1. Everything is sold "As Is", "Where Is". At the time of the sale we will attempt to describe honestly any and all major damages and restorations that we are aware of. This however is not to be interpreted as any form of warranty or guarantee, as to age, condition, or authenticity. All statements on such matter, whether printed or made orally, are to be considered opinions only and are not representatives of fact. It is the sole responsibility of the purchaser to satisfy themselves on the authenticity, condition, description and value of each lot before bidding. 2. The auctioneer is the sole determinant as to who is the successful bidder and at his discretion may re-offer and resell the article if a dispute arises. Auctioneer's sale record shall be conclusive as to who was the purchaser and the purchase price. If there is no apparent interest in an item (an appreciable opening bid) the item will be passed from the block by the Auctioneer and will not be re-offered again until possibly a later date. 3. Absentee bids are accepted at Beane's. A staff member will competitively bid for the absentee bidder. We let the audience start the bidding unless there is more than one bid at the book. If there is more than one bid then the bidding will be started above the under bidders. In the case of two bids being the same amount the bidding will start at that amount and the winner shall be the person who left the bid first. All left bids are considered confidential, and as such the names of the absentee bidders nor the amounts bid will not be given out. Phone bidding is allowed only under pre-arranged conditions determined by and discussed with the auctioneer prior to the auction. a. Absentee bids are a service provided to our customers free of charge. Every effort is made to execute all absentee bids, however, in the event of an error of omission, or failure to properly execute absentee bids, the Auctioneer shall not be held liable. b. All absentee bids must be accompanied by a 20% deposit, which will be refunded immediately after the auction, if your bid is unsuccessful. If your bid is successful, the 20% deposit will be applied to the purchase price and the balance due upon presentation of your bill. c. To leave an absentee bid you will need to fill out an absentee bid form and sign it. We will accept absentee bids up until one hour before the start of the sale. d. Bidding on any articles indicates your acceptance of all auction terms. 4. Bidding usually starts below the low estimae and advances in increments of approximately 10% of the opening bid subject to the auctioneer's discretion. The auctioneer reserves the right at his sole descretion to refuse any bids that he deems unreasonable, or significantly below the following minimum bid increment guidelines: $1 -$99.99 $5.00 increments, $100 - $500 $10.00 increments, $500-$1000 $25.00 increments, $1000 and up $100 increments. 5. A 5% sales tax must be charged to anyone who cannot present a valid ANNUAL RESALE CERTIFICATE at time of registration. NO EXCEPTIONS. If you are from out of state we must have you fill out a multi-jurisdictional form. We would also like to have some type of item such as a business card, copy of voided check, stationary, that shows your business name and address. 6. A Buyers Premium of 17.5% will be applied to all property sold to be paid by the buyer as part of the purchase price and is therefore subject to applicable state sales tax. A 2.5% discount will be given to those paying by Cash or pre-approved check. 22% Buyer Premium for all online sales. 7. Occasionally an item may carry a conservative reserve. A reserve is a confidential minimum price established between the auctioneer and consignor. The reserve will not exceed the low estimate . Reserves are executed by the bookkeeper on behalf of the consignor. 8. Names of consignors are considered confidential and will not be given out unless we have prior approval from the consignor to do so. 9. All items are to be paid for in American Funds. Checks are to be cleared by auctioneer prior to the auction. The auctioneer reserves the right to hold merchandise purchased by check until the check has cleared the bank. We accept Cash, pre-approved checks, Visa & MC . Must have valid drivers license when paying by charge card. If you are registering or executing a bid for someone else, please bear in mind that you are responsible for the settlement of that account with us regardless of whether the person you're executing or registering for pays you or not. 10. Once the item is sold it is then the sole responsibility of the buyer. We will not be held responsible for theft or damage once sold. Persons attending auction assume all risks of damage of or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which sale is held. 11. If you are registering for someone or if you execute a bid for someone else under your number, you are responsilbe for the settlement of that account. you are also responsible for examing the item for you client regarding the guarantee. 12. Storage: If an article or articles cannot be removed on sale date, storage may be arranged for an agreed amount of time. ANY ITEMS left will be at owners risk as they are not then covered by our insurance. 13. Any legal disputes arising from this auction shall be settled in the court system in the State of Maine. The Maine Uniform Commercial Code, Title 11, Section 2-328 applies to this auction sale. 14. Maine Auctioneer Rules and Regulations are regulated by the Maine Board of Licensing of Auctioneers, 35 State House Station, Augusta, Maine 04333. 15. Listing subject to omissions and errors. 16. Shipping: Buyer is to pay all shipping, insurance and handling costs. These costs are at the sole discretion of Beane's Antiques & Photography and are not negotiable. We will ship small, light (10lbs or under) internationally. A third party may be used to pack and ship items. 17. Acceptance of Terms: Bidding on article(s) indicates your acceptance of all of the above items. All sales are final and under no circumstances will partial or full refund be made. It is the responsibility of the purchaser to satisfy themselves as to the condition, age, authenticity, and value of an item before bidding on it. 18.
