Bidding at auction, whether online, or by absentee bid, the buyer agrees to be bound by these terms. Lauro Inc. dba Lauro Auctioneers ("the Auctioneer") sells as agents for the seller and as such is not responsible for any default by buyer or seller. The Seller warrants to the Auctioneer and to the buyer that he is the true owner or is properly authorized to sell the property by the true owner and is able to transfer good and marketable title to the property free from any third party claims. The highest bidder to be the buyer. If during the auction the Auctioneer considers that a dispute has arisen he has absolute authority to settle it or to re-offer the lot. The auctioneer may at his sole discretion determine the advance of bidding or refuse a bid, divide any lot, combine any two or more lots or withdraw any lot without prior notice. Seller Requires all bidders to contact and obtain permission to bid. All persons wishing to bid online for this auction are required to complete the online registration, therefore acknowledging their acceptance to the terms and conditions of the auction. All prospective Internet Buyers are required to register prior to the Auction and/or bidding. Buyer’s Premium: A ten-percent (10%) Buyer’s Premium will be added to the winning bid price to arrive at the total contract price paid by the purchaser for on-site buyer. A fourteen-percent (14%) Buyer’s Premium will be added to the winning bid price to arrive at the total contract price paid by the purchaser for internet buyer. There will be a 6% (Six Percent) Florida State Sales Tax for purchases picked up from the auction site or shipped within the State of Florida. A ten-percent (10%) down payment will be due immediately after being declared the buyer. The balance is due in cash at closing within 30 days. Registration begins anytime prior to auction day by contacting our office or 10:00 AM (ET) auction day 10/29/06. The auction begins at 2:00 PM (ET). The auction will take place at Bradford Marine located at 3051 State Road 84 Fort Lauderdale, FL 33312. Buyer Broker Participation: 2% commission will be paid to any properly licensed Buyer’s Broker who registers a successful buyer according to the Broker Participation Guidelines. Broker registration forms are available by contacting our office. Forms must be completed and returned no later than 24 hours prior to the auction. Catalogs and brochures are descriptive guides only, in which we have tried to provide the best information possible, but their accuracy cannot be guaranteed or warranted. Auctioneer will not be liable for any errors or omissions. All items are sold as is, where is, with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Your bidding will signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. All measurements are approximate. Bidders acknowledge that all lots were available for inspection prior to the auction and that they relied solely on their own inspection of the lots and not on any information listed in the catalog or otherwise provided by the Auctioneer, the auction staff or Seller. Our goal is to provide prospective bidders with accurate and detailed information. We recommend prospective bidders examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the item in question. We do not give refunds. All sales are final. Lauro Auctioneers can, if contacted by buyer, assist in shipping but shipping arrangements and costs are the responsibility of the buyer. All lots must be removed from the auction site by 5pm November 29th, 2006. Shipping arrangements for removal or storage of any item purchased through the internet on EbayLiveAuctions.com, by phone, live bid, or absentee bid, must be made within 30 (thirty) business days. Any lot not removed from the site by 5pm 11/29/06 will be deemed abandoned and be promptly disposed of or resold for Auctioneer's account. In the event that the buyer of any lot fails to pay the purchase price thereof when due, the Auctioneer shall have the option, at its sole discretion, to (a) enforce payment by civil action or other proceedings against the buyer; (b) to void the sale as if said sale had not occurred; or (c) to exercise any other remedy or remedies available under the law, including but not limited to a second sale of said item, including the subsequent enforcement of any deficiency against the initial buyer. The Auction House reserves the right to require that advance bids received either by mail or by means of telecommunications including email be accompanied by a 25% deposit. All items forwarded to a shipper/handled will be at the purchaser's risk. All persons attending the auction or removing goods assume all risk of damage or loss to persons or property. The Auctioneer, Auction Company and Seller shall be released from any and all liability. Contact us if you need assistance with shipping your items. Auction Company assumes no responsibility for items once they are shipped. All claims must be made through the shipping company used. Buyer agrees to make a ten-percent (10%) down payment immediately upon notification of winning bid. Notification of successful bids will be made within 24 hours of auction close. Acceptable forms of payment include cash, cashier’s checks, wire transfers and PAYPAL (payable to: mark@lauroauction.com). Credit cards will only be accepted via the internet through PayPal only, and with a verified address. The auction house reserves the right to hold property until checks clear. There is a $50.00 charge for any check presented to us and then returned by your bank for any reason. Checks made payable to Lauro Auctioneers. Customer Satisfaction is extremely important to us and "Positive Feedback" is always encouraged and greatly appreciated. If you leave us Positive Feedback, we will promptly provide you the same.
