"Conditions de vente Les ventes aux enchères organisées par la Maison de Ventes Cornette de Saint Cyr Bruxelles sont soumises aux présentes conditions. La participation aux enchères implique l’acceptation inconditionnelle de ces conditions : Les biens mis en vente Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser lors des expositions organisées avant les enchères par la Maison de Ventes Cornette de Saint Cyr Bruxelles. Des rapports d’état peuvent être communiqués à titre indicatif et gracieux sur simple demande, par courrier, téléphone ou courrier électronique. Ceux-ci sont fonction des connaissances artistiques et scientifiques à la date de la vente et toute erreur ou omission ne saurait entraîner la responsabilité de la Maison de Ventes. Les mentions figurant au catalogue sont établies par la Maison de Ventes et l’expert qui l’assiste le cas échéant, sous réserve des notifications et des rectifications annoncées au moment de la présentation du lot et portées au procès-verbal de la vente. Aucune réclamation ne sera admise une fois l’adjudication prononcée, l’exposition préalable ayant permis l’examen de l’objet. Toutes indications figurant dans les catalogues, publicités, ou autre publication faite par Cornette de Saint Cyr Bruxelles ne sont que des indications, n’engageant en aucune façon la responsabilité de la Maison de ventes. Elles ne garantissent ni l’auteur, ni l’origine, ni la date, la provenance, l’attribution, l’estimation, le poids, les dimensions ou l’état du lot. Il appartient à l’acheteur de s’assurer personnellement de l’exactitude des mentions portées dans ces différentes publications, catalogues, publicités. Toute réclamation doit, à peine de déchéance, parvenir à Cornette de Saint Cyr Bruxelles dans un délai de 8 jours après le retrait de l’objet, par lettre recommandée. En l’absence de règlement, l’objet sera à nouveau présenté à la vente selon les termes de la réquisition de vente initiale. Enchères Les enchères suivent l’ordre des numéros du catalogue. Le mode usuel pour enchérir consiste à être présent dans la salle. Ce formulaire doit parvenir à la Maison de Ventes Cornette de Saint Cyr Bruxelles accompagné d’un relevé d’identité bancaire ou des coordonnées bancaires au moins deux jours avant la vente. La Maison de Ventes Cornette de Saint Cyr se charge gracieusement des enchères par téléphone ainsi que des ordres d’achat. Dans tous les cas, la Maison de Ventes Cornette de Saint Cyr ne pourra être tenue pour responsable d’un problème de liaison téléphonique ainsi que d’une erreur ou d’une omission dans l’exécution des ordres reçus. Paiement La vente est faite au comptant et conduite en euros. Le paiement doit être effectué immédiatement après la vente. Dans l’hypothèse où l’adjudicataire n’a pas fait connaître ses données personnelles avant la vente, il devra justifier de son identité et de ses références bancaires. Les acquéreurs paieront en sus de l’adjudication, par lot et par tranche, les frais et taxes suivants : - De 0 à 40.000€: 28% HT - De 40.001 € à 800.000€: 27% HT - De 800.001€ à 4 500 000 €: 21% HT - au-delà 4 500 000 € : 14,5% HT L’adjudicataire pourra s’acquitter du paiement par les moyens suivants: - en espèces dans la limite de la législation en vigueur. - par virement bancaire - par chèque de banque - par carte bancaire: sauf American Express Droit de suite Pour certains lots, portant la mention ""AR"" dans le catalogue et qui sont vendus à un prix d'adjudication d'au moins 2 000€ (converti dans la devise de la vente en utilisant le taux de référence de la banque centrale européenne en vigueur à la date de la vente), l'acheteur nous versera une commission supplémentaire pour couvrir nos frais relatifs au paiement des droits d'auteur en vertu des règlementations du droit de suite des artistes. La commission supplémentaire correspond à un pourcentage du prix d'adjudication calculé conformément au tableau ci-dessous, et ne devra pas dépasser 12 500€ (convertis dans la devise de la vente en utilisant le taux de référence de la banque centrale européenne en vigueur à la date de la vente). Prix adjudication Pourcentage De 0 à 50 000€ 4% De 50 001€ à 200 000€ 3% De 200 001€ à 350 000€ 1% De 350 001€ à 500 000€ 0,5% De 500 001€ à 2 000 000€ 0,25% Défaut de paiement En cas de non-paiement dans les 20 jours à dater de la vente, toute somme due par l’acheteur et demeurée impayée sera majorée de 15 % de plein droit et sans mise en demeure à titre d’indemnité forfaitaire pour le préjudice subi ,avec un minimum de principe 100€ Un intérêt de retard de paiement dans les transactions commerciales en vertu de la loi du 02.08.2002 sera également dû à compter de l’échéance de la facture, de plein droit et sans mise en demeure préalable. L’application de cette clause ne fait pas obstacle à l’allocation de dommages et intérêts et aux dépens de la procédure qui serait nécessaire, et ne préjuge pas de l’éventuelle mise en œuvre de la procédure de folle enchère. Dans le cadre de la procédure de folle enchère, la Maison de Ventes se réserve de réclamer à l’adjudicataire défaillant le paiement de la différence entre le prix d’adjudication initial et le prix d’adjudication sur folle enchère, s’il est inférieur, ainsi que les coûts générés par les nouvelles enchères. La Maison de Ventes Cornette de Saint Cyr Bruxelles se réserve la possibilité de procéder à toute compensation avec les sommes dues à l’adjudicataire défaillant. De même, la Maison de Ventes Cornette de Saint Cyr se réserve d’exclure de ses ventes futures, tout adjudicataire qui n’aura pas respecté les présentes conditions de vente. Retrait des achats Aucun lot ne sera remis aux acquéreurs avant acquittement de l’intégralité des sommes dues. En cas de paiement par chèque non certifié ou par virement, la délivrance des objets pourra être différée jusqu’à l’encaissement. Dès l’adjudication, les objets sont placés sous l’entière responsabilité de l’acquéreur. Pour l’enlèvement des lots qui n’ont pas été retirés le jour de la vente, il est conseillé de contacter préalablement la Maison de Ventes Cornette de Saint Cyr Bruxelles +32 2 880 73 80. L’enlèvement des lots de taille modeste se fait chez Cornette de Saint Cyr, 89 chaussée de Charleroi 1060 Bruxelles (sauf indications spécifiques à la première page du catalogue), uniquement les mardi, mercredi ou jeudi de 9h30 à 13h ou de 14h à 17h30. Après un délais de quinze jours de stockage gracieux ce dernier sera facturé comme suit: objet: 50€ TTC - tableau: 80€ TTC - mobilier 100€ TTC par semaine et par lot. Toute semaine commencée est réputée due. Le mobilier, et de manière générale les pièces volumineuses, sont conservés dans les entrepôts de nos prestataires. Les frais de stockage sont à la charge de l’acheteur et lui seront facturés directement par les prestataires selon les tarifs en vigueur. Le magasinage des objets n’engage pas la responsabilité de la Maison de Ventes. Le transport des lots est effectué aux frais et sous l’entière responsabilité de l’adjudicataire. Compétence législative et juridictionnelle Les présentes conditions de vente sont régies par le droit belge. Toute contestation relative à leur existence, leur validité et leur exécution sera tranchée par le tribunal compétent du ressort de l’arrondissement de Bruxelles. Résultats des ventes sur le site internet www.cornettedesaintcyr.com ou www.cornettedesaintcyr.be ________________________________________ Conditions of sale The auction sales organized by the Auction House Cornette de Saint Cyr Brussels are hereby subject to the following conditions of sale: Goods put up for sale Potential purchasers are invited to examine the goods that might be of interest to them during the exhibits which are organized by the Auction House Cornette de Saint Cyr before the auctions. Condition reports may be requested from the Auction House by letter, telephone or electronic mail. They will be sent free of charge but are to be used for information only. The reports will include the artistic and scientific information known to the Auction House at the date of the sale and the latter will not accept any responsibility for errors or omissions. The descriptions to be found in the catalogue are drawn up by the Auction House and where applicable by the expert who assists the former, subject to notices and corrections given when the lot is presented and included in the bill of sale. Sizes, weights and estimates are given for information purposes only. The colors of the works included in the catalogue may vary due to printing techniques. The lack of information on the condition of the goods in the catalogue will by no means imply that the lot is in a perfect state of preservation or free from restoration, wear, cracks, relining or other imperfection. The goods are sold in the state they are found at the time of sale. As the prior exhibit has enabled potential purchasers to examine the object, no claim will be accepted once the hammer has gone down. The indications appearing on the catalogues, advertisements, brochures and any other written material produced by the Auction House Cornette de Saint Cyr Brussels should be considered as simple indications and are not binding in any case. They do not guarantee the exactitude of a declaration relative to the author, origin, date, age, attribution, estimates, weight, sizes or material state of the lot. Consequently buyers must verify for themselves the nature and material states of the lots. Any claim must reach the Auction by recorded latter not later than 8 days after the retrieval of the object or cannot be considerEd. In any case, for sales subject to article 1649 quarter of the Belgian Civil Code, the seller answers to the consumer for any fault of conformity that exists when the good is delivered or which appears within a delay of one year of this date; the buyer must inform the seller of the existence of a fault of conformity within a delay of two months of noticing the fault. ln the event of a withdrawal of an article prior to the sale by a depositor and after the publication of the catalogue or, in the event of a modification to the minimum price rendering it impossible to put the article up for sale immediately, the seller will be obliged to pay the purchaser and seller fees calculated on the basis of the median estimate stipulated in the catalogue to the Auction House Cornette de Saint Cyr Brussels by way of compensation. The article which has been withdrawn will not be returned to the seller until the aforementioned fees are paid. If no payment is forthcoming, the article will be put up for sale once again in line with the terms of the initial sale requisition. Auction sales The auction sales are carried out in the order of the catalogue numbers. The bidders are invited to make themselves known to the Auction House Cornette de Saint Cyr Brussels before the sale to ensure that their personal details are recorded beforehand. Bidders are generally present in the room. However, any bidder who would like to place an absentee bid in writing or bid by telephone may use the form, intended for this purpose, to be found at the end of the sale catalogue or on the websites www.cornettedesaintcyr.be, www.cornettedesaintcyr.com or www.cornette.auction.fr. In all cases, the Auction House Cornette de Saint Cyr Brussels cannot be held responsible for a problem with the telephone link along with an error or omission in the execution of the absentee bids receivEd. ln the event of two identical absentee bids, preference will be given to the earliest absentee bid. The bidder who is present in the room shall have priority over an absentee bid should the two bids be of equivalent amounts. The successful bidder will be deemed to be the individual who has made the highest bid. In the event of a double bid which is confirmed as such by the auctioneer, the lot will be put up for sale again and any or all persons present will have the right to take part in the second sale by auction. Payment Sales are to be paid for in cash and in euros. Payment must be paid immediately after the sale. The Additional Commission will be a percentage of the Subscription Price calculated in accordance with the table below, and will not exceed €12,500 (converted into the currency of the Sale using the reference rate of the European Central Bank prevailing on the date of the Sale). A late payment interest on business transactions, in accordance with the law of 02/08/2002, will also be charged as of the due date of the invoice, automatically and without prior formal notice. The fact that this clause is applied will not hinder the awarding of damages and costs for the legal proceedings which will be required, and does not exclude the article being put up for sale again in a new auction, procedure called""folle enchère"" Within the framework of the folle enchère procedure, the Auction House hereby reserves the right to claim for the payment of the difference between the initial hammer price and the subsequent hammer price obtained from the folle enchère procedure, if it is lower, together with the costs incurred due to the second Auction sale from the defaulting successful bidder. The Auction House Cornette de Saint Cyr Brussels hereby reserves the right to offset against the amounts owed to the defaulting successful bidder. Furthermore, the Auction House Cornette de Saint Cyr hereby reserves the right to exclude any or all successful bidder who has not complied with these conditions of sale from its future auction sales. Collection of purchases No lot will be handed over to the purchasers before all of the amounts owed are settlEd. ln the event of payment with a non-certified cheque or by bank transfer, delivery of the articles may be differed until receipt of the amounts owEd. As soon as the auction sale is concluded, the articles will be placed under the purchaser’s full responsibility. Smaller lots can be collected at Cornette de Saint Cyr, 89 chaussée de Charleroi 1060 Brussels (except for specific indications on the first page of the catalogue), only on Tuesdays, Wednesdays or Thursdays from 9.30 a.m. to 1.00 p.m. or from 2.00 p.m. to 5.30 p.m. After a period of fifteen days of free storage, the latter will be invoiced as follows: object: 50€ TTC - painting: 80€ TTC - furniture 100€ TTC per week and per lot. Any week started is considered due. Furniture and generally speaking any bulky articles are kept at our partner’s warehouse. Storage costs are to be paid by the purchaser and will be invoiced directly by our partners to the purchaser and in line with the tariffs in force. The Auction House will not be responsible for the storage of articles. Transport of the lots is to be carried out at the successful bidder’s expense and under their full responsibility. Governing law and jurisdiction These conditions of sale are governed by Belgian law. Any or all dispute relating to the wording, validity and performance will be settled by the court or competent jurisdiction in Brussels. De vermeldingen in de catalogus worden opgesteld door het Veilinghuis en de expert die in voorkomend geval assisteert, onder voorbehoud van de kennisgevingen en rechtzettingen die bij de voorstelling van het lot worden aangekondigd en in het proces-verbaal van de verkoop worden opgenomen. De afmetingen, het gewicht en de schattingen worden louter ter informatie opgegeven. De kleuren van de werken opgenomen in de catalogus kunnen verschillen omwille van het drukproces. Indien geen staat in de catalogus is vermeld, betekent dit evenwel niet dat het lot zich in perfecte staat bevindt of dat het vrij is van restauratie, slijtage, craquelures, verdoeking of andere onvolkomenheden. De goederen worden verkocht in de staat waarin ze zich op het ogenblik van de verkoop bevinden. Eens het lot is toegekend, wordt geen enkele klacht meer aanvaard, aangezien het voorwerp kon onderzocht worden tijdens de voorafgaande bezichtiging. De vermeldingen in de catalogi, advertenties of elke andere publicatie van Cornette de Saint Cyr Brussel zijn louter indicatief en kunnen op geen enkele wijze het Veilinghuis aansprakelijk stellen. Ze bieden geen garantie voor de auteur, de oorsprong, de leeftijd, de herkomst, de toewijzing, of de staat van het lot. De koper dient zich er persoonlijk van te vergewissen dat de vermeldingen in deze verschillende publicaties, catalogi, advertenties correct zijn. Indien de bewaargever een voorwerp intrekt vóór de verkoop en na het verschijnen van de catalogus of indien de limietprijs wordt gewijzigd waardoor het voorwerp niet onmiddellijk te koop kan worden gesteld, is de verkoper ertoe gehouden aan het Veilinghuis Cornette de Saint Cyr Brussel als schadevergoeding de erelonen koper en verkoper te betalen, berekend op basis van de mediane schatting vermeld in de catalogus. Het voorwerp dat uit de verkoop wordt gehaald zal pas terug overhandigd worden na de betaling van de voormelde erelonen. Indien deze niet worden betaald, zal het voorwerp opnieuw te koop worden aangeboden volgens de voorwaarden van de oorspronkelijke opdracht tot verkoop. Veilingen De veilingen volgen de volgorde van de catalogusnummers. De bieders worden verzocht zich aan te melden bij het Veilinghuis Cornette de Saint Cyr Brussel vóór de verkoop zodat hun persoonlijke gegevens kunnen worden geregistreerd. De gebruikelijke manier om te bieden bestaat erin aanwezig te zijn in de zaal. Elke bieder die een schriftelijke aankoopopdracht wenst te plaatsen of wenst te bieden per telefoon, kan gebruik maken van het formulier dat daartoe is voorzien achterin de verkoopscatalogus of op de sites www.cornettedesaintcyr.be. Het Veilinghuis Cornette de Saint Cyr Brussel staat kosteloos in voor de biedingen per telefoon evenals voor de aankoopopdrachten. In geen geval kan het Veilinghuis Cornette de Saint Cyr Brussel aansprakelijk worden gesteld voor een probleem met de telefoonverbinding of voor een fout of een nalatigheid bij de uitvoering van de ontvangen opdrachten. Voor het geval dat er twee identieke aankoopopdrachten zijn, wordt voorrang gegeven aan de oudste opdracht. Indien in de zaal een bod wordt gedaan dat equivalent is aan dat van een aankoopopdracht, zal de aanwezige bieder voorrang krijgen. De hoogste en laatste bieder krijgt het lot toegewezen. Ingeval van dubbel bod dat door de veilingmeester effectief wordt erkend, zal het lot opnieuw worden opgeroepen en zullen alle aanwezige personen kunnen deelnemen aan de tweede oproeping. Betaling De verkoop vindt plaats in contanten en in euro. De betaling dient onmiddellijk na de verkoop te worden uitgevoerd. Indien de koper zijn persoonlijke gegevens vóór de verkoop niet heeft medegedeeld, dient hij zijn identiteit en bankrefertes te staven. Bovenop de toewijzing betalen de kopers, per lot en per schijf, volgende kosten en taksen: - Van 0 à 40.000€: 28% excl. BTW - Van 40.001 € à 800.000€: 27% excl. BTW - Van 800.001€ à 4 500 000 €: 21% excl. BTW - Vanaf 4 500 000 € : 14,5% excl. BTW De koper kan de betaling op volgende manieren uitvoeren: - in contanten, binnen de grenzen van de vigerende wetgeving - via bankoverschrijving - via bankcheque - via bankkaart: uitgezonderd American Express Recht van antwoord Voor bepaalde kavels die in de catalogus zijn gemarkeerd met «AR» en die worden verkocht tegen een Biedprijs van ten minste €2.000 (omgerekend in de valuta van de Verkoop met gebruikmaking van de referentiekoers van de Europese Centrale Bank op de datum van de Verkoop), betaalt de koper ons een aanvullende commissie ter dekking van onze kosten in verband met de betaling van royalty’s krachtens de Artists’ Resale Right Regulations. De Aanvullende Provisie is een percentage van de Inschrijvingsprijs berekend in overeenstemming met onderstaande tabel, en zal niet meer bedragen dan € 12.500 (omgerekend in de valuta van de Verkoop met gebruikmaking van de referentiekoers van de Europese Centrale Bank die geldt op de datum van de Verkoop). Inschrijvingsprijs Percentage Van 0 op 50 000€ 4% Van 50 001€ op 200 000€ 3% Van 200 001€ op 350 000€ 1% Van 350 001€ op 500 000€ 0,5% De 500 001€ op 2 000 000€ 0,25% Niet-betaling Ingeval van niet-betaling binnen de 20 dagen te rekenen vanaf de veiling, zal elk bedrag dat door de koper is verschuldigd en niet is betaald, van rechtswege en zonder ingebrekestelling worden verhoogd met 15% ten titel van forfaitaire vergoeding voor de geleden schade, met een minimumbedrag van 100€.
