1.All bidders and buyers must provide satisfactory identification and documentation prior to approval to participate in this auction. Eluse reserves the right to refuse registration or bidding privileges at its sole discretion. 2.All property is sold ?as is.? Neither Eluse nor the listing agent makes any warranties or representations of any kind with respect to the property. In no event shall they be responsible for the correctness of, or be deemed to have made any representation or warranty regarding, the description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of any lot. No statement made at the sale, in the bill of sale, invoice, catalog, or elsewhere shall be deemed such a warranty, representation, or assumption of liability. Prospective buyers are strongly urged to inspect any lots in which they have an interest prior to bidding. 3.The highest bidder as determined by Eluse shall be the purchaser. In the event of a disputed bid, the auctioneer shall have sole and absolute discretion in determining the purchaser and may, at its election, withdraw the lot or re-offer it for sale. The auctioneer reserves the right to refuse any bid or to refuse to acknowledge any bidder. 4.A buyer?s premium equal to 15% of the final hammer price will be added to each lot sold and shall be paid by the buyer as part of the total purchase price. 5.Full payment must be completed within three (3) days after the auction ends. All merchandise is payable directly to Eluse. Accepted forms of payment include Visa, MasterCard, American Express, Discover, PayPal, and bank wire transfer, all in U.S. dollars. Invoices must be paid in full. Eluse reserves the right to refuse any particular payment method at its sole discretion and to hold merchandise until funds have fully cleared. Installment payments are not accepted. 6.If the purchaser breaches any of its obligations under these Conditions of Sale (including the obligation to pay the full purchase price), Eluse may exercise all available rights and remedies under applicable law, including without limitation: (a) canceling the sale and applying any payments already made toward damages caused by the breach; and/or (b) re-offering the lot at public auction without reserve and holding the purchaser liable for any deficiency plus all costs of sale. 7.Shipping costs are borne by the seller. Eluse will contact the winning bidder with shipping information after the auction and will arrange shipment. The buyer remains solely responsible for all applicable taxes, duties, customs fees, and any other charges arising from the importation of the item into the buyer?s country. For international shipments, Eluse will select suitable logistics providers based on the actual circumstances. If the buyer requests a specific shipping method, such request must be communicated in advance and agreed upon by both parties before shipment. Packaging, handling, and delivery are undertaken at the buyer?s risk once the item has left Eluse?s possession. Eluse shall have no liability for any loss, damage, delay, or return caused by the buyer?s failure to pay customs duties in a timely manner, failure to provide required customs clearance documents, provision of an incorrect shipping address, or any other buyer-caused reason. Eluse is not responsible for obtaining any export or import permits or licenses on behalf of the buyer. 8.All sales are final. No returns or refunds will be granted except in the case of a material discrepancy between the lot description and the actual item. Whether a material discrepancy exists shall be determined solely by Eluse at its reasonable discretion. Eluse?s decision on any such claim shall be final and binding. 9.By placing a bid on any lot, the bidder acknowledges and accepts these Conditions of Sale in full, together with any other terms printed, posted, or announced at the time of sale.
