By bidding at Your Best Call Auction Services Group, LLC, whether it be live, online, onsite, absentee or phone bid, you agree to be bound by Your Best Call Auction Services Group, LLC Terms & Conditions stated here forth. Addendum statements made day of auction take precedence over previously printed materials. The validity and interpretation of any of the terms and provisions of this agreement or of the rights and duties of the parties under this agreement shall be governed by the laws of the Commonwealth of Pennsylvania and venue of all proceedings shall occur in Delaware County, PA. 1. Bidding Qualifications Live Online Bidding Online bidding is offered worldwide through our in-house platform, as well as through third-party platforms such as LiveAuctioneers and HiBid. Please ensure that you are qualified to bid online. Bidders with limited history or with open disputes may require additional credit verification. Your Best Call Auction Services Group, LLC reserves the right to decline any bidders who fail to meet the registration criteria. Please note that third party online bidding does have a higher buyer's premium associated. The highest bidder shall be the buyer, and if any dispute arises between two or more bidders, the auctioneer shall decide the buyer or immediately put the item up for sale again. In the event of a tie between an online bidder and the floor bidder, the successful bidder will be at the auctioneer's discretion. The auctioneer's decision will be binding and final. Some lots are offered subject to a reserve, which is a confidential minimum price below which such a lot will not be sold. The record of sale, kept by the auctioneer and clerk, will be taken as absolute and final in all disputes. At its discretion, Your BEST Call Auction Services Group, LLC may also accept bids from approved internet bidders. Your BEST Call Auction Services Group, LLC or any of its staff shall not be held responsible or liable for any human or technical bidding errors, or internet bidding system shutdowns that may occur. Absentee Bidding For those unable to attend the auction, Your Best Call Auction Services Group, LLC offers the absentee bid service as a convenience to our patrons. Your BEST Call Auction Services Group, LLC will not be held responsible for error or failure to execute the bid(s). Absentee bid requests must be in writing and a fifty dollar ($50) minimum bid is required per item. Phone Bidding Phone bid requests must be in writing. All phone bids are required to open at $250 or half of the published estimate (whichever is greater and no less than $250). We suggest that phone and absentee bids be made at least 24 hours in advance to allow time for processing. Your BEST Call Auction Services Group, LLC shall have the right to accept absentee and phone bids for any items consigned for any particular auction. Your BEST Call Auction Services Group, LLC reserves the right not to execute any absentee bid at its discretion and to have no liability for any inadvertent failure to execute any such bids. Bidding Increments for Live & Phone Bidding Generally, bidding increments are made as follows, although the auctioneer has the discretion and authority to change them. Online bidding increments may vary, see each auction for details. When price is $250, the next bid increment is $275. When the price is $500, the next accepted bid is $550. 2. Buyer's Premium, Sales Tax & Payment When bidding on the in-house platform, yourbestcallauctionservicesgroup.com, the purchase price payable by a buyer shall be the sum of the final bid plus a premium of 20% of the final bid. An additional 3% will be added if payment is made by credit card/debit card. When bidding on a third-party platform (LiveAuctioneers and HiBid), the purchase price payable by a buyer shall be the sum of the final bid plus a premium of 28% of the final bid regardless of payment method. In addition, buyers are required to pay any sales tax, which may be due, unless exempted by law. Acceptable forms of payments: Visa, MasterCard, Discover, American Express, wire transfer, money order, cash and check. Payments are due within (10) Business days. Returned checks will be assessed a $35 charge for insufficient funds. Successful online bidders, who bid through a third party online bidding platform, will be assessed a 5% surcharge. This charge offsets the fee collected by the third party platform. For more information regarding this charge please see third party website for terms. 3. Pick-Up and Shipping Customer Responsibility Check List: Payment Pickup or Shipping Scheduling/Arrangements Vehicle, Helpers, Packing Supplies Review Terms Your BEST Call Auction Services Group, LLC does not offer in-house shipping under any circumstances. The buyer must pick up their items, or work with a third-party shipping company to handle the packing and shipping of items won at auction. The buyer is responsible for contacting third party shipping companies for cost estimates, as well as for making the shipping company aware that they will be picking up on the buyer?s behalf, and that they need to do so within ten (10) business days of the sale. Full payment to Your Best Call Auction Services Group, LLC is required before any item will be released to the buyer?s chosen shipper. The buyer will be responsible for all shipping costs, PA sales tax, and will pay their chosen shipper directly for all costs associated with the pickup, packaging, and shipment of items won at auction. A list of preferred shippers can be found below. All items must be picked up by appointment only. Pickup appointments may be scheduled online at: Pickup Appointment Scheduler All items must be removed from Your Best Call Auction Services Group, LLC within 25 business days of the sale date. Any item remaining beyond this period will be considered abandoned property. After 25 business days, Your Best Call Auction Services Group, LLC reserves the right, at its sole discretion and without further notice to the buyer, to dispose of, donate, sell, or otherwise handle any abandoned property. Furniture If we say "Chippendale Mahogany Chest of Drawers," we represent that the piece was made during that period. If we say "Chippendale Style Mahogany Chest of Drawers," we represent that the piece looks like the period mentioned, but it was crafted at a later date. 9. Your BEST Call Auction Services Group Online Onsite Auctions Your BEST Call Auction Services Group conducts auctions at various different onsite locations through online only timed auctions. The terms and conditions mentioned herein apply to these auctions along with the requirements below regarding merchandise pick-up. Designated pickup times are established for customers to remove their purchased items. Instructions will be included in your invoice for pickup. NO REFUNDS will be given on purchased items that are not picked up during the designated pick-up times. 10. Limitations of Liability Your BEST Call Auction Services Group is not liable for any breach or default by the consignor of a Lot. Your BEST Call Auction Services Group may withdraw any item before the sale if there is doubt as to the authenticity, title, or laws restricting the sale of the item or the accuracy of the Consignor's representations. 11. Governing Law Pennsylvania State Law prohibits any owner from bidding on their own merchandise to enhance the value. "Bidding in" or bidding on behalf of the Consignor shall be grounds for discontinuation of the auction and a claim for any resulting damages including, but not limited to, a reasonable amount for lost commissions. Your BEST Call Auction Services Group logo(s), content and photography are copyright materials that may not be copied, used or duplicated without the written consent of Your BEST Call Auction Services Group.

If you have not contacted Your Best Call Auction Services Group to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
