By registering to bid with Ararity Auctions, you acknowledge that you have read, understand, and agree to these Terms and Conditions and all referenced shipping and payment policies. Ararity Auctions has the authority to accept, limit, or deny any and all bidders. All sales are final. Any items not removed within fifteen (15) days of auction end may, at Ararity Auctions' sole discretion, be deemed abandoned and subject to storage fees, resale, disposal, or forfeiture without refund unless other arrangements have been approved in writing. Ararity Auctions endeavors to accurately describe and photograph all items being sold, however, all items are provided as is, where is, and with all faults without any warranties. All property is offered and sold in as-is/where-is condition at the time of the auction, with all faults, including any hidden defects of any nature. Ararity Auctions does not make any guarantee on the representation of an item, condition, correctness of titles or descriptions, genuineness of any items, attribution to artists or designers, period of the item, value, source, authenticity, and/or any other aspect or characteristic of such property. Any statement, written or verbal, in the catalog, in a condition report, or stated before, during or after the auction, or written or stated elsewhere, as to physical condition, history or provenance, origin, age, source, measurements, size, weight, quality, imperfections or damage, authorship or artistry, where an item has been displayed, exhibited or previously sold, or as to the items value or any other feature of the item, are statements of opinion and not representations or warranties. The bidder acknowledges that in no event shall Ararity Auctions or its employees be held liable for any damages, including without limitation, compensatory, incidental, or consequential damage. The bidder also agrees by bidding with Ararity Auctions to hold Ararity Auctions and its employees harmless for errors or omissions. These disclaimers shall apply to the fullest extent of the law. In the case that a bidders jurisdiction does not allow the exclusion of certain limitations of liability for damages, some of the above disclaimers and limitations may not apply to you. Ararity Auctions or its employees do not make any representation or warranty on behalf of Ararity Auctions. Ararity Auctions assumes no liability for damages by the failure or disruption of online services through LiveAuctioneers. In the event of any dispute between bidders or any error in bidding, Ararity Auctions shall have sole and absolute discretion to determine the successful bidder, reopen bidding, cancel the sale, or take any other action it deems appropriate. You agree that any provided photographs of lot(s) are adequate for your purposes and you have had fair opportunity to ask questions of Ararity Auctions. Please note catalog photos may have had modifications via processing or otherwise that may, in some cases, cause variation in color or appearance. Ararity Auctions does not provide returns or refunds. You hereby acknowledge and agree all sales are final with no refunds or returns. Ararity Auctions functions as a sales intermediary for individuals, estates, and trusts, facilitating the consigned property's sale. By participating in this auction and placing a bid on a lot, you are forfeiting any rights to retract your final bid once the item(s) or lot is declared sold or to annul the contract formed as a result of the final auction sale. By registering, you consent to receive email communications from us regarding auctions and other related announcements. You may unsubscribe from marketing emails at any time. Ararity Auctions and/or its consigners reserve the right to use all available methods to rectify non-payment or non-compliance with these terms and conditions. These terms nor any provision hereof may be modified, amended, or waived except by written permission of Ararity Auctions. If any term, provision, part of a provision, or sentence within these terms is deemed invalid, illegal, unenforceable by any rule or law, or contrary to public policy, such provision, part, or sentence shall be severed from these terms. All remaining conditions and provisions will continue to be fully effective and enforceable.

If you have not contacted Ararity Auctions to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
