To ensure fairness and transparency, bidders should be aware of the following: ? Absentee bids placed on one platform may compete with the highest bidder on other platforms. ? Due to this, a bidder may not be the highest bidder, as the platforms are not connected in real-time. ? In cases where identical bids are received at the same time, the Auctioneer will accept the first bid called out by our clerks. ? Donley Auctions cannot guarantee the order in which bids are received electronically. To avoid potential disappointment, bidders are encouraged to watch the auction live and increase their bids as needed. When you bid on any item, you are entering into a binding contract. Bidders acknowledge and understand that online bidding services may experience technical issues. All property is sold 'AS IS', and ALL SALES ARE FINAL. There are absolutely no refunds, exchanges, or returns on ANY items. We work very hard for the consignor as well as the buyer. The auction moves fast between the auctioneer, the on-site bids, and the live internet bids. Because of this, one little delay, or what we call 'hiccup' in the internet connection, can cause an online bid to be missed. We apologize if this happens, but it is sometimes inevitable. Please be aware of this when bidding online. NOTE: We provide online bidding for our clients in various ways, i.e., 3-4 bidding platforms, Phone Bids, Live Bids, and Absentee Bids. THERE IS NO WAY POSSIBLE for the Auctioneer to know who places a bid in advance. All bids come into the consoles at the same time. He can only take ONE bid, the first one that he hears. So, if you want to ensure that you are not in a tie bid, please bid online LIVE with the auction. Due to the element of Third-Party Auctions and the reliability/unreliability of technical issues, we reserve the right to end an auction early or extend an auction as we see fit. In no event shall Donley Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. The bidder shall be the sole judge of value, condition, age, genuineness, value, or any other determinative factor. Bidders who bid off-site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value, or any other factor by way of their own knowledge, pictures, description, and emailing Donley Auctions with questions at Info@DonleyAuctions.com. We will be happy to describe each item in detail and any pertinent information regarding the item BEFORE THE AUCTION. Donley Auction Services will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Under no circumstances shall Bidder have any kind of claim against Donley Auctions or anyone else if the Internet service fails to work correctly before or during the live or timed auction. Donley Auctions will not be responsible for any missed bids from any source. Donley Auctions reserves the right to withdraw or re-catalog items in this auction. IMPORTANT SHIPPING INFORMATION: Shipping procedures vary depending on the auction platform used. LiveAuctioneers Purchases: For purchases made through LiveAuctioneers, the following shipping procedures apply: ? Shipping costs and payment may be processed differently. ? In some cases, shipping costs may be calculated and displayed with bidding information on the website. ? Payment for shipping may be collected at the same time as payment for your items. ? Shipping arrangements and notifications will be handled by LiveShipping. You will be contacted by them directly regarding shipping. ? We are in the process of evaluating this shipping method and will provide updates as needed. ? If you prefer to use Donley Auctions' standard shipping services, you may be able to decline shipping during the LiveAuctioneers checkout process. General Shipping Information (Applies to All Sales): The following shipping procedures apply to all sales, including those made through the Donley Auctions website: 1. PAYMENT: When the invoice is paid in full, it will be passed to our Shipping Department. Cost for shipping is a separate transaction and will NOT be included in the original invoice, except for LiveAuctioneers purchases where payment for shipping may be collected at the same time as payment for your items. 2. SHIPPING TIMELINE: Please allow up to 2-4 weeks for our Shipping Department to pack your items. We handle a high volume of items, and careful packing takes time. 3. SHIPPING NOTIFICATION: You will receive a text/email from us through our shipping software, "Shipping Saint," with shipping cost details and a link for payment. This does not apply to LiveAuctioneers purchases, which will be handled by LiveShipping. 4. ITEM PICK-UP: If you decide to decline shipping and pick up your items, please notify us within 24 hours. Otherwise, you may be charged for packing. Contact us at Shipping@DonleyAuctions.com to confirm day and time for pickups. Pickups are by appointment only. 5. STORAGE FEES: Due to limited space, items must be picked up from the auction house within 5 days. Any items left for over 5 days will incur a storage charge of $20 per day, unless prior arrangements have been made. Items left after 30 days will be considered abandoned and may be sold to recover expenses. 6. U.S. SHIPPING OF STANDARD-SIZED ITEMS: We will carefully, efficiently, and economically pack small to medium-sized items. You will receive an invoice via text/email with shipping/handling costs, which can be paid directly through the link. LiveAuctioneers shipping will be handled on their website. 7. U.S. SHIPPING OF OVERSIZED ITEMS: We do not pack large, oversized, or items over 100 lbs. By request, we will send you a list of recommended transporters and/or crating companies. It is the sole responsibility of the buyer to arrange transportation. 8. INTERNATIONAL SHIPPING: If a single item is valued over $2,499, we cannot ship internationally through USPS or FedEx. Any single item exceeding the value must ship through an international shipping broker. We will provide recommendations. It is the sole responsibility of the buyer to arrange transportation.
