Live Auctioneers/Dypto Terms and Conditions & Privacy Policy By submitting your bid, you agree that: You have read and agree with the Auctioneer Terms and Conditions below and the Live Auctioneers terms and conditions Terms and Conditions for Dypto Conditions of Sale Placing a bid is a legally binding obligation. All autograph signatures, letters, documents, memorabilia, objects, wardrobe, props and signed photos are sold "as is". All statements contained in any bill of sale, invoice or elsewhere as to period, culture, source, origin, measurements, quality, rarity, provenance, importance, exhibition and literature of historical relevance or physical condition are qualified statements of opinion and not representations or warranties. Purchaser expressly acknowledges and agrees that in no event shall we be liable for any damage including, without limitation, any compensatory, incidental or consequential damages. Unless otherwise indicated, the purchase of any lot does not give the buyer any copyright ownership. All items are subject to prior sale. A Buyer's premium amounting to 20% of the winning bid amount will be added to the purchase price of each lot plus 5% - Live Auctioneers Live fee. The winning bidders acknowledge and agree to pay a total of 25% premium on top of the winning bid price. Should the bidder choose not to go forward with the purchase, or cancel their items; the 25% premium will still be in effect as the buyers responsibility. Dypto reserves the right to cancel any winning bid in the event the item is not up to our authenticity or condition standards. Shipping -All items will be shipped within 21 business days AFTER RECEIPT OF PAYMENT We ship via FedEx, UPS and USPS. Shipping charges are calculated at time of invoicing and are dependent on the number of items purchased and the destination shipping address. Due to the value of most purchases, a signature is required for delivery. This policy limits our ability to ship to PO Boxes. All international shipments (destinations outside the U.S.) will be sent via FedEx or DHL. Please feel free to contact us in advance for shipping charges - international customers are encouraged to do so. Please remember to provide a daytime telephone number when payment is made as shipping services such as FedEx require one. Payment WE ACCEPT CREDIT CARDS, MONEY ORDERS AND WIRE TRANSFERS. ALL ACCOUNTS MUST BE SETTLED WITH 48 HOURS OF THE SALE. Customers wishing to complete payment via money order or wire transfer should contact us for instructions. Buyers are provided the ability to pay via credit card online by clicking the link on your invoice. When shipping has been specified in advance, buyers may complete payment at the time of purchase. International customers are encouraged to contact us in advance of purchase to determine shipping costs. BUYERS ARE RESPONSIBLE FOR ALL INTERNATIONAL CUSTOMS DUTIES AND/OR TAXES. We are not told in advance of what a given country may charge for customs duties and/or taxes. Unless otherwise agreed to, complete payment is due within 48 hours of purchase. New Bidders If your Live Auctioneers Account is less than 30 days old you will be considered a New Bidder. All New Bidder Invoices that exceed $2,000 USD will be required to be paid via wire transfer, Bank Check or UPSP money order only. There are no exceptions to this rule. Taxes and Duties Customers having purchases shipped to locations in New York will be taxed at 8.875% as required by law. Customers residing outside the United States are advised that they are responsible for any customs duties or taxes their country may charge. Refund/Returns ALL SALES ARE FINAL. NO REFUNDS, RETURNS, EXCHANGES, OR REFUSALS. There are no warranties or representations of merchantability, of fitness, nor of any kind, express or implied. Your bid will signify that you have examined the items as fully as you desire, or that you have chosen not to examine the item. Dypto is not responsible for any variations in appearance of online photographs. Due to various monitor settings some colors may appear different in person than online. Dypto is not responsible for these variations. Condition We have tried to accurately describe every item. Condition descriptions range from 1-10 where 1 is very poor and 10 is like new. Substantial defects are noted, minor defects may not be mentioned. This is not an approval sale. If any substantial defect not described is discovered by the purchaser, the item must be returned within two days. Authenticity Dypto 100% guarantees all items authenticity. For an addition $30, Dypto can provide an additional 3rd party authentication certificate through Entrupy, the leading authentication service in the industry. This Certification of Authenticity does not imply that the item will be certified by any other rival authentication companies. The accompanied certification is the only certification the auction company can confirm. These items are being sold as collectable pieces and there is no guarantee that this item can be resold on any online marketplace. Each of these companies has their own policies and politics. Arbitration These Conditions of Sale and the purchaser's and our respective rights and obligations hereunder are governed by FL law. By purchasing an item, the buyer or bidder agrees to be bound by these Conditions of Sale. Any dispute, controversy or claim arising out of or relating to the Agreement or the breach, termination or validity thereof, brought by or against Dypto shall be resolved by Arbitration in FL under the AAA consumer rules of Arbitration. The Arbitrator shall be empowered to order specific performance and to award consequential damages and pre-award interest, but shall not be empowered to award punitive damages. The arbitration shall be governed by the U.S. Arbitration Act, 9 U.S.C. 1-16, and judgment upon the award rendered by the Arbitrator may be entered by any court having jurisdiction thereof. Each party shall bear its own attorneys fees and expenses in connection with such proceedings and shall bear one-half of the Arbitrators fees and expenses.
