AUCTION TERMS & CONDITIONS
1. Acceptance of Terms
By registering for, bidding in, or participating in this auction, each bidder acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. Participation in the auction constitutes acceptance of all terms set forth herein.
2. Condition of Property
All lots are offered and sold strictly on an "AS IS, WHERE IS" basis, with all faults, imperfections, defects, restorations, repairs, alterations, and wear, whether visible or not.
Descriptions, photographs, condition reports, and verbal statements are provided solely as opinions and for informational purposes. They shall not be construed as warranties, representations, or guarantees of any kind.
Prospective bidders are encouraged to personally inspect property or obtain independent expert advice prior to bidding.
3. Authenticity Disclaimer
The Auctioneer, Seller, and Consignor make no representation, warranty, or guarantee regarding the authenticity, attribution, authorship, provenance, origin, age, medium, period, condition, or historical significance of any lot.
Any Certificate of Authenticity (COA), appraisal, provenance document, receipt, letter, or related paperwork accompanying a lot is supplied by the consignor or third parties and has not been independently verified by the Auctioneer.
The Auctioneer does not authenticate, investigate, validate, or guarantee the accuracy of any such documentation.
Bidders acknowledge that determining authenticity is solely their responsibility and that they have conducted their own due diligence prior to bidding.
4. Catalog Descriptions
Catalog descriptions reflect the opinion of the consignor, seller, or cataloger and are not statements of fact.
References such as "Attributed to," "Circle of," "School of," "Manner of," "After," or similar terminology indicate varying levels of uncertainty and should be interpreted accordingly.
No statement in the catalog, online listing, condition report, or advertisement shall constitute a warranty or guarantee.
5. Bidding and Contract Formation
The highest accepted bid acknowledged by the Auctioneer shall constitute a legally binding contract between the buyer and seller.
The Auctioneer reserves the right to:
? Reject any bid;
? Withdraw any lot;
? Re-offer any lot;
? Resolve bidding disputes;
? Cancel any sale resulting from error or technical malfunction.
6. Buyer's Premium and Taxes
The buyer agrees to pay:
? The hammer price;
? Any applicable buyer's premium;
? Applicable taxes;
? Shipping, handling, insurance, and related fees.
All amounts are due immediately upon receipt of invoice unless otherwise agreed in writing.
7. Payment
Accepted payment methods may include:
? Bank wire transfer;
? Personal Check
? Money Order
? Bank Transfers
The Auctioneer reserves the right to withhold shipment until payment has fully cleared.
8. Shipping and Delivery
Shipping arrangements may be provided as a courtesy to buyers.
The buyer assumes all risk of loss, damage, delay, theft, customs inspection, import restrictions, or other events occurring after the lot has been transferred to a carrier.
Shipping estimates are not guaranteed.
International buyers are responsible for compliance with local laws and import regulations.
Unless otherwise stated, customs duties, taxes, brokerage fees, and import charges are the responsibility of the buyer.
9. International Shipments
The Auctioneer shall not be liable for customs delays, governmental actions, import restrictions, quarantine procedures, confiscation, or additional charges imposed by authorities.
Delivery dates are estimates only and are not guaranteed.
10. No Returns; All Sales Final
ALL SALES ARE FINAL.
No returns, refunds, cancellations, exchanges, credits, or adjustments shall be permitted for any reason including but not limited to:
? Authenticity disputes;
? Attribution disputes;
? Provenance concerns;
? Condition issues;
? Restoration or repairs;
? Framing conditions;
? Buyer remorse;
? Differences of opinion regarding value;
? Shipping delays;
? Failure to inspect.
By bidding, the bidder expressly waives any right to rescind the sale except where prohibited by applicable law.
11. Chargebacks and Payment Disputes
By participating in this auction, the bidder agrees not to initiate a credit card chargeback, payment reversal, or payment dispute based upon:
? Authenticity claims;
? Attribution claims;
? Condition concerns;
? Provenance issues;
? Subjective dissatisfaction;
? Failure to inspect;
? Shipping delays beyond the Auctioneer's control.
Any dispute shall first be submitted directly to the Auctioneer for resolution.
The bidder agrees that these Terms and Conditions, the invoice, bidding records, lot descriptions, photographs, correspondence, proof of delivery, and related records may be submitted as evidence in response to any chargeback or payment dispute.
12. Limitation of Liability
The Auctioneer, Seller, Consignor, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from participation in the auction or purchase of any lot.
In all circumstances, liability shall not exceed the purchase price actually paid for the lot in dispute.
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Auctioneer conducts business.
Any dispute arising from the auction shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
14. Severability
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Auctioneer and bidder and supersede all prior oral or written communications regarding the auction.
By registering and placing a bid, the bidder acknowledges acceptance of these Terms and Conditions in their entirety.
