Southernaire Antiques & Auction Auction Terms and Conditions These Terms & Conditions (?Terms?) govern all participation in auctions conducted by Southernaire Antiques & Auction (?Auction House?, ?We?, ?Our? or ?Us?). By registering to bid, consigning property, placing bids, or participating in any auction event, whether online, in-person, absentee, or by telephone, all participants (?Bidder?, Buyer?, or ?Consignor?) agree to be bound by these terms Registration & Bidder Approval 1.1 All bidders must register prior to participating in any auction. 1.2 The Auction House reserves the right to refuse registration , revoke bidding privileges, or remove any participant at its sole discretion. 1.3Valid government-issued identification may be required. 1.4 Online bidders may be required to provide a valid credit card for verification purposes. 1.5 By registering, the bidder represents that all information provided is accurate and complete. 2. Auction Format 2.1 Auctions may be conducted live, online, simulcast, timed, or in-person. 2.2 The Auction House reserves the right to: - Withdraw items from sale; - Divide or combine lots; - Add minimum bids or reserves - Cancel or postpone auctions - Resolve bidding disputes at its sole discretion. 2.3 The Auctioneer?s decision shall be final in all matters relation to bidding and auction conduct. 3. Condition of Items 3.1 All property is sold ?AS IS, WHERE IS?, with no guarantees, warranties, refunds, or returns unless otherwise stated in writing. 3.2 Descriptions, photographs, dimensions, and condition statements are provided as a courtesy and are opinions only. 3.3 The Auction House makes no representations regarding authenticity, provenance, age, condition, merchantability, fitness for a particular purpose, or completeness. 3.4 Bidders are strongly encouraged to inspect items prior to bidding. 3.5 Failure to inspect an item does not relieve the bidder of responsibility for payment. 4. Bidding 4.1 By placing a bid, the bidder enters into a legally binding contract to purchase the item if declared the winning bidder. 4.2 The highest acknowledged bidder shall be deemed the buyer. 4.3 In the event of a dispute between bidders, the Auctioneer my reopen bidding, determine th successful bidder, or cancel the sale. 4.4 The Auction House is not responsible for missed bids, internet interruptions, platform malfunctions, clerical errors, or technical issues. 4.5 Absentee and telephone bids are accepted as a convenience and are not guaranteed. 5. Buyer?s Premium & Taxes 5.1 A buyer?s premium of 23% shall be added to the hammer price of each lot unless otherwise announced. 5.2 Applicable Georgia Sales tax of 8% shall be collected unless the buyer provides a valid resale or tax exemption certificate. 5.3 Online bidding platforms my charge additional or processing fees. 6. Payment Terms 6.1 Payment is due immediately upon conclusion of the auction unless prior arrangements have been approved in writing. 6.2 Accepted forms of payment my include: - Cash; - Check (with valid ID) - Credit or Debit card - Other approved payment methods 6.3 The Auction House reserves the right to hold merchandise until payment has fully cleared. 6.4 Returned checks or failed payments my incur additional fees. 6.5 If payment is not received within the required timeframe, the Auction House may: - Cancel the sale; - Resell the item; - Charge storage fees; - Pursue legal remedies; - Ban the bidder from future auctions. 7. Pickup, Shipping & Storage 7.1 Buyers are responsible for removal of purchased items within the announced pickup period. 7.2 Items no removed within the stated timeframe may incur storage fees of $10 per item, per day. 7.3 Items left beyond 10 days may be deemed abandoned and resold without refund 7.4 Buyers assume all risk of loss or damage immediately upon being declared the winning bidder 7.5 Shipping services may be offered as a convenience. The Auction House is not responsible for damage, delay, or loss caused by third-party carriers. 7.6 Buyers are responsible for all shipping, handling, insurance, packaging, and transportation costs. 8. Firearms, Restricted Items & Compliance 8.1 Any firearm sales shall comply with all applicable federal, state, and local laws. 8.2 Buyers are responsible for determining whether they may legally possess any item purchased. 8.3 The Auction House reserves the right to refuse transfer of any regulated item. 9. Default by Buyer 9.1 If a buyer fails to pay for or remove purchased property, the Auction House my exercise any rights available under Georgia law. 9.2 The defaulting buyer shall be responsible for: - Any deficiency resulting from resale; - Collection costs; - Attorney?s fees; - Interest; - Storage fees; - Administrative expenses 10. Consigned Property 10.1 Consignors warrant that they possess legal ownership and authority to sell consigned property. 10.2 Consignors agree to indemnify and hold harmless the Auction House against claims relating to ownership, authenticity, liens, or title disputes. 10.3 Commission rates shall be agreed upon separately int he Consignment Agreement. 10.4 The Auction House reserves the right to decline any consignment. 10.5 Unsold items must be retrieved within 10 days following the auction unless other arrangements are made. 10.6 Consigned items removed from auction after cataloging, advertising, or scheduling my incur withdrawal fees of $10 per item 11. Liability Disclaimer 11.1 Persons attending auctions, previews, or pickup events do so at their own rick. 11.2 The Auction House is not responsible for accidents, injuries, theft, or damage to persons or property. 11.3 The Auction House shall not be liable for incidental, consequential, or special damages. 12. Online Auctions & Technology Disclaimer 12.1 The Auction House does not guarantee uninterrupted access to online bidding services. 12.2 The Auction House shall not be liable for technical failures, software issues, server outages, internet disruptions, or delayed bid transmissions. 12.3 In the event of technological issues, the Auction House reserves the right to reopen bidding, continue the auction, or suspend the sale. 13. Disputes & Governing Law 13.1 These Terms shall be governed by and interpreted under the laws of the State of Georgia. 13.2 Any legal action arising from these Terms or any auction shall be brought in the appropriate courts located in the State of Georgia. 13.3 The prevailing party in any legal dispute may recover reasonable attorney?s fees and court costs where permitted by law. 14. Privacy 14.1 Bidder information collected by the Auction House may be used for: - Registration; - Payment processing; - Auction communications; - Marketing and promotional purposes. 14.2 The Auction House does not sell personal information to third parties. 15. Acceptance of Terms By registering for or participating in any auction conducted by Southernaire Antiques & Auction, the participant acknowledges the have read, understood, and agreed to these Terms & Conditions. 16.
