GENERAL CONDITIONS

Conditions applicable to the sale - Applicable law
The sales by LECLERE MDV, as well as the present general conditions of sale which govern them with regard to the
bidders, are subject to French law. Any bid made by bidders in any form whatsoever (telephone, internet,
purchase order ...) or through any intermediary implies the acceptance of these general conditions of sale. The possible invalidity of a clause
will not lead to the nullity of the other conditions, which will remain applicable elsewhere.
Auctions
The Auctioneer who sells the sale is solely responsible for determining the bid price and bid level.
Means of bidding
It is possible to bid on the sale by being present or represented on the day of the sale, via websites, or by leaving a
written purchase order with LECLERE MDV at the latest fence of the exhibition. The possible costs of bidding by such or such a means are incumbent upon
the person who chooses to use them. To be admitted to bid, all persons must have registered with LECLERE MDV in advance
giving his name and surname and giving him a copy of a valid identity document. If the bidder is bidding on
behalf of a third party, the bidder must provide a copy of the third party's bid . If the third party is a company, it must indicate its name and justify its
right to represent it by providing a copy of its extract Kbis or any equivalent document. For technical or other reasons,
LECLERE MDV may not be able to contact the bidder in the event of a telephone auction, which can not be held
responsible. The registrants have a right of access and rectification of the information concerning them, integrated in the file
client of LECLERE MDV, recipient of this data.
Selling costs to be borne by the successful tenderer In
addition to the tender price ascertained by the hammer blow, selling costs will be payable by the successful tenderer. These fees are 27.6% inclusive of tax.
For online buyers on the invaluable.com site, an additional 5% tax will be levied.
The successful tenderer shall be held indivisibly to pay the tender price plus the selling costs calculated in accordance with the above conditions, in addition
to any other special costs.
Export
It is the responsibility of any bidder to inquire prior to the sale if he intends to export a lot. Delay or refusal by the administration
of the documents leaving the territory will not justify the questioning of the sale nor any compensation. The VAT collected may
be reimbursed to the successful tenderer provided that the latter submits the documents
justifying the exportation of the vehicle purchased within the deadlines and in the form provided for in the regulations in force .
Adjudication, payment of sums due and delivery
The sale is carried out in cash and conducted in euros. The successful tenderer is obliged to pay the price without delay, by bank transfer, bank check
or bank card. Issuance to the successful tenderer will only take place after full payment of the sums due to the LECLERE-MDV account and
handing-over of copies of documents supporting the identity of the bidder and the successful tenderer. The bidder who bids the auction
shall be personally responsible for paying the price of the prize on which he has bid, including if he has appointed a third party for the successful tenderer.
Failure of payment
In the absence of payment by the successful tenderer, the seller may opt either for the re-sale of the lot on reiteration of the auction at the expense of
the successful tenderer after formal notice remained unsuccessful addressed within a period of three months as from of the invitation to tender, either for the automatic resolution of
the sale or for the action for payment, without prejudice to the damages due by the defaulting tenderer. In the event of
resolution, in addition to the amount of the selling costs, LECLERE MDV will be entitled to ask the successful tenderer interest at the legal rate on
selling expenses until full payment of the price, in addition to other fees caused by such default. In the event of an action for
payment, LECLERE MDV shall be entitled to require the successful tenderer
to pay the above sums, in addition to the price to the seller plus interest at the legal rate until full payment of the price. In the event of a re-auction, the successful tenderer shall automatically be liable
for the full additional costs resulting from his failure, the difference between the first auction price and the tender price
obtained on reiteration of bids if this is lower, in addition to the amount of expenses paid to LECLERE MDV under the first auction
plus interest at the statutory rate.
Shopping and transport
It is the responsibility of the successful tenderer to withdraw his lot at the end of the sale and to have it insured as soon as the tender has been awarded, all
risks, including loss, damage, theft or other this moment transferred to it. The purchased lots can be withdrawn, free of charge,
after the sale or the day after the sale before 10 am at the Hotel Drouot.
Disputes
LECLERE-MDV's liability is prescribed by five years.
Transportation
