The following are the TERMS OF SALE for bidding in the Timed Auction of Arte Antico, LLC scheduled for Spring 2021 Auction at 12pm pst. 12 Please read the following "Terms of Sale" carefully. These terms are applicable to all bidders in this auction. Your submission of bids in this auction constitutes your acceptance of these "Terms of Sale." 1. All items in this auction have been legally acquired, are legal to sell, and guaranteed to be as described or your money will be refunded. 2. By bidding in this auction, the bidder personally guarantees payment. The auctioneer has sole discretion in all matters. In case of dispute, the lot(s) in question may be resold. 3. Bidders will receive an e-mail notifying them if they have been outbid, as long as bid is placed one day prior to lot closing time. 4. High and Low Estimates are provided for each lot for reference only. Lot may sell for a price greater or less than the estimate. 5. Payment is due, in full, upon receipt of invoice. No lots will be released until payment in full has been made. Payment (in U.S. funds) may be made via personal check or money order. All buyers who pay by credit card must first have a credit card authorization form on file with Arte Antico, LLC prior to the auction. For the form, call 917-536-6049. Credit cards accepted are American Express, MasterCard, Visa or Discover. PayPal and Bank Wire Transfers are also accepted. For PayPal payments please use "arteantico@hotmail.com" email address for processing payments. Please note that all credit card payments and Paypal payments are subject to a 4% surcharge due to credit card processing fees. All invoices will have the 4% surcharge included, if your payment method is not by credit card or Paypal please email or call to have the charge removed from the invoice. International bidders payment by wire transfer only. No credit card or Paypal payments will be accepted for purchases over $2,000.00. Live Auctioneers credit card processsing fee is 2.8% 6. BUYER'S PREMIUM: There is a 25% buyers premium for all lots. 7. New York State Sales Tax: New York State Sales Tax will be added to all invoices, unless a valid N.Y.S. Resale Certificate is on file with Arte Antico, LLC. Items shipped outside of New York State (United States or international) will not be charged Sales Tax. 8. RETURN POLICY: ALL SALES ARE FINAL - NO RETURNS WILL BE ACCEPTED except at the discretion of the auction house. 9. BIDDING will be conducted online as the auction progresses or you may leave an absentee bid prior to the commencement of the auction. 10. SHIPPING: Buyer Pays Shipping Cost. All lots will ship within 10 business days after payment received. Lots will ship to address on the Live Auctioneers Invoice. Please make sure your shipping address is updated with Live Auctioneers. Most lots ship by in-house. Lots with third party notation in the description use third party shippers. Contact the auction house for a list of third party shippers. The Auction House does not accept responsibility of any agreements reached between Buyer and shippers, or any resulting loss, damage or delay resulting in the use of the shipper. If Buyer is required to arrange for their own shipment of merchandise, any and all liability of the Auctioneer is relinquished when item is received by the shipper, regardless of time item was paid for in full or how and/or when it was shipped or if merchandise has yet been received by Buyer. Once you have made shipping arrangements, you must submit a release form authorizing us to release your purchases to the shipper NOTE: DUE TO THE PANDEMIC INTERNATIONAL SHIPMENTS ARE EXPERIENCING DELAYS. 11. ALL BIDDERS must register in order to bid. 12. Buyer agrees that any claim of controversy arising out of, or relating to the formation, interpretation of performance of these terms and underlying transactions or the breach thereof, is subject to arbitration and shall take place within the County of New York, NY subject to the laws of the State of New York. 13. If you have not contacted Arte Antico, LLC to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
