ABOVE AND BEYOND AUCTIONS TERMS AND CONDITIONS (READ THIS)!!! 1. ONLINE, PHONE AND ABSENTEE BIDDERS MUST PAY FOR THEIR PURCHASES WITH A CREDIT CARD, PayPal or Wire Transfer. 2. International buyers must fill out the bid form completely before bidding. We MUST have your credit card information on file 48 HOURS BEFORE the auction. 3. All property is sold as is, where is. Condition reports are posted, INQUIRE BEFORE YOU BID. All sales are final. NO REFUNDS. We encourage you to thoroughly inspect every item that you wish to bid on. It is the sole responsibility of the buyer to determine age, authenticity and value of the item(s). 4. Condition reports are supplied upon request. 5. Written or oral descriptions are our opinions only and should in no way be construed as a guarantee or warranty of any kind. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend that you do not bid on the item in question. 6. All items must be paid for within 5 days. 7. All sales are subject to Florida Sales Tax unless a current Florida Certificate of Resale is on file at the time of registration. No exceptions. 8. All sales 15% buyers premium added to the hammer price. Local buyers who pick up their item locally and pay cash will be afforded a 3% discount. 9. The buyer shall be the highest bidder. Should a tie or dispute arise, the auctioneer, at his discretion, may reopen the bidding between the high bidders until the property is sold. If there is a tie bid between a floor bidder and internet bidder, the bid will go to the floor bid. 10. Neither the Auctioneer nor the Consignor shall be liable for any personal injury on the premises where the sale should be held, including, but not limited to, the removal of auction items from the premises. 11. Auctioneer reserves the right to reject any bids that are deemed inappropriate or withdraw any item before or during the sale. 12. All items will be shipped via UPS unless other arrangments are made. 13. Buyer hereby agrees that any suit, action or legal proceeding arising out of or relating to the auction shall be brought solely and exclusively in the courts of the State of Florida in and for Orange County. 14. Buyer further waives the right of jury trial, considering arbitration and reasonable means of reconciliation foremost. 15. Your registration at the auction guarantees that you have read and will abide by the terms and conditions of the Auction. All sales are audio tape recorded for your protection. 16. When the Auctioneer says, SOLD, title on the property shall pass to the successful bidder, who thereupon assumes full risk and responsibility. The purchasers at his own risk and expense shall remove said property unless prior arrangements have been made with the auction. 17. NO refunds. 18. All items purchased locally can be picked up locally by making arrangements via phone call. I would asked for all items to be paid for and picked up by local buyers within 4 days.
