The following Conditions of Sale constitute the entire agreement with the purchaser relative to the property listed by Revere Auctions, LLC (?Revere Auctions?). Revere Auctions acts as owner or as an agent for various owners and consignors. Revere Auctions reserves the right to change the terms of sale by oral announcement. Any such change shall become part of the Condition of Sale. By bidding at auction (whether through a live internet bidding platform, by agent, by telephone, by absentee bid instruction, or present in person), you (sometimes referred to as a ?buyer? or a ?purchaser?) agree to be bound by these terms.
Before the Sale
All lots are offered and sold strictly "AS IS, WHERE IS," with all faults and imperfections, and without recourse. Neither Revere Auctions nor its consignor(s) makes any warranties or representations, express or implied, with respect to such lots. All implied warranties, including merchantability and fitness for a particular purpose, are hereby disclaimed. By placing a bid, the buyer confirms they have thoroughly reviewed the lot and have satisfied themselves entirely as to its condition, authenticity, attribution, and description.
Prospective buyers bear sole responsibility for conducting their own independent due diligence. Bidders are strongly advised to personally examine any property in which they are interested before the auction takes place. As a courtesy to prospective bidders unable to inspect property in person, Revere Auctions may provide written condition reports and supplementary high-resolution imagery upon request. Any condition report provided is a subjective statement of opinion prepared to the best of our specialists? judgment; it should not be construed as comprehensive or definitive. The absence of a specific condition report, or the absence of references to damage, wear, restoration, or repairs within a description, does not imply that an item is in pristine condition or free from defects. Revere Auctions assumes no liability for late requests that cannot be fulfilled prior to the start of the auction.

Reserves
Some of the lots in this sale are offered subject to a reserve, which is the confidential minimum price below which the lot will not be sold. A reserve shall not be greater than the low estimate of the lot. A representative of Revere Auctions will execute such reserves by bidding on behalf of the consignor.
Withdrawal
Revere Auctions in its sole and exclusive discretion, reserves the right to withdraw any property, at any time, before the fall of the hammer.
Buyer's Premium & Other Fees
The buyer's premium is an additional fee added to the final hammer price which the buyer will pay. This fee will be calculated on the final bid amount and added to the invoice. It is payable by the buyer to Revere Auctions as part of the total purchase price. The buyer's premium is charged at a 25% rate when bidding directly on the Revere Auctions website/platform and 30% on all other third-party platforms/websites/apps. All purchases, regardless of bidding method, are subject to the buyer's premium and appropriate Sales Tax (see Sales Tax section for more details).
An additional fee may be charged by the third-party platform a customer bids through. Those bidding live online or leaving absentee bids on liveauctioneers.com, invaluable.com, bidspirit.com, bidsquare.com, drouot.com, the-saleroom.com, or any other third-party platform/website may be required to pay an additional fee per the user agreements in place with these companies. Bidders are responsible for reviewing those sites to understand their additional fees. By bidding through these platforms/websites/apps, you agree to pay any additional fees associated with that platform/website/app. These fees are unrelated to Revere Auctions and cannot be removed by Revere Auctions.
There is a 3% processing fee added to all credit/debit card payments.
Bidding
Revere Auctions reserves the right to limit bid amounts for any reason on registered accounts. Additional financial records, proof of payment, or deposit from a bidder may be required to increase a bid limit. Questions about your bid limit and/or adjustment to that limit needs to be communicated directly with the auction house. Please reach out to payments@revereauctions.com for instructions.
Bidding may be available online, by absentee ballot, or by telephone. All absentee and telephone bid requests must be submitted directly to the auction house 24 hours before the start of the sale. Revere Auctions reserves the right to decline bids based on the timing of the request, staff limitations or other reasons, within Revere Auctions sole and absolute discretion. The highest bidder acknowledged by the auctioneer during the live auction shall be the selected buyer. The auctioneer has the right to reject any bid, to advance the bidding at their sole and absolute discretion, and in the event of any dispute between bidders, the auctioneer shall have the sole, absolute and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after sale, the Revere Auction sale record shall be conclusive in all respects. If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, the auctioneer may reject the same and withdraw the Property from sale.
Hammer
Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the buyer with these Conditions of Sale. All sales are final, with no returns or refunds except as provided in this limited warranty. The Buyer thereupon assumes full risk and responsibility of the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full price, plus Buyer's Premium, therefore or such part, upon such terms as Revere Auctions may require. Title in a purchased lot will not pass until Revere Auctions has received in full the total purchase price in cleared funds. Unless exempted by law, the purchaser will be required to pay Minnesota state sales tax as applicable, any applicable local sales tax, and any applicable compensating use tax of another state.

A buyer's premium will be applied to the purchase price of all items:
25% - when bidding directly through Revere Auctions.
30% - when bidding on LiveAuctioneers?s platform/app.
Auto-payment is charged 72 hours after invoices are sent out. The amount due will be charged to the payment method on account. It is the purchaser?s responsibility to contact the auction house to change/remove the auto-payment.
All credit/debit payments (Visa, Discover, American Express or MasterCard) are subject to a 3.0% processing fee.

All sales are final. The purchaser's obligation to pay the full purchase price immediately is absolute and unconditional and is not subject to any defenses, setoffs or counterclaims of any kind whatsoever. Revere Auctions is not obligated to release a lot to the purchaser until title to the lot has passed. The purchaser agrees to pay Revere Auctions' handling charge of $30 for any check dishonored by the drawee. Please note that Revere Auctions reserves the right to refuse to accept payment from a source other than the buyer of record.
In addition to other remedies available to us by law, we reserve the right to impose from the date of sale a late charge of 1.5% per month of the total purchase price if payment is not made in accordance with these conditions.

Revere Auctions offers in-house shipping for eligible orders and referrals to third-party shippers. Customers with eligible orders will receive an email from ShippingSaint.com within two business days after an auction informing you of eligibility. Please allow 7-10 business days after submitting payment for your order for Revere Auctions to begin packaging your order. Eligible orders will include but are not limited to, unframed artwork, framed artwork, jewelry, coins, and decorative objects. Ineligible orders include but are not limited to, furniture, oversized lots, and any lot that must be shipped by a third party.
LiveShip is not part of our in-house shipping services and is handled/quoted directly by LiveAuctioneers, in no affiliation with Revere Auctions.
As a convenience to the Buyer, Revere Auctions will make a referral for packing and shipping to third-party shipping vendors. This is at the request, expense, and risk of the Buyer, and Revere Auctions assumes no responsibility for the items or the timing of delivery. Insurance for in-transit items is the responsibility of the buyer. The buyer must reach out to a third-party shipping vendor to arrange shipping.
?Oversized lots? are objects such as furniture, andirons, floor vases, sculptures, or any other item whose safe packing will exceed the limits of common carriers. The delivery of oversized, large, exceedingly heavy, or high-value objects is not an inexpensive proposition and we urge you to consider this before bidding.
The buyer must fill out the Shipping Release Form in order for their items to be released to a third-party shipper. This is to ensure that the won item(s) are given to the proper shipping company and reach their final destination safely. REMOVAL
Collection of purchased lots must be completed within 30 days (Retrieval Period) of the sale date reflected on the invoice. Property purchased from Revere Auctions by a successful bidder will not be released to such bidder until the full payment of the total purchase price (including the buyer's premium and online bidding service fee, and all applicable sales taxes) has been made. The purchaser must remove all property from the auction premises at their expense.
Revere Auctions reserves the right to charge storage fees for property left in their facility beyond the 30-day Retrieval Period. If the purchaser fails to retrieve their property within the allotted Retrieval Period, Revere Auctions reserves the right to charge a minimum storage and handling fee starting at $20 per lot, per day. This storage fee will be required payment in order to release any lots after the Retrieval Period window. Purchasers are reminded that Revere Auctions' liability for loss or damage to sold property shall cease no later than thirty (30) days after the date of the auction, and immediately upon removal from the Revere Auctions? facility.
Revere Auctions also reserves the right to send the property to an off-site public warehouse for storage at the risk and expense of the purchaser, to be released only after payment in full of all removal, storage, handling, insurance, and any other costs incurred, together with payment of all other amounts due to us.
Property still present at the Revere Auctions? facility more than 180 days after the date of sale will be considered abandoned property. We reserve the right to cancel the sale, without refund, thus revoking ownership, and reoffer the lot(s) at our discretion on any abandoned lot(s).

Jewelry, Watches, & Sterling

Jewelry mountings and other metals, including silver hollowware, flatware, and other sterling objects, etc., bearing a metal karat or content mark, were not tested to verify the metal content.
All types of gemstones may have been improved by some method. Colored stones may have been enhanced by various treatments to improve their appearance. These methods are considered common by the international jewelry trade. Treatments may or may not be permanent and may or may not require special care. Unless the catalog description specifically states that the stone is of natural color, it should be assumed that a treatment may have been used.
All gem material was graded in the mounting. The mountings limit the ability to be exact in the color and clarity grades assigned to these gems. This is reflected in the use of ranges when describing color and clarity. All gem material was measured in the mounting unless otherwise noted. Due to the mountings, the measurements may not be exact. These measurements were used when calculating the gem material?s carat weight using industry-standard formulas. The carat weight of gem materials is approximate based on these calculations.
Watches are not tested for time; while watches may run, they may not keep time accurately. Watch cases, bracelets, and bands may include after-market alterations. Many timepieces have been repaired in the course of the object's life and may contain replacement parts. Most watches have been opened to determine the type of movement. Due to this, water-resistant cases may no longer be waterproof, and we recommend they be checked by a competent professional before use.

Cultural Patrimony, Repatriation & Withholding Policy
Revere Auctions is dedicated to the ethical stewardship and repatriation of Native American cultural patrimony, sacred items, and objects of religious significance through active consultation with tribal nations and governing authorities. In adherence to these standards, lots may be subject to review, temporary holds, or permanent withholding upon the request of the Association on American Indian Affairs (AIAA) or tribal representatives, which may result in the withdrawal of lots prior to the auction or the cancellation of completed sales. Remedies
If the purchaser fails to fulfill or comply with any of the conditions herein, the purchaser shall be in default and, in addition to all legal remedies available to the Revere Auctions and the consignor by law, including, without limitation, the right to hold the purchaser liable for the total purchase price, including all fees, charges and expenses more fully set forth herein, Revere Auctions, at its option, may: a) cancel the sale of that, or any other lot or lots sold to the defaulting purchaser at the same auction or any other auction, and retain all payments made by the purchaser as liquidated damages; b) resell the purchased property whether at public auction or by private sale, for the account of the purchaser, in which case the purchaser shall be liable to Revere Auctions for all its costs and damages, including the commissions for both auctions; c) remove the property to a public warehouse for the account and at the risk and expense of the purchaser; d) charge interest at such rate as we shall reasonably select, or e) effect any combination thereof. In any case, the purchaser will be liable for any deficiency and any and all costs, handling charges, late charges, expenses of both sales, our commissions on both sales at our regular rates, legal fees and expenses, collection fees, and incidental damages. Payment will not be deemed to have been made in full until we have collected good funds. In the event that the purchaser fails to pay any or all of the total purchase price for any lot and Revere Auctions nonetheless elects to pay the consignor any portion of the sale proceeds, the purchaser acknowledges that Revere Auctions shall have all of the rights of the consignor to pursue the purchaser for any amounts paid to the consignor, whether at law, in equity, or under these conditions of sale. In addition, the defaulting purchaser will be deemed to have granted and assigned to Revere Auctions a continuing security interest of first priority in any property or money of or owing to such purchaser in our possession, custody or control, in each case whether at the time of the auction, the default or if acquired at any time thereafter, and we may retain and apply such property or money as collateral security for the obligations due to us.
Revere Auctions makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after the bidder's receipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at their own expense, obtain the opinion of two mutually agreed-upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyer's sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the property in the same condition as at the time of sale. Revere Auctions shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty. The limited warranty does not extend to the lots identified as attributions, school, circle, manner, or after.
Limited Liability
In no event will Revere Auctions, LLC?s liability to a purchaser with respect to an item of property exceed the greater of $100.00 and the purchase price actually paid by such purchaser for such item. We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots by us is at the entire risk of the purchaser and Revere Auctions will have no liability for any loss or damage to such items.
Copyright
The copyright in all images, illustrations and written material produced by or for Revere Auctions relating to a lot, including the contents of this catalogue, is, and shall remain at all times, the property of Revere Auctions and shall not be used by the buyer nor by anyone else, without our prior written consent. Revere Auctions reserves the right to reproduce any image of the lots sold in this catalogue. The rights and obligations of the parties with respect to these Conditions of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in Minnesota. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law.
Miscellaneous
If a dispute, controversy, claim or cause of action arises out of, or in connection with, this Conditions of Sale or any breach or alleged breach thereof (the "Dispute"), and if the Dispute cannot be settled through direct discussions, we mutually agree to endeavor first to settle the Dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures then in effect (or under any other form of mediation mutually acceptable to the parties involved) before resorting to arbitration. Any unresolved controversy or claim relating to the Dispute shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules then in effect (or under any other form of arbitration mutually acceptable to the parties involved), and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. If all parties to the Dispute agree, a mediator involved in the parties' mediation may be asked to serve as the arbitrator. The mediation and arbitration, if any, shall take place in Saint Paul, Minnesota. Any award rendered shall be final and conclusive upon the parties. The costs and expenses of the mediation and arbitration shall be borne equally by the parties, provided, however, that the arbitrator shall award to the prevailing party, if any, the reasonable costs and attorneys' fees incurred by the prevailing party in connection with the mediation and arbitration. If the arbitrator determines that a party was the prevailing party on some but not all of the claims and counterclaims, the arbitrator may award the prevailing party an appropriate percentage of the reasonable costs and attorneys' fees incurred by the prevailing party in connection with the mediation and arbitration. In the event this mediation/arbitration provision is found to be unenforceable or inapplicable for any reason, then any dispute, controversy, claim or cause of action arising out of, or in connection with, these Conditions of Sale or any breach or alleged breach thereof, shall be brought in the state courts in Saint Paul, Minnesota, and Company irrevocably consents and submits to the jurisdiction of such courts to litigate any such action and waives trial by jury. The prevailing party in such action shall be entitled to recover its reasonable costs and attorneys' fees incurred in connection therewith, and if it is determined that a party was the prevailing party on some but not all of the claims and counterclaims, such party may be awarded an appropriate percentage of the reasonable costs and attorneys' fees it incurred in connection therewith. You understand that absent this provision, you would have the right, and are hereby waiving your right to sue in court and have a jury trial.
Autopay
If you have not contacted Revere Auctions to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
