Aphrodite Gallery's 3rd Ancient Art Auction Terms & Conditions Here are the TERMS OF SALE for bidding in our Live Auction for Tuesday, September 27, 2016. AUCTION will start at 8:00 AM PST, 11:00 AM EST, Live Absentee Bidding only. Please read the following "Terms of Sale" carefully. These terms are applicable to all bidders in this auction, collectors and dealers alike. Please do not bid in this auction if you do not agree to all of the terms listed below. Bidding in our auction constitutes your agreement and acceptance of our terms of sale. 1. All items in this auction are have been legally acquired with clear titles, are legal to sell, and guaranteed to be as described. Also, these items have been vetted by a third party. We provide a Certificate of Authenticity for every object we sell. 2. When bidding in this auction, the bidder personally guarantees payment. The auctioneer has final discretion in all matters. In case of dispute, the lot(s) in question may be resold. 3. All payments must be made in full prior to shipment. 4. Title remains with Aphrodite Gallery until payment is made. 5. Payment must be made in U.S. Dollars and may also be made via wire transfer, a personal check or money order, major credit cards (Visa, Mastercard, American Express, Discover), and PayPal. 6. There will be a 3% service charge for PayPal transactions. 7. There will be a 3% service charge for credit card transactions. 8. For PayPal payments, the recipient address is: aphroditeart@yahoo.com 9. For bank wire transfers, we will provide our bank wire instructions. 10. Buyer's Premium: An 22% Buyer's Premium will be added to the final price of each successful bidder's purchase lot. 11. For all New York state residents, we will add 8.875% tax to all invoices within New York state, unless a valid re-sale permit is on file with Aphrodite Gallery. 12. All other items shipped outside of New York are all exempt from sales tax 13. Return Policy: Returns will be allowed for any items sold through us, in the unlikely event they are proven to be unauthentic and verified in writing by a credible, accredited third party expert. This return period will be good for 7 business days from date of receipt. We must receive a notification of intent to return within this 7-day period. For a refund to be issued, we must receive the item in question back, in the same condition it was mailed, and the buyer will assume return shipment cost. No lot will be accepted for return without prior written consent. 14. This is an online / live bidding type of auction. Bidder may place their bids live, or by placing bids via the LiveAuctioneer auction catalog. 15. Shipping fees are the responsibility of the buyer. All successful bidders receive an invoice detailing their successful bids as well as their shipment charges. If a buyer ends up buying more than one lot in this auction, we can combine shipping to reduce shipping costs, provided they are for the same address. 16. USPS and UPS will be our two main shipping agents for U.S. shipments. For international shipments, USPS and DHL will be the shipping options, unless buyer chooses a different method. 17. All international buyers will be responsible for customs and import duties. 18. All bidders must register beforehand to be able to bid in this auction. 19. Estimates provided are for reference purposes only and the lot may sell above or below the estimate. 20. The starting prices are at the discretion of the auctioneer, and may be lower than the estimate, to encourage bidding. This is up to the auctioneer. 21. The auctioneer may open a bid on any lot by placing a bid on behalf of the seller. The auctioneer may accept or decline any bid, and that is up to his sole discretion. 22. For all successful bidders, payment is due within seven (7) business days. In the event a successful bidder fails to make payment within the timeframe it is due, Aphrodite Gallery reserves the right to resell the item, and bidder agrees to pay for the reasonable cost of such a sale. 23. If the auction invoice is not paid in full, as agreed, within the set date, the unpaid balance will bear interest at the highest rate permitted by law, until balance is paid in full. 24. In the event we refer an unpaid invoice to an attorney for collection, bidder agrees to pay all costs incurred by Aphrodite Gallery for this purpose, including: reasonable attorney fees, court costs, and all other collection costs incurred by Aphrodite Gallery. 25. Buyer agrees that New York state law may potentially apply towards any claim or dispute, at the discretion of the auctioneer. 26.
