By registering as a bidder to the auction or placing a bid, bidders agree to the following terms and conditions: 1. REGISTRATION: Bidders are required to register in order to bid at the auction either on site or through Live Auctioneers for Internet bidders. There is no fee to register. Linda Welsh Auction may refuse a bidder number to anyone for any reason. Bidder may be asked to provide identification or payment information to Linda Welsh Auction for approval. Bidders are required to sign up for this auction and complete bidder approval form. Approval is at the discretion of Linda Welsh Auction. 2. BUYERS PREMIUM: A seventeen percent (17%) buyers premium will be charged on all items in the auction purchased through Live Auctioneers. For example, if the hammer price (sold price) of an item is $100, and the buyer’s premium on that item is seventeen percent (17%); the total purchase price will be $117. For items sold in the State of Texas, Travis County Sales Tax in Texas is 8.25% and will be charged on the total purchase price including buyers premium under Texas state law. 3. OWNERSHIP AND RESPONSIBILITY OF PURCHASER: Once the auctioneer announces an item is sold, the buyer assumes full risk and responsibility for items purchased and the auctioneer will not be held responsible for lost or stolen items. 4. SALES TAX: All sales are subject to Texas sales tax laws. Sales tax will be charged unless the successful bidder provides a copy of their resale certificate no later than the time of registration for on-site bidding or by 6PM CST the day prior to auction by email or fax. For items sold on-site and for items sold to Texas residents, sales tax will be charged at Travis County Texas sales tax rate which is 8.25% 5. PAYMENT: For on-site bidders, all purchases must be paid for on the day of the auction before you leave. Accepted forms of payment: US Cash, Cashiers Check, VISA, MasterCard, Discover Card, American Express, Paypal, funds wire, or certified check from a local bank or a bank check accompanied by an irrevocable bank letter of credit guaranteeing payment to Linda Welsh Auction and approved at least 24 hours in advance of the auction. Payment must be received and cleared prior to shipment of any item purchased through Internet bidding. Any Purchaser who purchases an item and for which there is a delay in delivery or shipment due to clearance of payment may incur extra charges for storage and delivery to and from storage facility. 6. AS-IS: Everything is sold "as-is-where-is" and without recourse. Although auction information has been obtained from sources deemed reliable, the auctioneer and sellers make no representation of warranties or guarantees expressed or implied as to the genuineness, authenticity, description, genuineness, merchantability, attribution, provenance, period, fitness or condition of any item in the auction or the accuracy of the information contained herein or announced by the auctioneer. Bidders should rely solely on their own inspection of the merchandise and bid accordingly. Any statement made by the auctioneer or seller regarding the items should be used as a guide only. Any error in description does not relieve the buyer of their responsibilities to inspect items carefully. By bidding, you agree to these conditions of sale. Bidders who bid from off site and are not present at the live auction or preview acknowledge and understand that they may not be able to examine and inspect items as well as if they had examined them in person. Bidder shall be the sole judge of the value of an item. No employee of Linda Welsh Auction is authorized to make on our behalf, or that of the Seller, any representation or warranty, oral or written with respect to any item offered. ALL SALES ARE FINAL. NO RETURNS OR REFUNDS. 7. INTERNET BIDDING: If Internet bidding is provided for this auction, bidder(s) acknowledge that this service may not function properly on the day of the auction. Bidder shall have no claim against Linda Welsh Auction or anyone else if the Internet bidding service fails to work correctly before or during the live auction. Linda Welsh Auction will not be responsible for any missed bids from any source. 8. SHIPPING and or REMOVAL: Purchases must be removed on auction day or at the times specified by the auctioneer. Please have your paid receipt when removing your purchases. Buyers assume all responsibility for removal, transportation, and handling of their purchases. Merchandise that is not removed within the specified removal period(s) shall be deemed abandoned. Buyers accept full responsibility for all costs incurred for removal. Although shipping arrangements are the sole responsibility of the buyer, Linda Welsh Auction offers packing and shipping services by UPS, FedEx, USPS, and with professional moving and delivery companies. Bidder grants any shipper of Linda Welsh Auction’s choosing the right to charge the Purchaser's credit card the entire amount of shipping and handling costs. All items shipped will be insured for the purchase price. Purchases which are not removed day of auction and for which delivery arrangements by professional shipper are not made for removal that day may incur charges for delivery to and from storage facilities and may incur additional storage charges. Purchases not removed and for which delivery arrangements are not made with Linda Welsh Auction may be deemed abandoned and may be reoffered for sale. 9. TIE BIDS, BIDDING INCREMENTS AND STARTING BIDS: In the event of an apparent tie bid or a dispute between bidders, auctioneer reserves the right to re-open the bidding, at his discretion, between the bidders in question. Starting prices are determined by the auctioneer or auction house at the time of sale. Auctioneer also reserves the right to choose the increment of the bidding and reject any bid if he feels it is in the best interest of the seller. Linda Welsh Auction reserves the right to bid on behalf of the owner/seller for items where there is a reserve and on behalf of customer/buyers who leave absentee bids but shall not be liable for errors or omissions in executing instructions to bid. The auctioneer acts as an agent only and shall not be liable for any default of any purchaser or consignor/seller. 10. ADDITIONS OR DELETIONS TO SALE, ACCEPTANCE OF BIDS, TIE BIDS and ABSENTEE BIDDERS: Auctioneer reserves the right to withdraw from sale any of the items listed and/or add additional items to the sale at any time during or before the actual sale or reject a bid from any bidder. In the event of a tie bids between an Absentee bidder, or Internet bidder and the house, the house bidder will win the said item at the amount bid. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute, the auctioneer shall have the sole and final discretion to determine the successful bidder or to re-offer and resell the item in dispute. Absentee bidders may make arrangement for bidding by those bidders who cannot attend our auction or use Live Auctioneer during the auction due to scheduling differences or their location. 11. LIABILITY: Persons attending during the preview, auction sale, or removal of goods assume all risks of damage or loss to person and property releasing auctioneer and seller of any and all liability. 12. RESERVE: All items not expressly offered as Absolute are deemed to be offered with Reserve (a confidential amount below which the lot will not ordinarily be sold). We as agents for the Seller may place bids during the auction if and when the highest outstanding bid at any time during the sale is below the reserve which may have been established on the lot being offered. Consigners/Sellers are not allowed to bid on their own property. 13. CONTRACT: Your bid is a contract. Place a bid only if you are serious about buying the item. If you are the successful bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. 14. TEXAS LICENSURE: Auctioneer is licensed by the State of Texas and covered by Recovery Fund managed by the Texas Department of Licensing and Regulation. P.O.
