Please be advised that by placing a bid, you are entering into a legally binding contract with BIDHAUS. If you are the successful winning bidder, you have a legal obligation to purchase the item(s) won from Heartland Estates & Auctions, (HEA). Furthermore, a bidder acknowledges that proper and careful due diligence has been conducted prior to placing any bid, and that the bidder knowingly and willfully placed a legally binding bid. HEA reserves the right to withdraw or combine any lots listed in the auction at any time with no liability. Furthermore, BIDHAUS reserves the right to cancel or replace an order post auction if (a) it does not successfully pass and meet our quality control standards prior to shipping, (b) is no longer available because our products may be offered simultaneously on multiple platforms, or (c) it was sold in error by our Auctioneer. In the event this occurs, HEA may provide the winning bidder with the same, similar or upgraded item at no additional charge to the bidder; or at HEA' sole discretion, provide a refund or credit. Any Customer credit(s) will expire one (1) year from the date of issuance. The successful winning bidder is the highest bidder acknowledged by our Auctioneer. HEA and its Auctioneers will have final discretion in determining the winning bidder and in resolving any disputes between bidders. If any dispute arises after the sale, the HEA sale record shall govern. Winning bidders must pay for the entire invoice before the items are removed from our inventory or any other online platforms. Many items are consigned to HEA and may be simultaneously offered for sale on multiple online platforms. If a listed item becomes unavailable, HEA will attempt to remove the item from the auction on a best-efforts basis. Consequently, HEA may provide the winning bidder with the same or similar item at no additional charge to the winning bidder, or at HEA' sole discretion, provide a refund or credit. Buyer's Premium Each lot sold in our auction is subject to a fifteen percent (15%) Buyer's Premium, unless specified otherwise. (For example: A $100 Hammer (bid) will equate to $100 Hammer + $15 Buyers Premium for a total of $115.) Reserves This is an absolute auction. There will be no reserves. Condition We have tried to accurately describe every item. Condition and substantial defects are disclosed and/or photographed. Accordingly, minor defects or smells may not be disclosed, which can be expected in pre-owned or vintage items. Please review images carefully as all items are SOLD AS IS. Keep in mind that on certain monitors, photos and light may depict slight color variations. Unless specified in the lot description, the item may not come with a box, papers, dust-bags, or authenticity card/certificate. Furthermore, any representation of serial numbers and/or unique item date codes may only be shown as a reference for their physical location on the item and may differ on the actual item won. Return Policy All items are SOLD AS IS, with all disclosed faults to the best of our ability and knowledge. ALL SALES ARE FINAL. In the event an item description does not match the item received, HEA will provide a refund, credit or exchange. Return or exchange requests may only be made within three (3) days from the date on which the winning bidder receives their items from HEA and must notify HEA Customer Support (qcheartlandestates@gmail.com) of any discrepancies. HEA expressly reserves the right to find an acceptable replacement or should replacement be unavailable, refund the Customer. HEA also reserves the right to reject any returns or exchanges that do not comply with the requirements listed above. Return requests for any other reasons, contrary to the above, may only be made within three (3) days from the date on which the winning bidder receives their items from HEA and must notify HEA Customer Support (qcheartlandestates@gmail.com) with an explanation, which may be approved at HEA' sole discretion. A restocking fee of twenty percent (20%) will be deducted from the Hammer and Buyer's Premium Invoice total. Shipping, handling and insurance charges are non-refundable. Customers are responsible for fully insured return shipping. The Customer must make sure to carefully package and provide tracking information for the item(s) they are returning. All authorized returns must be received in the same condition as when they were originally shipped to the Customer, or they will be returned to the Customer at their cost. Any unauthorized returns will be discarded, and the winning bidder will relinquish any and all claims to these items. Refusal to accept merchandise delivered by BIDHAUS to the winning bidder constitutes an unauthorized return in direct violation of these Terms and Conditions. Liability and Disclaimer HEA, its Vendors and/or Consignors disclaim any warranties, express or implied, including but not limited to the Implied Warranty of Merchantability or Fitness for any particular purpose. Neither HEA, nor its Vendors and/or Consignors will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of an item. While HEA representatives, to the best of their ability, describe the items for sale, any statement, whether oral or written, by the Auctioneer or by any authorized HEA representative are mere opinions and shall not be deemed a warranty or representation regarding the item(s) offered for sale. Any low or high estimates provided in any auction catalog or by the Auctioneer prior to, or during a live auction does not constitute an appraisal and does not represent a resale value. Estimates are calculated based on a combination of previous sales for similar items, supply and demand, rarity, and targeted price range. Estimates are not Reserves and do not indicate a minimum price needed for an item to be sold. Estimates are provided merely as an estimation of similar items in new retail conditions and are meant to compare the sale of new items versus purchasing a second hand or used item(s). The bidder is responsible for determining the age, size, condition and value of the item(s) before bidding. By placing a bid, you signify that you have examined the item to your satisfaction or have chosen not to examine it.
