By placing a bid, you accept and agree to the following Terms and Conditions of Magnum Auctions, L.L.C., and any participation in the auction binds you to the agreement of these terms, WHETHER OR NOT you have read or understand said terms. This is a binding contract between you and Magnum Auctions, LLC. 1. Condition: All items sold by Magnum Auctions are SOLD AS-IS, WHERE IS, WITHOUT EXCEPTION. Magnum Auctions makes every attempt to call any issue that may affect the value of an item. This is noted in the description and also in the first sentence of the Condition of the item in each listing. It is recommended that bidders request a condition report before bidding to address any questions they may have about the item. Condition reports must be received 24 hours prior to each auction. We cannot guarantee a response if received after that window of time. If you have not heard from us, it is best to call our office. It is the buyer's responsibility to ASK ANY AND ALL questions they may have above and beyond the provided condition report. Photos are part of the description. Please use them as such. We are happy to supply any additional reports as needed to the best of our ability. However, those are solely our opinion, ONLY, and not to be a basis for determining whether or not to bid. Magnum Auctions, LLC does not guarantee the authenticity or attribution of property listed in the catalog or online. Magnum Auctions, LLC makes no warranties, nor does the SELLER, as to the merchantability or fitness for a particular purpose, the correctness of the catalog, or any other description of the physical condition, size, quality, rarity, importance, provenance, literature, or historical relevance of any property. No oral or written statements made in the catalog, online listing, advertisement, flyer, announcement, social media, website, or elsewhere, or made by employees or auctioneer, shall be construed to be a warranty. MAGNUM AUCTIONS, LLC, and the SELLER are not responsible for errors and/or omissions in the catalog, online listings, website, social media, or any other supplemental material, whether written or verbal. 2. Buyer's Premium: The bidder agrees to pay a buyer's premium of up to 20% on all purchases made on the LiveAuctioneers.com website. 3. Methods of Payment and Fees: Acceptable methods of payment are Cash, Personal Check, Wire Transfer, and Credit Card. Credit Cards are subject to an "Online Payment Fee" of 3.75% and a $0.25 per invoice charge. The bidder agrees to pay an additional "Online Payment Fee" implemented by LiveAuctioneers.com on all invoices on the LiveAuctioneers.com website, including any additional invoices for packing and shipping, unless prior arrangements have been made to pay in another manner. *Credit Card payments are not accepted for Jewelry, Watches, Currency, Gold, Silver, or other Precious Metals. The only payment options for those are Cash or Wire Transfer. *If no prior arrangements for a payment method outside of a Credit Card are made, the Credit Card on file with LiveAuctioneers will be auto-charged on the third day after the auction invoice has been sent. *At our discretion, we may request any invoice over $2,500.00 to be paid via Check, Certified Check, or Wire Transfer. All funds must be cleared before the order is released. A bank letter of credit submitted three days prior to the auction date may be requested at our discretion. *Wire Transfer Payments are subject to an additional $30.00 fee. *We reserve the right to hold all goods paid for by Check or Certified Check until the payment has cleared. *Invoices to International bidders exceeding $2,000.00 may be at our discretion, to be paid via wire transfer. *If the credit card on file is declined, LiveAuctioneers.com will re-attempt to authorize the credit card. If unsuccessful and no attempt has been made by the buyer to complete payment, an UNPAID ITEM case will be opened. All bidders having an outstanding balance will have their account flagged as such and will be blocked from bidding with Magnum Auctions, LLC, and subsequently from LiveAuctioneers.com. 4. Sales Tax: The prevailing sales tax for the state where the successful bidder resides will be applied to all invoices for purchases, including those for packing and shipping made on the LiveAuctioneers.com website, unless a resale tax form is completed and submitted to info@liveauctioneers.com before bidding in any auction. Email your resale certificate along with your username to info@liveauctioneers.com. Sales tax will not be removed post-auction, without exception. Magnum Auctions is unable to, and will not, deduct sales tax manually from your invoice on the LiveAuctioneers website. 5. Packing & Shipping and Personal Pick-Up of Purchases: There are several options available for the delivery of your purchases. Magnum Auctions LLC prepares, packs, and ships all items in-house unless it is an item that is designated too big to ship. In such a case, contact our office at 419-310-0105 or email shipping@magnumauctions.com for a list of preferred antique couriers. If you prefer your item to be shipped by Magnum Auctions In-House Shipping, please select "Arrange Own Shipping" during the checkout process. Personal pickup is always best. We set aside two days following the auction for pick up of your items. These are always the Saturday following the auction and the Wednesday following that Saturday prior. Quotes for packing and shipping may be submitted to shipping@magnumauctions.com prior to the auction. Magnum Auctions, LLC will not provide a shipping quote Post- Auction. Shipping quotes are only an estimate and are provided as a convenience to the buyer and not a guaranteed amount. The final amount may vary depending on several factors, including the hammer price of the item or its complexity. Our trained and dedicated staff will prepare your items. Once the initial invoice payment for your auction purchases has been completed, the order will go into the queue for packing. Once the order has been packed, a shipping quote with full insurance will be ascertained. An invoice will be emailed to you with the total for packing materials, labor, shipping cost, and insurance cost. Once that invoice has been paid, your item will ship. Tracking for the package is automatically uploaded to the email address on file with your LiveAuctioneers account. Typically, you can expect your items to be shipped within two weeks following the auction. Once the orders have shipped from our facility, it can take an additional 3-5 business days for delivery. *There will not be any negotiations of the cost of the packing and shipping invoice. *Magnum Auctions, LLC will ship purchases to the buyer at the registered address listed on their LiveAuctioneers.com account. *Magnum Auctions, LLC will ship all packages with full insurance. Packages with a value of over $300.00 will require, WITHOUT EXCEPTION, a signature of confirmation of receipt of delivery. *All packages are insured; however, no claims can be filed for stolen packages. *If Magnum Auctions, LLC is not informed of a change of address and you have not provided a valid and updated shipping address in your LiveAuctioneers Account upon completion of payment for the auction and your box was shipped to an invalid or an address other than to which you intended to have it shipped to, You will be responsible for any and all additional fees and shipping costs due to us associated with redirecting and/or shipping to your revised address. You may contact any packing and shipping company of your choice. Magnum Auctions, LLC will not transport any items to another shipper. If the buyer wishes to choose an outside shipper, it is the buyer's sole responsibility to arrange transport of the item to the shipper of their choice. We must receive an email within two days after the completion of the auction stating such. You will be emailed a copy of our release form. You must complete this form and return it to us. You will also be required to have the shipper contact us to schedule a pickup date and time. Magnum Auctions is located about 20 minutes from any outside shipping company. 6. Failure to Pay for Shipping: Once your Packing and Shipping invoice has been sent, you will have 10 Calendar days to pay the invoice. If your invoice remains unpaid on the 11th day following the date your invoice was sent and you have made no attempt to contact us, your items are then considered Forfeited & Abandoned and will become the property of Magnum Auctions, LLC. 7. Returns & Refunds: Please ask all pertinent questions before bidding. All items are sold at Caveat Emptor, meaning the sole responsibility lies with the buyer of goods, and he must perform due diligence before the purchase of the goods. We do our very best to call any issue that may affect the value of any item, and we supply numerous photos to give a good general idea of what you are buying. No Returns or Refunds are offered unless an item considerably varies from the photos or descriptions. That is solely based on our opinion, not that of the buyer, and ultimately any decision of Magnum Auctions, if any adjustment or cancellation of the order is made. If damage is noted, photographed, and evident in the photographs, and no additional condition reports were requested by the winning bidder, no refund shall be given. In the event we miss a condition issue, we will either make an adjustment or cancel the transaction. *INTERNATIONAL BIDDERS are ineligible to return items for ANY reason. 8. Erroneous/Accidental Bids: In the event you erroneously bid on an item, It shall be at the sole discretion of Magnum Auctions, LLC if the bid shall stand or be removed. You may be liable for the bid placed. 9. Incorrect Delivery Address: If you have not provided a valid and updated shipping address in your LiveAuctioneers Account upon completion of payment for the auction and your box was shipped to an invalid or an address other than to which you intended to have it shipped to, You will be responsible for any and all additional shipping and fees associated with redirecting and/or shipping to your revised address. 10. Credit Card Chargebacks: Credit Card Chargebacks for any reason will not be tolerated, WITHOUT EXCEPTION. By bidding in our auction, you are agreeing to our Terms and Conditions. This constitutes you acknowledge this and will not for any for any reason initiate a Credit Card Chargeback. In the case you do initiate a Credit Card chargeback for your purchase from Magnum Auctions, LLC, you agree it shall be decided in favor of Magnum Auctions, LLC, and you agree to cancel it and to forfeit and relinquish any right to any arbitration with the chargeback and against Magnum Auctions, LLC.
