Hubbard Burdett LLC - Terms & Conditions Welcome to Hubbard Burdett LLC’s online auction services conducted through LiveAuctioneers.com. By participating in our auctions, you agree to the following terms and conditions. Please read them carefully. 1. Introduction These Terms & Conditions ("Terms") govern the use of the online auction services provided by Hubbard Burdett LLC ("Company," "we," "us," or "our") through the LiveAuctioneers.com platform. By registering for and using our auction services, you ("User," "Bidder," "Buyer," or "Seller") agree to be bound by these Terms, as well as the terms and conditions of LiveAuctioneers.com. 2. Registration 2.1. Eligibility: Users must be at least 18 years old and capable of entering into a legally binding agreement. 2.2. Account Information: Users must provide accurate and complete registration information and keep their account details up to date. Registration on LiveAuctioneers.com is required to participate in our auctions. Hubbard Burdett may use this information to contact the Client. 2.3. Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. 3. Bidding 3.1. Bidder Agreement: By placing a bid, the bidder agrees to purchase the item if they are the highest bidder at the auction’s close. 3.2. Binding Bids: All bids placed are binding and cannot be retracted. Once a bid is placed, it cannot be canceled or altered. 3.3. Bid Increments: Bids must be placed in the increments specified for each auction. 3.4. Winning Bids: The highest bid at the close of the auction period will be deemed the winning bid, subject to any reserve price that may apply. 4. Payment 4.1. Invoices: Winning bidders will receive an invoice via email within 24 hours of the auction close but usually will be directly after the auction ends. 4.2. This auction uses Autopay by LiveAuctioneers. If you place a winning bid, your card will be charged shortly after the conclusion of the auction. 4.3. Payment Terms: Payment must be made within [3] business days of the auction’s close. Accepted payment methods will be outlined in the invoice. 4.4. Buyer's Premium: A buyer's premium, as specified in the auction details, will be added to the hammer price of each item sold. 5. Shipping and Pickup 5.1. Shipping: The buyer is responsible for all shipping and handling costs. After the auction closes, Buyer’s should inform Hubbard Burdett via email whether they would like to utilize the LiveAuctioneers LiveShipping option or the “In-House" option, which requires a FedEx shipping account number. FedEx will pack, ship and bill your account directly. If the item(s) are to be insured, please be sure to mention when providing us with your FedEx shipping account number after the auction closes. If you would like to utilize the LiveShipping option, please allow up to 5 business days to hear from them about shipping arrangements. Any further questions about LiveAuctioneers LiveShipping can be directed towards packaging@liveauctioneers.com. 5.2. Pickup: Items available for pickup must be scheduled within [7] days of the auction’s close. Contact us to arrange a pickup appointment. Items that are not picked up or arranged for after 7 days of the auction close will be forfeited without refund unless otherwise authorized by an official Hubbard Burdett representative. Delivery to a certain location may be available free of charge as well. Please reach out to us for details if interested. 6. Item Descriptions 6.1. Accuracy: We strive to provide accurate descriptions and photographs of auction items. However, all items are sold "as is," and we make no warranties or representations regarding the accuracy of descriptions. 6.2. Inspection: Buyers are encouraged to inspect items or request additional information before bidding. 7. Returns and Refunds 7.1. All Sales Final: All sales are final. No returns or refunds will be accepted unless an item is significantly not as described. 8. Liability 8.1. No Liability for Platform Issues: Hubbard Burdett LLC is not responsible for any issues or downtime related to the LiveAuctioneers.com platform. 8.2. No Liability for Damages: We are not liable for any damage or loss to items after they have been sold, though we will take reasonable precautions to protect items while in our possession. 8.3. Indemnity: Users agree to indemnify and hold harmless Hubbard Burdett LLC from any claims, damages, or expenses arising out of their use of the auction services. 9. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. 10. Amendments We reserve the right to modify these Terms at any time. Changes will be posted on our website, and continued participation in our auctions will constitute acceptance of the modified terms.
