as is" without recourse. Lots with a hammer price of $200 or less are not returnable for any reason.
11 If an item is returned for reason, the purchaser shall not be entitled to any remedy, relief or damages beyond the refund of the original purchase price and shall not be entitled to damages of any kind. If we are prevented for any reason in the delivering of property to the purchaser, our liability shall be limited only to the amount actually paid by the purchaser.
12 This is the entire terms and conditions relating to the auction by GMIL Fine Art and may be amended from time to time as necessary and posted on the LiveAuctioneer.com website. Any dispute of these terms and conditions shall be governed by the laws of the province of Ontario.
