TERMS AND CONDITIONS All bidders-buyers agree that they have read and understood all of LaShoppeVintage?s terms and conditions and agree to be bound by them. 1. Preview of items available by appointment only or available for preview at www.liveauctioneers.com . Please let us know in advance what lots you would like to inspect and when you are planning to come for an inspection. A premium equal to 18% of the final bid price will be applied to each lot sold, to be paid by the buyer as part of the purchase price. 3. We ONLY ship to the UNITED STATES (excluding Hawaii and territories) and to CANADA. 4. We offer in house shipping. We will take away the stress away from you by packaging and shipping your item. We always ship with a tracking number and this number will be provided to you. You are responsible for tracking your order. We are not responsible for your item once it leaves our premises. For orders over $300 CAD for each item (shipping and taxes not included) a signature on delivery will be requested, therefore please ensure that you are available to receive your parcel(s). Item ships out within 5-7 business days after close of auction. The shipping fee category will be written in the item description. We will charge the bidders-buyers the credit card you used to register for the auction for the amount of your shipping invoice. The shipping cost includes (packing, shipping (only the shipping portion not the related fees), and insurance). Buyers are responsible for any import taxes, customs duties, and-or fees imposed by the destination country. These charges are typically due once the package arrives in the destination country. Unfortunately, we am not responsible for any lost, stolen, missing, undeliverable or unclaimed parcel(s) and no refund or any other type of compensation will be given should this happen. In addition, no recourse towards LaShoppeVintage will be possible should your parcel(s) be lost, stolen, missing, undeliverable or unclaimed. LaShoppeVintage assumes no responsibility or liability for shipping, packing, moving, or transportation, including without limitation damage to Lots, damage to Buyer's or any persons involved vehicle, or any personal injury of any persons involved (including buyer?s). LaShoppeVintage WILL NOT CANCEL SALE DUE TO SHIPPING. Should items be returned to the LaShoppeVintage listing agent due to incorrect address provided at checkout or shipping errors, the buyer will be obligated to make a 2nd payment for shipping, and will be liable for other fees and taxes that were associated with the lot(s) being directed back. Should the buyer not honor the obligation, they will violate the terms of the sale. Should the buyer want to be released from the sale after the initial payment, it is at LaShoppeVintage?s discretion to honor that request. However, the shipping cost and excess fees would be withheld from the refund as services rendered. 5. Bidding is only possible through online on the LiveAuctioneers platform. We don?t offer any other type of bidding or purchasing options. LaShoppeVintage accepts no liability for equipment failure, inability to access the internet or software malfunctions related to the execution of on-line bids. All binds are final. By placing a bid or winning a bid, you agree to have agreed to all the terms and conditions. Within a maximum of 24 hours of the close of the auction, we will charge the credit card you used to register for the auction for the whole amount of your invoice. We only accept the credit card and related details of the credit card holder that is on file that you used to register for the auction. We do not ship to an address that is not associated with the credit card on file. We automatically charge the shipping fee to your invoice. If you wish to not have your item shipped and will be picking up your lot locally, please contact us immediately (up to 3 hours after the close of the auction). If we do not hear from your 3 hours after the close of the auction, we will assume that you require shipping and proceed with charging your credit card and shipping out your lot. In the case of a disputed bid, LaShoppeVintage have sole discretion in determining the purchaser and may also, at their election, withdraw the lot or reoffer the lot for sale. LaShoppeVintage shall have sole discretion to refuse any bid, or refuse to acknowledge any bidders-buyers or admission to the auction. Acceptable forms of payment are VISA, MasterCard and American Express, payable in Canadian dollars. Invoice must be paid in full. LaShoppeVintage reserves the right to hold merchandise purchased until the funds have cleared. 6. If the bider-buyer breaches any of its obligations under these Terms and conditions, including its obligation to pay in full the purchase price of all items for which it was the highest successful bider-buyer, LaShoppeVintage may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the bider-buyer to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price other fees, holding the purchaser liable for any deficiency plus all costs of sale. 7.Online purchases from LaShoppeVintage may be subject to sales tax. Please view LiveAuctioneers articles for more details. Canada residents are subject to Canadian sales tax regulations. Subject to the foregoing provisions, any Lot that is not picked up by the end of the day on the tenth calendar day following the conclusion of the Auction is subject to an additional storage charge of $5.00 per Lot per day ("Storage Charge") for as long as the Lot is stored at LaShoppeVintage facilities. The outstanding amount of this Storage Charge must be paid in full (in addition to the Purchase Price) before such Lot will be released to the Bidders-buyers . Such Storage Charge accrues on a daily basis and is billed monthly. The maximum allowance of storage days that we will keep a lot is 30 business days following the day of conclusion of the auction. After those 30 business days, bidders-buyers agrees that didn?t claim property, to release all rights to the lot and it becomes property of LaShoppeVintage. These unclaimed lot(s) may be placed in a subsequent auction, and LaShoppeVintage will not remid any proceeds to the bidders-buyers that didn?t claim the property.. All items handled or stored will be at the Bidders-buyers 's risk. LaShoppeVintage is not liable for any damage to Lots after the conclusion of the Auction. 9. All bidders-buyers s and buyers shall present satisfying documentation prior to the approval of this auction. 10. This auction contains items with 'no reserve' or 'reserve' pricing, as indicated in each item description. An item with 'no reserve' means there is no minimum price set, so the item is guaranteed to sell regardless of what the winning bid price is. An item containing a 'reserve' means that there is a minimum price that the bidding must reach to sell. At any moment LaShoppeVintage reserves the right to remove an item from the auction for any reason and with no recourse available towards LaShoppeVintage. 11. Please view and zoom in all images for item condition. All descriptions are based on the opinion of LaShoppeVintage. Descriptions including photographs, condition, weights, measurements, authenticity, provenance, manufacturer, artist, and origin are believed to be accurate, however neither LaShoppeVintage, the auctioneer nor consignor makes any warranty or representations of any kind to the merchandise being offered. Colours may be slightly different than shown due to screen variations. All measurements and weights are approximate. Keep in mind these are preowned items and there is visible wear all over from years of loving using. Everyone has a different perception of item quality, thus we leave it up to the bidder-buyer to decide and evaluate on an item?s condition. It is the responsibility of the prospective bidder to inspect the items and to determine the exact condition of each item. The absence of any reference in a condition report or photograph does not imply that an item is free from defect or restoration. The reference to particular defects does not imply the absence of any other defects. No staging elements are included in this sale. LaShoppeVintage is not responsible for any omission or errors in the description, or a further verbal description given by the auctioneer. 12. Certain items may require a license or certificate prior to exportation and/or importation. It is the purchaser's responsibility to obtain any export and/or import licenses and/or required documentation. LaShoppeVintage has no obligation to assist bidders-buyers in applying for or obtaining such documentation, export and/or import license, and will charge bidders-buyers additional fees for such services. LaShoppeVintage shall neither be obliged to rescind a sale nor to refund any interest or other expenses incurred by the bidders-buyers where payment is made by the buyer-bidde in circumstances where an export license is required. The denial of any license or any delay in obtaining licenses shall not justify the rescission of any sale nor any delay in making bill payment for the Lot; and shall not limit or alter any of the obligations of the Bidders-buyers herein. 13. All bidding and sales are final. No refunds, returns, cancellations or exchanges for all items-services offered at auction. Bidders-buyers releases LashoppeVintage from any claims and compensation related to items sold, including for defective items, warranties, warranties of titles, items that caused damaged to a property or person, non-infringement, merchantability, fitness for a particular purpose, misrepresentations, items that caused physical injury (like product liability claims). Bidders-buyers understands that our services and sold items are provided ?AS IS? and ?AS AVAILABLE? without any kind of warranty (express or implied) and no legal recourse towards LaShoppeVintage is possible. 14. For electrical or battery operated items, please ensure wiring, plugs, batteries, structure, material, and lightbulbs are compliant/safe before usage. Light cord is for USA-CANADA. Lightbulbs are not included. Please ensure cables or wires are away from children and pets. When purchasing jewelry, please ensure claps/connecting hooks are well closed before inserted a chain, charm, etc, or wearing your piece of jewelry purchased. We accept no responsibility or liability for the items that we sell. 15. Some lots in the auction are subject to a reserve or a confidential minimum sale price. The auctioneer in his sole discretion may open the bidding on any lot below the reserve and bid up to the reserve. 16. Any notices, published, posted, or oral, before or during the sale, are part of our terms and conditions of sale agreement. Acceptance of a bidders-buyers card or a bidders-buyers number constitutes acceptance of these terms and conditions of sale. LaShoppeVintage makes no warranty that a buyer acquires any copyright, trademark or reproduction rights as to any lot purchased. LaShoppeVintage, reserves the rights to reproduce any image of any lot sold at auction. the copyright in all images, illustrations and written material produced by or for LaShoppeVintage relating to a Lot including without limitation the contents of the Catalogue, is and shall remain at all times the property of LaShoppeVintage and shall not be used by the Buyer or Bidder, nor by anyone else, without our prior written consent. LaShoppeVintage and the Seller make no representation or warranty that the Buyer of a Lot will acquire any copyright or other reproduction rights in it. 17. If any part of these Terms and Conditions is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law.
