Please read thoroughly: Terms and Conditions of Auction By registering to bid, placing a bid online or bidding in any manner offered, Bidders agree to the terms and conditions (written and/or announced) of this auction. This auction takes place in Arizona, so Arizona law applies. General. This is a cataloged auction and unless otherwise announced by the auctioneer, items are offered in order, by lot number, as listed in the catalog. Buyers are given ample opportunity to preview items online and/or live, prior to the auction, and are encouraged to consult with whom ever deemed appropriate to acquire satisfaction with regards to value, condition and authenticity of items. The Auction House (WTP) does its best to describe and photograph each item however, the descriptions and any attributions are opinion and opinions usually vary depending on with whom you speak. While we do our best to reach informed conclusions about the items, we are not experts in all fields, so it is ultimately the buyer's responsibility to inspect the item(s) to their satisfaction prior to bidding. The title of a lot passes to the winning bidder upon cleared payment. Estimates. The estimate range is provided as a guide for prospective bidders and is based on the condition, rarity, quality and provenance of the item(s) being offered. They do not constitute a warranty, representation, guarantee or prediction of a selling price. Estimates may be subject to revision at the discretion of WTP. Estimates do not include the buyer?s premium, any applicable taxes, and any other applicable charges. WTP is not liable for any errors or omissions with respect estimates in the auction catalog. Property Condition and Age. The physical condition of products offered can vary due to age and other circumstances. Dents, dings, scratches, other damage or repairs may be present, and is common, on used and vintage items. Opinions of condition and age may vary from person to person, so items are available for preview in advance of the auction. In general, we use terms such as "Antique" to describe items we feel are made prior to the 1930s; "Vintage" to describe the period between 1930s thru the 1970s and "Modern" applies to the 1980s thru current. Please inspect items and ask questions to your satisfaction PRIOR to bidding. Read the condition report listed for each item and look at the pictures closely, and then form your own opinion. Bidder/Buyer assumes all responsibility for ascertaining the condition of an item to their own satisfaction. A ?Buyer?s Premium? is added to the final hammer amount to help cover fees incurred by WTP. The premium is as follows: 15% (with a 2% discount offered if paid by cash, check, certified funds or wire transfers). Online Marketplace Platforms have an additional premium added (usually 5% over the WTP rate) as a pass thru of their premium fee charged to WTP. Check auction details on each platform individually for specific fees. State sales tax applies. Applicable sales tax is added to purchases within AZ (and any other states when applicable) unless a valid resale certificate is provided prior to bidding. ?Buy it Now? is a versatile option which may be offered at the discretion of Western Trading Post, with the cooperation of Sellers. How this works is if a buyer is willing to pay the high estimate plus applicable fees (which would include a 13% Buyer's premium and applicable shipping and handling) for a particular auction lot, they can buy the item(s) now and not wait till auction day. This option is generally available during the first five days the auction is posted on our website and is subject to seller approval (which we generally get at the time of consignment). Please see auction description for details. Item Withdrawal or Auction Delays. WTP reserves the right to withdraw any lot when sold through the buy it now option, or for any other reason, and neither assumes nor accepts any liability contemplated by a potential buyer for such withdrawal. The same applies to delays to the auction due to unforeseen circumstance. WTP reserves the right to delay or re-schedule an auction (or any portion thereof) for any reason, and neither assumes nor accepts any liability contemplated by a potential buyer for said delays. Payment and Card on file. Bidders shall have a credit card registered prior to bidding activity. In house bidders must pay for items in full on the day of the auction and a receipt is required prior to removal of any items. Online bidders will be sent an invoice at the close of the auction (auctioneer may elect to charge the buyer's card for purchases before shipping is calculated). Bidders bidding on the Live Auctioneers or Invaluable platforms must pay through their payment processing services and agree to their terms and conditions as well. By agreeing to the terms and conditions and placing bids, bidders grant Western Trading Post permission to charge their credit card (if and when applicable) without further question, for charges related to purchases. Charge backs by the cardholder are strictly prohibited and the buyer shall be held legally responsible for any such activity. Alternative forms of payment (check, money order, wire transfer, etc.) are also accepted. All invoices over $5,000 (regardless of bidding platform) shall be paid by certified check or wire transfer at the discretion of WTP and certain other invoices such as gold and silver lots, or purchases by parties unknown to WTP, may also be required to be paid with certified funds. *Please note, if a credit card is declined for any reason, a $15 service charge may be applied to your balance for each attempt to collect payment. If you pay by check, and it is returned, a $35 service charge will apply. If paying by check, items may not be released or shipped until check clears. Shipping: Items bought from afar can generally be shipped by Western Trading Post, or we work with a few different shipping services (see catalog for specific lot details). But please remember, we are shipping the item(s) for you, at your expense, and are not responsible for damage or loss caused by the shipping service. Buyer shall pay the shipping cost of items shipped, plus there is a minimum handling/packaging fee (see catalog listing for advertised cost on each lot). This charge is in addition to the cost of postage. We generally send packages priority mail with insurance, but if you want to make sure it is sent some other way, let us know immediately after the auction. Buyer takes the risk for un-insured packages. Once shipping is calculated, buyer will receive a final invoice and instructions on how to pay. This may include a Quickbooks invoice and/or wiring instructions. If we do not hear from online or absentee bidders within 24 hours, we reserve the right to charge their card (if on file) and ship the item(s) to the address provided without further notice. New buyers paying by credit card or check, and buyers wishing to have items shipped to another address other than the billing address of the card they are using, are subject to having the auction house hold their items for up to 30 days in order to make sure the payment clears. INTERNATIONAL BUYERS: Please note international shipments now have to be serviced through a specialty shipper to accommodate certain requirements such as duty forms, etc.. There will be a handling charge for facilitating/delivering items to the specialty shipper. Please contact us if you have questions or specific instructions regarding shipping. Items not picked up, or arranged to be shipped, or not paid for, or have other arrangements (such as a longer term hold or storage agreement), which are left after 7 days of the date of an auction my be considered abandoned and disposed of at the discretion of the auction house with no compensation owed to the person who abandoned their items. **Money Back Guarantee: If a mistake was made, or there is a problem not disclosed by either the photos and/or description, buyers have 14 days from the date it was purchased to return it to Western Trading Post for a refund or future auction credit of the purchase price and buyer's premium. Buyer to pay return shipping and shipping is non-refundable. (Shipping and handling are a convenience paid by the buyer for not having to attend in person. As this is a convenience for the benefit of the buyer, it is non-refundable, and not covered under the money back guarantee). Once the item is returned, WTP will determine whether or not there was an error made and proceed with the refund accordingly. Regarding Firearms: Any person(s) bidding on firearms in our auction are required to be at least 18 years of age for long guns and 21 years of age for hand guns. Western Trading Post llc. is a licensed Federal Firearms Licensed (FFL) dealer. Any Bidders who desire to bid on and purchase firearms in our auctions cannot have been convicted of a felony, have any restraining orders, or have any reason that they would not pass a NICS FFL background check. Western Trading Post llc. reserves the right to run a NICS FFL Background check on any purchaser of firearms. If the Bidder is a resident of the state of Arizona, they may pick up in person once cleared by the NICS FFL background check. Otherwise, firearms will be shipped to a Federal Firearm Licensed Dealer of your choosing nearest your residence. The Buyer agrees to pay for any and all shipping/handling/fees/etc. necessary for the shipping and transfer of firearms. Antique firearms and black powder replicas which are exempted from NICS FFL background checks can be transferred directly to the purchaser (where not prohibited). Regarding Bidding: Internet, absentee, phone and other acceptable forms of bidding are offered as a convenience to bidders, but Western Trading Post will not be held responsible for any failures or problems in the execution of such bids. All bids are subject to the terms and conditions herein and it is ultimately the bidder who is responsible for making sure a bid is presented to the auctioneer in a timely manner. Absentee bids may be entered by staff into the bidding system (possibly using a house bidding number) or can be entered by the bidder themselves directly into the online platforms. FYI, bidding on behalf of absentee bidders does not start at their maximum bid (unless otherwise instructed), but at the current asking bid. The system bids on behalf of the bidder, only as necessary, just the same as if the bidder was standing in the room bidding against the other bidders. If during the live auction, another bidder does not outbid what the absentee bidder is willing to pay, then the item will be won by the absentee bidder at what ever price was realized when the bidding terminated. WTP is not responsible in any way for a potential bid not reaching the auctioneer or being recorded in time to be recognized before a lot closes. Bidding Priority/Ties: Our auctions are often held on more than one platform simultaneously. When a lot opens for bidding during the live auction, if identical bids have been placed on more than one platform during the pre-bidding, we give priority to the bid placed on our site or app. Please note, it is rare, but possible for a bidder to win a lot for an amount equal to an absentee bidder?s bid. These so-called ?ties? will go to the bidder whose turn it was in the bidding in the live auction format. If this is not clear, please ask for further explanation of how bidding works in a live auction format, and realize bids are not technically accepted until they are acknowledged by the auctioneer. In the event of a dispute of a bid, the validity of a bid, the priority of a bid, or any other issue with respect to bidding -- the auctioneer has final say. As a matter of disclosure, Western Trading Post may have a financial interest in any or all of the lots being presented for auction. This interest is, at the very least, a sales commission based on the final hammer price. But it may also include an ownership interest in some lots. We may also bid on some consignments and/or reserves could also be in place where we bid on behalf of the reserve. If you want to know of our possible financial or bidding interest in any particular lot, or if there is a reserve on a particular lot, please contact us before the auction (these questions will not be addressed during the auction or on that day). Permission to contact and Privacy Policy. Western Trading Post may refuse to issue a bidder?s number and/or reject bids from any person for any reason we deem appropriate. All persons attending Western Trading Post, assume all responsibility for themselves and their property and specifically release and indemnify Western Trading Post, its agents and employees from claims and liability.
