GENERAL TERMS AND CONDITIONS for bidders at 100x100 by OstLicht Auction By submitting an online bid, each bidder at the 100x100 by OstLicht Auction accepts the terms and conditions of the auction. The auction is accessible worldwide via LiveAuctioneers and shall be conducted in accordance with the regulations of the Trade, Commerce and Industry Regulation Act and the applicable legal provisions. The place of performance is the Auction House's place of business, and the place of jurisdiction is Vienna. The valuation and professional description of the objects were carried out by experts of OstLicht Auction. Errors and misprints may occur. Corrections to the descriptions in the online catalogue may be made up until the auction. Within the framework of this special auction format, we are unable to provide individual condition reports. All lots may be viewed in person at Gallery OstLicht during the auction period. High-resolution photographs are available in the online catalogue. Bids may be placed exclusively through the LiveAuctioneers platform. No buyer's premium shall be charged. No additional fees or commissions imposed by LiveAuctioneers shall apply. The purchaser shall be liable solely for payment of the hammer price together with the actual and verifiable shipping costs incurred. The auction house reserves the right to request proof of funds. The auction will take place in the order of the online catalogue numbering. In principle, no underbids will be accepted. All prices are in EURO, and all invoices must be paid in EURO. Ownership of the auctioned goods shall not pass to the buyer until full payment has been received. In the event of a successful bid, the buyer undertakes to accept and pay for the lot purchased. The items are insured until 14 days after the auction or until the buyer takes possession of them before the expiry of this period. Thereafter, the buyer assumes full responsibility for the purchased lots. The auctioned lots will only be released to the highest bidder after full payment of the hammer price and shipping costs. For lots purchased online, an invoice with bank details will be issued as soon as possible. Payment is due within 8 days of receipt, net, without deduction and including all bank charges. In the event of late payment, default interest of 5% above the base rate of the Austrian National Bank will be charged. Costs for packaging, transport and transport insurance will be invoiced separately at cost. We make every effort to offer the most reasonable transport and insurance rates. A storage fee of EUR 5–20 per day and item may be charged for auctioned items not collected within 30 working days from the invoice date. In the event of refused acceptance, late payment or non-payment, the buyer shall be liable for all resulting damages and costs. Lots that have not been paid for or have only been partially paid for may be auctioned again. In such a case, the original buyer shall be liable for any deficiency in the resale price and shall not be entitled to any surplus. Auctioned items cannot be returned. However, in the case of an obvious and significant error in the description, and provided the buyer has not personally inspected the item, any claim must be submitted in writing no later than 8 days after receipt. If the claim is accepted as valid, the buyer is entitled to a refund of the purchase price upon return of the auctioned item.
