Terms & Conditions
1. BIDDER REGISTRATION
The auction is open to the public and your attendance is welcome. To
participate in the auction, a Bank Cashier's Check in the amount
of $5,000.00 must be displayed at the time of registration. All checks
should be made payable to yourself. Immediately after you're pronounced the winning bidder the check will be signed over to the auction company. Auction registration will begin at 4:30
PM on Friday, May 25th 2007.
2. CONDITION OF PROPERTY
All properties are offered in As-Is condition and Bidders are encouraged to
inspect the property prior to the Auction.
3. CONTRACT & DEPOSIT
The total deposit due from top bidders on auction day will be 10% of the
contract price, which includes the Bank Cashier's Check used to register for the
auction. Any difference between the Bank Cashier's Check brought to the auction
and 10% of the contract price can be paid by cash(In House Only), corporate or personal
check and will be due immediately following the auction and execution of the
Purchase Agreement immediately following the auction. For any property with
a purchase price less than $50,000, the buyer will be required to pay 20% of
the contract price on the day of the auction. The form of the Purchase
Agreement will be available for inspection prior to the auction and is not
negotiable. In the event any language included in any of the advertising
materials conflict with those contained in the Real Estate Purchase
Agreement, the language of the contract will prevail.
4. CLOSING DATE AND CLOSING COSTS
The Real Estate Purchase Agreement provides for closing on or before 30 days
after the auction. Payment for a Title Insurance Policy showing title to be
good and insurable and documentary stamps required to transfer title will be
the responsibility of the Purchaser. Real Estate taxes are pro-rated. Buyer will receive a general warranty deed free and clear of all liens at closing.
5. FORM OF AUCTION
These properties are being offered for sale at absolute and reserve auction,
also known as "subject to seller's confirmation". If a property is
sold
subject to the Seller's confirmation, confirmation is expected during or
immediately following the auction. It is the intention of the sellers to
liquidate the property on auction day.
6. REAL ESTATE BROKER PARTICIPATION
We welcome the participation of other real estate brokers and their
associates. Licensed real estate professionals who bring a buyer to the
auction will be paid 2% of the highest bid amount at closing. Please call Rogers Auctioneers for details and instructions for registration of
prospects at 919-545-0412. If the winning bidder purchases the property through Ebay, then
no real estate commission shall be paid to the buyer's real estate agent.
7. BUYER'S PREMIUM
A 10% Buyer's Premium will be added to all Top Bids and included in the total
contract price.
8. CONDUCT OF AUCTION
-The terms and conditions may be modified or changed by announcement from
the auction podium. Any such announcement will take precedence over
previously printed materials or oral statements made.
-In the event of tie bids or disputes between bidders, the decision of the
auctioneer will be final.
-Bids will be accepted from registered bidders only and increments of
bidding will be at the discretion of the auctioneer.
-The auction will be audio or video recorded to provide a record of the
event.
-Bidders should rely upon their own inspection of each property, information
and judgment as measurements, stated square footage or similar information
may be estimations.
-All information contained in the brochure, newspaper advertising, website
or provided by staff members is believed to be correct but is not
guaranteed.
ONLINE BIDDERS: Must register by 5:00 pm on Thursday May 24, 2007 via fax or email with $5,000 secured funds.
Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. You should contact the seller to resolve any questions before bidding.
