Terms & Conditions
1. Conditions of Sale. All lots are sold AS IS, WHERE IS, and with all faults. Neither the Auction Company (The Fine Art Specialist LLC) nor the consignor makes any guarantees, warranties, or representations (express or implied) regarding authenticity, authorship, origin, condition, age, size, or value. Bidders are encouraged to request condition reports and ask questions before the auction.
2. Bidding & Auctioneer's Discretion. The highest bidder acknowledged by the auctioneer will be the buyer. In the event of a tie bid, a dispute between bidders, or doubt as to the validity of any bid, the auctioneer has sole discretion to determine the successful bidder or to re-offer and resell the lot. The auctioneer's record of sale is conclusive.
3. Registration & Absentee Bidding. All bidders must register in advance and provide complete billing information. The Auction Company may, at its sole discretion, require presentation of government-issued photo identification, credit references, or other verification as a condition of bidder registration or participation. The Auction Company reserves the right to decline registration or bidding privileges to any individual or entity. The Auction Company may accept in-house absentee bids. Absentee bids are executed competitively as though the bidder were present. Online absentee and live bidding are facilitated by LiveAuctioneers. Please see LiveAuctioneers' site for their terms and procedures. If a bidder leaves absentee bids with both the Auction Company and LiveAuctioneers, it is solely the bidder's responsibility to manage or cancel duplicate bids. The Auction Company will not be held responsible for executing duplicate or conflicting bids.
4. Buyer's Premium & Payment. A 25% buyer's premium will be added to the hammer price of each lot. Payment may be made by cash, approved check, wire transfer, or credit card (credit cards may incur additional fees). Payment must be completed no later than 7 days after the auction. Late payments may result in storage charges and/or cancellation of sale. Invoices generated through LiveAuctioneers will be automatically billed to the card on file unless prior arrangements are made. The Auction Company reserves the right to hold Property purchased by ACH and personal check until the payment has cleared the bank.
5. Title, Risk, and Removal. Title to each lot passes when the auctioneer announces it as sold. Thereafter, all risk of loss, damage, or theft is borne by the buyer. The Auction Company does not provide in-house shipping services, but will provide a list of third-party shippers upon request. Packing, handling, and shipping arrangements are solely the buyer's responsibility and expense. If the Auction Company or its staff assists in packing, handling, or transport, such assistance is at the buyer's sole risk and without liability to the Auction Company.
6. Storage Fees. All purchases must be paid for and removed in a timely manner. Storage fees of $5 per lot per business day (or $25 per lot per week, whichever is greater) will be charged for items left more than 30 days after the auction. Items left beyond 45 days may be re-consigned to a future auction without further notice, and any proceeds, less fees and costs, may be applied toward the outstanding balance.
7. Default and Cancellation. If any buyer fails to pay the full balance of their invoice within the required timeframe, the Auction Company reserves the right, after 30 days from the auction date and without further notice, to cancel the sale of any unpaid or partially paid lots. In such event, any funds already paid toward the invoice may be retained by the Auction Company as liquidated damages and not as a penalty. The lot(s) may be re-offered in a future sale without notice to the buyer. The buyer remains liable for any deficiency, handling charges, storage fees, and all costs of resale or collection.
8. Taxes. All purchases are subject to applicable state and local sales tax unless the buyer provides a valid resale certificate prior to purchase.
9. Rescission Policy. The authenticity of authorship (as defined in the catalog heading) is warranted for 14 days after the auction to the original buyer of record. If a lot is determined to be misattributed, the sale may be rescinded, provided the lot is returned in the same condition as at the time of sale and accompanied by a written opinion of a qualified expert recognized in the relevant field and acceptable to the Auction Company. The buyer's sole remedy in such a case is a refund of the purchase price and buyer's premium. No incidental or consequential damages, including shipping costs or expert fees, will be considered.
10. Online Bidding Disclaimer. The LiveAuctioneers bidding portal software is a third-party service. The Auction Company is not responsible for errors, technical failures, missed bids, or connectivity issues on any third-party platform. Participation through such platforms is at the bidder's own risk.
11. Terms of Guarantee and Catalog Terminology. All property is sold AS IS, and no statement oral or written shall be deemed a guarantee of authorship, description, age, or provenance. While we strive to catalog items accurately, all buyers are responsible for forming their own opinions before bidding. When used in catalog descriptions, the following terms carry the meanings below. These definitions are provided for guidance only and are not guarantees of authenticity: Attributed to [Artist] In our opinion, the work is of the period of the named artist and may be by that artist, but we make no warranty that it is. Circle of [Artist] In our opinion, the work is of the period and closely associated with the named artist or from the artist's studio, but we do not guarantee authorship. After [Artist] In our opinion, the work is a later copy or interpretation of a work by the named artist. Manner of [Artist] In our opinion, the work was created in the style of the named artist and bears stylistic similarities but was executed by another hand, and we make no warranty of authorship or period. These attributions are expressions of opinion only and are subject to change as research and scholarship progress. The Auction Company, its specialists, and consignors make no warranties, express or implied, regarding these attributions. Buyers accept all lots with all faults and errors of description.
12. Bid Increments. Unless otherwise announced by the auctioneer, bids shall advance according to the following increments: $0 $10: $1 increments $10 $50: $5 increments $50 $100: $10 increments $100 $500: $25 increments $500 $2,500: $50 increments $2,500 $5,000: $100 increments $5,000 $10,000: $250 increments Variations from these increments are at the auctioneer's sole discretion, and the auctioneer may reject or reopen any bid deemed not in keeping with the increment structure or fairness of sale.
13. Governing Law and Jurisdiction. By bidding at this auction (whether in person, absentee, online, or by any other method), the bidder agrees that these Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Venue for any action shall lie exclusively in Philadelphia County, Pennsylvania. Any dispute, claim, or cause of action arising out of or relating to this auction shall be resolved exclusively in the state or federal courts located in the Commonwealth of Pennsylvania. Bidders consent to the jurisdiction of such courts.
14. Acceptance of Terms. By bidding at this auction, the bidder acknowledges review of and agrees to be bound by these Terms & Conditions.
15. Photography and Recordings. The Auction Company may photograph, record, or otherwise document the auction and its participants for recordkeeping, publicity, or marketing purposes. Participation in the auction constitutes consent to such recording and use.
16. Errors and Omissions. The Auction Company is not responsible for typographical errors, omissions, or misprints in the catalog, online listings, or any other auction-related materials. The Auctioneer reserves the right to correct such errors at any time.

If you have not contacted The Fine Art Specialist LLC to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
