TERMS OF SERVICE
1. Agreement: By placing a bid in this auction, Buyer agrees to these terms and conditions. Please read these terms carefully. If you do not accept these terms and conditions, you may not bid in this auction.
2. WARRANTIES/REPRESENTATIONS:
All items are sold "AS IS, WHERE IS" with all faults. Neither Delmar Auction nor the consignor make any warranties or representations of any kind or nature with respect to merchantability, fitness, property, value nor of any other kind, express or implied. All items are available for your examination before the sale. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. Delmar Auction attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot including genuineness, attribution, provenance, authenticity, authorship, completeness, condition of property or estimate of value. All measurements are approximate. Antiques, by the very nature of their age, have wear that reflects their years of use. As a result, honest wear earned from use is to be expected and is sometimes the proof that an item is an antique. Normal wear will not be listed. Buyers who would like to know the fine points regarding condition should request a condition report at least three days prior to the sale. We recommend prospective bidders examine all items in which they have an interest in person. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have requested condition reports for the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question. All sales are final!
3. Condition Reports:
Delmar Auction provides condition descriptions in all of our lots. If you require additional information please make your request at least three days prior to the auction date. We can't guarantee that we will be able to answer requests made within the last 72 hours before the start of the auction.
4. Payment Methods:
All items sold are for United States Dollars. Delmar Auction accepts Credit card payments through the HiBid and LiveAuctioneers auction platforms. Delmar Auction will send you an invoice with all applicable fees within 3 days of the end of the auction. All invoices must be paid within 3 days of their receipt. For invoices not paid within 3 days, Delmar Auction will automatically process payment to the credit card on file with the platform. Failure to pay can result in exclusion from any future sales. Once payment is received for customers that opt to use our in house shipping service we will send you an additional invoice to your registered email address to pay the shipping cost.
5. Service Fee:
Be advised that LiveAuctioneers charges a credit card service fee of approximately 3% for credit card. This fee is the responsibility of the buyer.
6. Shipping:
Delmar Auction offers in house shipping for any lot that includes a shipping quote. The amount quoted will be for domestic USA shipping by a carrier of our choosing. International buyers please contact us for a shipping quote to your country. Purchased lots may also be subject to taxes or fees imposed by various foreign taxing agencies. Buyer is responsible for paying all domestic and foreign imposed taxes (including VAT's and GST's). We will combine shipping for multiple lots purchased at a reduced rate. The combining of lots will be at our discretion to ensure safe delivery. Buyer, at their own discretion, can arrange for their own shipping, in which case it is the sole the responsibility of the buyer. Delmar Auction will make its best effort to securely pack each and every item. However, Delmar Auction shall not be liable for any sold items damaged while in transit or any items lost by any carrier. In the event an item is lost or damaged while shipping, Buyer may only look to the shipping company for any compensation. It is the Buyer's responsibility to obtain adequate insurance for any shipped item. Please make sure to clearly indicate your insurance preferences. Packaging and shipping may take one to three weeks depending on demand. Once your purchase is shipped we will email you the carrier information and tracking number.
6a. Failure to collect or coordinate shipping within 30 days after the auction closes will incur a $10 per lot per week storage fee. Once accrued fees are equal to the total invoice value, the item will be forfeited and resold.
7. Sales Tax:
Applicable sales will be collected by the auction platform.
Autopay
If you have not contacted Delmar Auctions to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
Sales Tax
