TERMS AND CONDITIONS:
1. LIABILITY
The buyer should assume all items are not free from wear and tear, imperfections or the effects of aging.
We offer our best, studied opinion as appraisers/marketers as to the authenticity of any item. All sales are final. The Auctioneer and the Consignor assume no risk, liability or responsibility for the authenticity or the authorship of any property identified in the online catalog (that is, the identity of the creator or the period, culture, source or origin as the case may be, with which the creation of any property is identified herein). All property is sold "As Is" and neither the Auctioneer nor the Consignor makes any warranties or representations of any kind or nature with respect to the property, and in no event shall be responsible for the correctness or any implied warranty of merchantability or any implied warranty of fitness for a particular purpose as it relates to description, genuineness, attribution, provenance, safety, reliability or condition of the property. If any implied warranties of merchantability or fitness for a particular purpose can be construed from the catalog, auction, or bill of sale, such warranties are disclaimed by the Auctioneer and the Consignor. No statement in the online catalog or made at the sale or in the Bill of Sale or invoice or elsewhere shall be deemed such a warranty or representation or an admission of liability. Moreover, the Auctioneer will not be held responsible for any variations in appearance of online photographs we use as part of the description.
2. BUYER'S PREMIUM.
All bid prices/Hammer prices will be subject to a buyer's premium payable by the purchaser.
3. SALES TAX
Stubbs Estates is required by law to collect and remit the appropriate sales tax in effect in Kansas unless appropriate documentation of exemption is provided. Buyers claiming exemption from sales tax must have the appropriate documentation on file with Stubbs Estates prior to the release of the property. If the property is delivered to a state where Stubbs Estates is not required to collect sales tax, it is the responsibility of the purchaser to self-assess any sales or use tax and remit it to taxing authorities in that state. Stubbs Estates is not required to collect sales tax for property delivered to the purchaser outside of the United States.
4. STORAGE / ABANDONMENT TERMS
Purchased items will be gladly stored for 60 days. After that we will consider items abandoned and no refunds will be issued if no shipping arrangements have been made or paid for. Item/s will be donated to charity or resold.
5. PHOTOGRAPHS:
Stubbs Estates reserves the right to retain, disclose, sell, transfer, and/or publish any photographs, images, descriptions of property, and results of any sale, before and after the auction, including but not limited to, publishing via the internet and/or any other media, and/or to any third party. All images, texts, photographic reproductions, and catalogue design are subject to copyright and may not be reproduced without our explicit written permission. Neither Stubbs Estates nor consignor make any representations and/or warranties, express or implied, as to whether the purchaser acquires any copyrights, intellectual property rights, including but not limited to, any reproduction rights.
6. ENDANGERED OR PROTECTED SPECIES OR WILDLIFE:
We at Stubbs Estates prefer not to offer items made of or having incorporated into it, endangered or protected species or wildlife. We have a high regard for these animals and do not wish to promote their collection or endangerment. We will not knowingly sell elephant ivory solely on an ethical basis. On occasion we accept consignments knowingly or unknowingly containing materials from endangered species. They may have import and/or export restrictions established by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Property, including, but not limited to, items made of or incorporating plant or animal materials such as coral, crocodile, ivory, whalebone, tortoiseshell, may require a license or certificate prior to exportation and/or importation. Such items are not available to ship internationally and, in some cases, domestically. Additionally, these items may be subject to confiscation by state or federal officials if the proper documentation authorizing their sale is not produced. By placing a bid, the bidder acknowledges that he is aware of the restriction and takes responsibility in obtaining and paying for any license or permits relevant to delivery of the item(s). Stubbs Estates is not responsible and would not be liable for the inability to ship the purchased items or if such item(s) is (are) confiscated by state or federal officials prior to their shipment or transport to the successful bidder. In any event, bidder is responsible for making a timely payment for the total purchase price of the lot. Bidder should be familiar with relevant customs regulations prior to bidding. Bidder should inquire with relevant government wildlife import and export requirements prior to placing a bid.
7. USEFUL TERMS

After: A work of art or object made in the style of an artist or maker, but not by the artist. Sometimes refers to bronzes or other multiples that may have used an artist s mold or plate, but were reproduced by someone other than the artist. Can also be used to describe a direct reproduction after an original work of art.
Attributed (attr.): In our opinion, probably or possibly a work of art by the artist or maker, but either unsigned, unmarked and/or lacking adequate provenance or agreement by experts in the field.
Bears the Signature: The work is signed, but the work and signature may not be by the hand of the artist.
Condition: Any visible condition problems, flaws, or damage to the piece. Acceptable condition varies for various categories of object. For example, antique furniture, paintings and decorative objects are expected to show a certain amount of wear, given their age, while modern pieces should be
In the Manner of: Made in the likeness or style of an artist, with a slight possibility that it was made by the artist or maker or by a follower or student of him or her. Also see After and Attributed To .
Measurements/Scale: Are most often approximate. In artwork, sight indicates the size of the visible artwork, not including matting or frame. Frame size includes the height and length of the outermost dimensions of the frame. In rugs, measurements do not typically include the fringe. For scale, at times, an item will be shown alongside an item of known size i.e. a penny or quarter to indicate scale.
Medium: The material/materials an artist utilized in creating a work of art, such as oil paint, acrylic or bronze. The material that a work was created on, such as canvas or wood, is also considered part of the medium. For example, one might say that the medium of an oil painting is "oil on canvas."
Not Examined Out of Frame: The piece of art has not been taken out of the frame for examination.
Provenance: The history of ownership of the piece, provided either by the consignor or from accompanying information.
School: Usually relates to a particular artistic or aesthetic movement. It can also relate to an actual school or to followers of a particular artist or maker. Also see: Manner of, Style, Attributed to and After .
Style: After the time period in which the style originated, or a more recent reproduction (ie: Queen Anne style, Chippendale style). In artworks, sometimes used to refer to the style of a particular artist or artistic movement, generally made long after that time period.
Autopay
If you have not contacted Stubbs Estates to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
Sales Tax
