# AUCTION TERMS & CONDITIONS
These Auction Terms & Conditions apply to every offer and sale of property made by Glass Of Venice and to all bidders and buyers participating in this auction. Please read these terms carefully before bidding.
By registering to bid, placing a bid, or purchasing any lot in this auction through LiveAuctioneers or any other approved bidding method, you agree to be bound by these Auction Terms & Conditions, as they may be amended by Glass Of Venice before or during the auction.
For purposes of these terms, ?Glass Of Venice,? ?we,? ?us,? and ?our? refer to Glass Of Venice. ?You? and ?your? refer to each bidder, buyer, or authorized agent participating in the auction.
Glass Of Venice sells authentic Murano glass products, including, but not limited to, Murano glass jewelry, Murano glass watches, vases, sculptures, figurines, bowls, tableware, chandeliers, lighting, home d?cor, decorative objects, collectibles, and related Murano glass items. Unless expressly stated otherwise in a lot description, all lots offered by Glass Of Venice are represented as authentic Murano glass.
## 1. DEFINITIONS
**Auctioneer:** The person or platform representative conducting or administering the auction.
**Buyer:** The highest bidder recognized as the purchaser of a lot, whether bidding live, absentee, online, or through an authorized agent.
**Lot:** Each item or group of items offered for sale in the auction.
**Property:** One or more lots offered for sale or sold in this auction.
**Hammer Price:** The highest accepted bid price for a lot, exclusive of buyer?s premium, taxes, shipping, handling, insurance, and any other applicable charges.
**Buyer?s Premium:** The commission or fee payable by the buyer in addition to the Hammer Price.
**Purchase Price:** The total amount due from the buyer, including the Hammer Price, Buyer?s Premium, applicable taxes, shipping, handling, insurance, storage, and any other applicable fees.
## 2. BUYER?S PREMIUM
A Buyer?s Premium of 25% will be added to the Hammer Price of each lot. The Buyer?s Premium is part of the total Purchase Price and is payable by the buyer.
Any LiveAuctioneers fees, payment-processing charges, sales tax, use tax, shipping, handling, insurance, customs duties, import fees, or other charges required by law or by the bidding platform are the buyer?s responsibility unless expressly stated otherwise.
## 3. SALES TAX
Applicable sales tax will be charged as required by law and/or by LiveAuctioneers as a marketplace facilitator.
Buyers claiming tax exemption must provide valid resale or exemption documentation before payment is completed. Failure to provide acceptable exemption documentation may result in sales tax being charged.
## 4. BIDDING AND REGISTRATION
All bidders must register and be approved to bid before participating in the auction. Glass Of Venice reserves the right, in its sole discretion, to approve, reject, suspend, or revoke any bidder?s registration or bidding privileges.
By placing a bid, you represent that you are legally able to enter into a binding contract and that you are bidding as principal unless you have disclosed that you are acting as an authorized agent for another party.
Any person bidding as an agent may be held jointly and severally liable with the principal for all obligations arising from the bid.
All bids are binding. A successful bid creates a binding purchase obligation. Bids may not be withdrawn or canceled except with the express written consent of Glass Of Venice or as otherwise required by applicable law.
## 5. ABSENTEE AND ONLINE BIDS
Absentee, online, and platform bids may be accepted for bidder convenience.
Glass Of Venice is not responsible for missed bids, bidding errors, internet outages, platform delays, software errors, transmission failures, or other technical issues affecting the placement, receipt, execution, or recording of bids.
In the event of a dispute regarding bidding, the Auctioneer?s or platform?s determination shall be final. Glass Of Venice?s records of the auction shall be conclusive in the event of any post-auction dispute.
## 6. AUCTIONEER?S DISCRETION
Glass Of Venice and/or the Auctioneer reserve the right, in their sole discretion, to:
1. Withdraw any lot before sale.
2. Divide, combine, or reorder lots.
3. Reject or refuse to recognize any bid.
4. Advance the bidding in any increment deemed appropriate.
5. Reopen bidding or reoffer a lot in the event of a dispute.
6. Pass a lot that does not meet reserve or other sale requirements.
7. Correct cataloging errors or amend lot descriptions before or during the auction.
All decisions of Glass Of Venice and/or the Auctioneer are final.
## 7. RESERVES
Some lots may be offered subject to a confidential reserve, which is the minimum price at which the lot may be sold.
Glass Of Venice may implement reserves by opening the bidding or by placing bids on behalf of the seller up to the reserve amount, where permitted by law and platform rules.
## 8. PAYMENT
Payment in full is due within five (5) business days after the auction or invoice date, unless otherwise agreed in writing by Glass Of Venice.
Accepted payment methods may include the LiveAuctioneers payment system, credit card, wire transfer, ACH, cashier?s check, or other approved methods.
Glass Of Venice reserves the right to require wire transfer, cleared funds, or additional verification for high-value purchases, first-time buyers, international buyers, or any transaction deemed higher risk.
No lot will be released, shipped, transferred, or made available for pickup until payment has been received in full and the funds have cleared.
If payment is not received when due, Glass Of Venice may, in its sole discretion and without limiting any other remedies:
1. Charge the payment method on file, where permitted.
2. Cancel the sale.
3. Retain any partial payments as liquidated damages to the extent permitted by law.
4. Resell the lot privately or at auction.
5. Hold the buyer liable for any deficiency, collection costs, storage fees, resale costs, attorneys? fees, and related expenses.
6. Suspend or revoke the buyer?s bidding privileges.
7. Report the nonpayment to LiveAuctioneers or other relevant platforms.
## 9. TITLE AND RISK OF LOSS
Title to a purchased lot passes to the buyer only after Glass Of Venice has received full payment in cleared funds.
Risk of loss or damage passes to the buyer upon the earliest of:
1. Transfer of title.
2. Release of the lot to the buyer or the buyer?s agent.
3. Delivery of the lot to a carrier, packer, shipper, or other third-party service provider.
## 10. PACKING, SHIPPING, AND DELIVERY
All packing, shipping, handling, insurance, customs duties, import fees, and delivery charges are the buyer?s responsibility unless expressly stated otherwise.
Glass Of Venice may, at its discretion, offer in-house packing and shipping or assist buyers in arranging shipment through a third-party shipper. Any such assistance is provided as a convenience only.
Glass Of Venice is not liable for loss, theft, breakage, delay, or damage occurring after a lot has been released to a carrier, shipper, packer, delivery service, or buyer?s agent.
Murano glass products, including jewelry, watches, vases, sculptures, lighting, tableware, and decorative objects, may be fragile, delicate, valuable, or require special packing, shipping, insurance, or handling.
Buyers should expect that professional packing, insurance, and shipping may be required and may be costly, especially for large, heavy, delicate, antique, or multi-piece lots.
If a buyer chooses a third-party shipper, that shipper acts as the buyer?s agent and not as an agent of Glass Of Venice.
Buyers are encouraged to obtain shipping estimates before bidding. Post-auction shipping cost, delay, or difficulty is not grounds for canceling a purchase.
International buyers are responsible for all customs duties, import taxes, brokerage fees, documentation requirements, and compliance with the laws of the destination country.
Glass Of Venice will not falsify invoices, understate values, or describe purchases as gifts for customs purposes.
## 11. PICKUP AND STORAGE
If pickup is available, purchased lots must be picked up within five (5) business days after payment has cleared, unless otherwise agreed in writing.
Lots not picked up or shipped within the required period may be subject to storage fees of $10 per lot per day.
Glass Of Venice may, in its discretion, transfer uncollected property to a storage facility at the buyer?s sole risk and expense.
## 12. MURANO GLASS AUTHENTICITY
Glass Of Venice sells authentic Murano glass products. Unless expressly stated otherwise in a lot description, all lots offered by Glass Of Venice are represented as authentic Murano glass or as containing authentic Murano glass components.
For Murano glass jewelry, watches, lighting, and mixed-material items, the Murano glass components are represented as authentic Murano glass unless expressly stated otherwise.
Non-glass components, including, but not limited to, chains, clasps, findings, bezels, watch movements, batteries, cords, sockets, metal hardware, wood bases, packaging, and accessories, are not represented as Murano glass.
Statements regarding maker, studio, designer, age, period, technique, color, dimensions, condition, provenance, rarity, or value are made in good faith based on available information, visual inspection, supplier documentation, catalog references, market knowledge, and/or expert opinion, where applicable.
Such statements are opinions and are not guarantees unless expressly stated as a written guarantee in the individual lot description.
Because Murano glass has been produced by many furnaces, artists, studios, importers, and distributors over many decades, attribution to a specific maker, designer, furnace, or period may be uncertain unless specifically documented.
Terms such as ?attributed to,? ?in the style of,? ?manner of,? ?similar to,? or ?possibly? indicate opinion only and should not be treated as a guarantee.
## 13. MURANO GLASS JEWELRY, WATCHES, AND MIXED-MATERIAL ITEMS
Murano glass jewelry and Murano glass watches may include non-glass components such as chains, clasps, findings, metal settings, stainless steel, silver, gold plating, leather, fabric, cords, watch movements, batteries, crystals, bezels, cases, crowns, and packaging.
Unless expressly stated otherwise in the lot description, only the Murano glass elements are represented as authentic Murano glass.
Metal content, plating, stone content, watch movement type, water resistance, battery condition, sizing, and other non-glass specifications are described in good faith when known, but are not guaranteed unless expressly stated in writing.
Watches and timepieces are sold as collectible decorative items and should be examined carefully.
Unless expressly stated otherwise in writing, Glass Of Venice does not guarantee the accuracy, water resistance, originality, completeness, service history, power reserve, battery life, or working condition of any watch, clock, movement, complication, strap, bracelet, clasp, or timekeeping function.
Watches may require service, repair, battery replacement, restoration, or adjustment at the buyer?s expense.
## 14. CONDITION
All lots are sold ?as is? and ?with all faults? unless expressly stated otherwise in writing.
Condition reports, descriptions, and photographs are provided for bidder convenience and represent good-faith opinions only. They are not exhaustive.
The absence of a condition statement does not imply that a lot is free of:
* Chips
* Scratches
* Fleabites
* Repairs
* Restoration
* Wear
* Manufacturing irregularities
* Inclusions
* Bubbles
* Pontil marks
* Ash
* Tool marks
* Color variation
* Missing parts
* Replacement parts
* Prior repairs
* Signs of use
* Other condition issues
Murano glass is handmade. Variations in shape, color, size, weight, pattern, texture, and finish are normal and should not be considered defects unless expressly described as damage.
Photographs may not accurately reflect color, size, scale, translucency, iridescence, aventurine, millefiori detail, gold or silver foil, surface texture, metal tone, watch dial condition, or overall condition.
Buyers are responsible for reviewing all photographs, requesting additional information when needed, and satisfying themselves as to condition, authenticity, value, and suitability before bidding.
## 15. DISCLAIMER OF WARRANTIES
Except for the limited authenticity representation regarding Murano glass stated above, and except as expressly provided in a specific lot description, Glass Of Venice makes no warranties, representations, or guarantees, express or implied, with respect to any lot, including, but not limited to:
* Merchantability
* Fitness for a particular purpose
* Non-infringement
* Investment value
* Resale value
* Condition
* Attribution
* Age
* Provenance
* Rarity
* Metal content
* Watch function
* Water resistance
* Battery life
* Timekeeping accuracy
No employee, contractor, consultant, representative, or agent of Glass Of Venice is authorized to make any warranty or representation inconsistent with these terms unless confirmed in writing by an authorized officer of Glass Of Venice.
## 16. LIMITED RIGHT OF RESCISSION FOR MURANO GLASS AUTHENTICITY
The original buyer may request rescission of a sale only if the buyer establishes, to the reasonable satisfaction of Glass Of Venice, that the lot was materially misdescribed as authentic Murano glass or as containing authentic Murano glass components.
To make such a claim, the buyer must provide written notice to Glass Of Venice within thirty (30) calendar days after the auction date.
The notice must state the basis for the claim and include supporting documentation. Glass Of Venice may require one or more written opinions from recognized experts in Murano glass at the buyer?s expense.
The lot must be returned to Glass Of Venice, at the buyer?s sole expense and risk, in the same condition as when sold, with all original packaging, labels, certificates, accessories, and accompanying materials, within seven (7) calendar days after Glass Of Venice requests its return.
If Glass Of Venice determines that rescission is warranted, the buyer?s sole remedy will be cancellation of the sale and a refund of the Purchase Price actually paid for the lot.
Shipping, handling, insurance, storage, customs duties, import fees, third-party costs, and consequential damages are not refundable unless required by law.
This limited rescission right:
* Is available only to the original buyer.
* May not be transferred.
* Does not apply to condition issues.
* Does not apply to buyer?s remorse.
* Does not apply to shipping costs.
* Does not apply to post-sale damage.
* Does not apply to differences of opinion regarding attribution to a specific studio or artist.
* Does not apply to non-glass components of jewelry or watches.
* Does not apply to watch function, battery condition, sizing, metal content, or plating.
* Does not apply to statements clearly presented as opinion.
## 17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Glass Of Venice shall not be liable for incidental, consequential, special, punitive, indirect, or compensatory damages, including, but not limited to:
* Lost profits
* Lost business opportunity
* Loss of use
* Loss of data
* Emotional distress
* Diminution in value
This limitation applies to damages arising from participation in the auction, purchase of any lot, use of LiveAuctioneers or any bidding platform, catalog errors, shipping delays, or post-sale handling.
If Glass Of Venice is unable to deliver a purchased lot for any reason after payment has been made, the buyer?s sole remedy shall be a refund of the Purchase Price actually paid for that lot. Glass Of Venice shall have no further liability.
## 18. COPYRIGHT AND USE OF IMAGES
All photographs, descriptions, catalog text, graphics, and other auction materials created or used by Glass Of Venice are protected by copyright or other intellectual property rights.
Buyers and bidders may not reproduce, distribute, publish, or commercially use such materials without the prior written consent of Glass Of Venice.
## 19. ERRORS AND AMENDMENTS
Glass Of Venice reserves the right to correct any errors or omissions in catalog descriptions, estimates, photographs, condition reports, invoices, or other auction materials.
Any correction or amendment made before or during the auction shall become part of these terms and the applicable lot description.
## 20. GOVERNING LAW AND VENUE
These Auction Terms & Conditions and all related transactions shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
Any dispute arising out of or relating to the auction, any bid, any purchase, or these terms shall be brought exclusively in the state or federal courts located in Bergen County, New Jersey, unless arbitration is required under the dispute-resolution section below.
## 21. DISPUTE RESOLUTION
Any dispute, claim, or controversy arising out of or relating to this auction, any lot, any bid, any purchase, or these Auction Terms & Conditions shall first be addressed through good-faith written communication between the buyer and Glass Of Venice.
If the dispute cannot be resolved informally, Glass Of Venice may require that the dispute be submitted to binding arbitration before a single neutral arbitrator in accordance with the commercial arbitration rules of the American Arbitration Association or another mutually agreed arbitration provider.
The prevailing party shall be entitled to recover reasonable attorneys? fees and costs to the extent permitted by law.
Nothing in this section prevents Glass Of Venice from:
* Pursuing collection of unpaid amounts.
* Enforcing payment obligations.
* Recovering property.
* Seeking injunctive relief in a court of competent jurisdiction.
## 22. SEVERABILITY
If any provision of these Auction Terms & Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
## 23. ENTIRE AGREEMENT
These Auction Terms & Conditions, together with any lot-specific terms, posted notices, invoice terms, and applicable LiveAuctioneers platform terms, constitute the entire agreement between the buyer and Glass Of Venice regarding this auction.
By registering to bid or placing a bid, you acknowledge that you have read, understood, and agreed to these Auction Terms & Conditions.
