George Ross DS as Pre-Revolutionary PA Prosecutor

2pp DS signed by Declaration signer George Ross (1730-1779) as "G. Ross" on the second page at center. The legal document pertains to Carlisle, Pennsylvania and is dated "July Term 1761". On watermarked cream bifold paper. Blank third page, and docketed on the last page. Inscribed overall in a bold secretarial hand. Expected paper folds are fragile, and there are some minor closed tears along creases. Overall even toning and edge darkening. Very good to near fine. 7.375" x 12.5".

Judges, lawyers, and jurors summoned to deliberate on civil and criminal cases in the July Term of 1761 in Cumberland County, Pennsylvania, located southwest of modern day Harrisburg, would have adjudicated the case of Cannon & Cannon vs. Gilston. Plaintiff Richard Gilston, represented by his attorney George Ross, accused "John Cannon & Robert Cannon late of Cumberland County yeomn" of failing to pay a debt of £8 and 3 shillings. Gilston also sought £20 in damages because he claimed the Cannons never intended to reimburse him.

In part, with unchanged spelling and punctuation:

"John Cannon & Robert Cannon late of Cumberland County yeomn was attached to answer Richard Gilston of a Plea of Trespass on the law &c and whereupon the said Richard by George Ross his Attry Complains that whereas the sd John & Robert the First day of May In the Year of our Lord One Thousand Seven Hundred and Sixty One at Carlisle in the County afsd was Indebted to the said Richard in the Sum of Eight pounds three Shillings lawfull Money of Pennsylvania…

Nevertheless the said John & Robert their promise & assumption afsd not regarding but deigning and fraudulently intending Him the said Richard in this behalf Craftily & Subtiley to deceive and defraud the afsd Eight pounds three Shillings…"

George Ross entered the Pennsylvania bar in 1750. Initially the young lawyer had Tory sympathies, but he radicalized sometime during the transition from private practice to his 12-year tenure as Crown Prosecutor of Cumberland County, Pennsylvania. Ross was one of nine Pennsylvania delegates to sign the Declaration of Independence. He was elected to three Continental Congresses, and served as a Colonel in the Continental Army. He died at age 49.
