All internet bids carry the same legal and binding effect as if you were physically present at the auction. Statements made by the auctioneer on sale day take precedence over all printed or online material. While all information is believed to be accurate, there are no guarantees - expressed or implied. 1. AS-IS, WHERE-IS – ALL SALES FINAL • All property is sold “AS IS, WHERE IS.” No returns, refunds, or exchanges. No exceptions. All Sales Final. Bidder acknowledges and understands that no items may be returned after purchase. • Buyers are responsible for determining condition, age, authenticity, value, or any other factor before bidding. Please read all descriptions and view all photos. • Public inspection is available - bidders are encouraged to examine items in person when possible. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in. • Van Byars Auctions may provide descriptions in advertising, online, or at the auction, but these are for reference only and not a warranty or guarantee. • In no event shall Van Byars Auctions. be liable for implied warranties of merchantability or fitness for a particular purpose. 2. OFF-SITE & ONLINE BIDDING • Bidders participating remotely acknowledge they may not have the same ability to inspect items as on-site bidders. • The auction company will make every effort to provide accurate descriptions, but is not responsible for errors or omissions unless a material and intentional misrepresentation has occurred. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in. • Van Byars Auctions provides internet pre-auction and live internet bidding as a service to our customers. Under no circumstances will Van Byars Auctions be held responsible for internet outages, bidding software malfunctions, missed bids, delays in transmission, or any other technical issues. The auctioneer is not liable for any failure of the internet or bidding platform to function properly. We strongly recommend you do not bid using a mobile device. For best results, we recommend using a hard wired computer. • To ensure your bid is recognized, consider using the proxy-bid feature and submit your maximum bid at least 24 hours before the auction. • As a registered bidder you are responsible for each and every bid and your account, all bids placed on your account will be binding. 3. AUCTIONEER’S RIGHTS Van Byars Auctions reserves the right to: • Withdraw or re-catalog any items. • Accept or reject any bid. • Resolve any disputes at their sole discretion. SHIPPING INSTRUCTIONS: To comply with ATG / Live Auctioneers requirements, the Live Shipping option has been enabled for this auction. However, all purchased items must be removed from the auction site no later than Friday, September 4, 2026. Buyers may choose to have items shipped through Pak Mail of Newnan, an independent third-party shipping provider located at 1741 Newnan Crossing Blvd., Suite 1, Newnan, GA 30265. Phone: 678-423-8339. Van Byars Auctions has worked with Pak Mail for several years as a convenience to buyers. Shipping charges include the actual shipping cost, plus packing materials and labor. Buyers are solely responsible for requesting and paying for any declared value or shipping insurance. Van Byars Auctions does not provide packing or shipping services and is not responsible or liable for the packing, shipping, transportation, delivery, or pickup of purchased items, regardless of whether the buyer chooses self-pickup, a third-party shipper, or the Live Shipping service offered through the bidding platform. Buyers are solely responsible for coordinating all pickup and shipping arrangements, including all packing, crating, loading, transportation, insurance, declared value, and related costs. Van Byars Auctions assumes no responsibility or liability for communication, scheduling, delays, damages, loss, theft, claims, or disputes between buyers and any shipping provider, including those selected independently by the buyer or arranged through the Live Shipping program. Large, heavy, oversized, or unusually shaped items may require specialized handling or freight shipping and may not be eligible for standard shipping services. Buyers are responsible for determining appropriate shipping arrangements and all associated costs. Van Byars Auctions will work with the buyer and, when possible, assist in coordinating with an appropriate third-party shipping or freight provider; however, Van Byars Auctions does not arrange, provide, or guarantee freight services and assumes no liability for the services, actions, or performance of any freight carrier or shipping provider. Once an item has been tendered to any shipping provider or the buyer's designated representative, all risk of loss, damage, delay, or non-delivery transfers to the buyer. Van Byars Auctions assumes no responsibility or liability for the actions, omissions, or performance of Pak Mail, UPS, FedEx, USPS, freight carriers, or any other third-party shipping company or individual. By arranging third-party shipping, the buyer acknowledges that shipping services are a separate transaction between the buyer and the shipping provider. The buyer agrees not to initiate a chargeback or payment dispute against Van Byars Auctions for any shipping-related issue, including shipping costs, delays, damage, loss, claims, non-delivery, or the failure or non-performance of any shipping provider. As a courtesy, Van Byars Auctions will assist with transferring eligible items to Pak Mail of Newnan for shipment whenever possible. Our goal is to provide buyers with a smooth and efficient auction experience while facilitating the shipping process. Failure to remove purchased items or initiate shipping by Friday, September 4, 2026, may result in storage fees, abandonment of property, or other remedies as provided in the auction Terms & Conditions.

At the end of the auction, buyer's will receive an invoice with a "Pay Now" button to checkout securely via credit card. The buyer's credit card on file will be automatically charged within 24 hours if the invoice has not already been paid. Payment in US funds only. An additional 4% credit card fee will be automatically charged on all invoices. Bidder agrees that under no circumstances will he/she initiate a charge-back on his/her credit card. NO credit card purchases over $10,000. All sales are subject to local sales tax unless you have a tax exemption number, which must be provided to Van Byars Auctions and to the bidding platform prior to August 29, 2026. If you are tax exempt, your documentation must be provided. Tax-exempt refunds cannot be issued after invoices have been generated.

If you have not contacted VAN BYARS AUCTIONS to arrange payment within 1 day of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
