Terms of Sale
When bidding on any lot offered by Rogers Auctioneers, Inc., the bidder indicates acceptance of the following terms of the sale. Auctioneer sells approximately 80-100 lots per hour.
Bidding & Ownership
Ownership of merchandise will be of the highest bidder at the fall of the Auctioneer's hammer or when Auctioneer says 'Sold'. The buyer will assume all risk and responsibility of the lot purchased once ownership has changed. The Auctioneer will determine highest bidder. The auctioneer alone has the right to reopen the bidding of an item if deemed necessary in a dispute. Auctioneer will make every attempt to adhere to posted bidding increments. Auctioneer has full authority over increments and accepted bids.
Condition of Items Listed
Rogers Auctioneers, Inc. makes every effort to accurately describe all items being sold, but all items for sale are "as is" and it is the bidder's responsibility (present or absentee) to determine the exact condition of each item. All items listed are in generally good condition unless described otherwise. This means all items have wear consistent with age and use. Defects and repairs may not be specifically mentioned when present. Exact condition will be determined sale day. Rogers Auctioneers, Inc. is not responsible for typographical errors. CONDITION REPORT REQUESTS sent via e-mail will be responded to by adding information or photographs to the lot listing where appropriate. Any requests received after 9:00pm the day before the start of an Auction will not be answered. Questions will not be answered once the Auction has started. ALL SALES ARE FINAL! The following as amended by any posted notices or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalog shall be offered for sale or sold by Rogers Auctioneers, Inc. ("RA") and any consignor of such property for whom RA has acted as agent. By bidding at an auction, whether in person or by agent, absentee bid, telephone, Internet or other means, the purchaser or bidder agrees to be bound by these Terms and Conditions of Sale. There are no warranties or guarantees of any kind, express or implied. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. RA attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question. If your item(s) are damaged in shipping, you will need to contact UPS to file a claim. WE DO NOT GIVE REFUNDS! ALL SALES ARE FINAL! THERE WILL BE NO RETURNS. 2. All property is sold "AS IS, WHERE IS" and neither RA nor the consignor makes any warranties or representations of any kind or nature with respect to property or its value, and in no event shall be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of property or estimate of value. No statement (oral or written) in this catalog, at the sale, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. All measurements are approximate 3. The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on RA's part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, RA's sale record is conclusive.**Note: Floor bidder's live bid will take precedence over internet bidder's if there is a tie in bidding. 4. The purchaser assumes full responsibility for items at the fall of the hammer. All items must be immediately insured by the buyer at the time of purchase. 5. As a convenience to customers, absentee bids and phone bids will be executed by RA'S personnel in a competitive and confidential manner. Phone bid arrangements must be made 24 hours prior to start of the auction. All phone bids start at a $100.00 minimum opening bid. RA will not be responsible for failure to execute absentee or phone bids. 6. There will be a buyer premium of 16% for Internet bidders added to the hammer price of each lot and it will be considered part of the total purchase price. THIS DOES NOT INCLUDE SHIPPING AND HANDLING SEE NUMBER 9 FOR DETAILS. 7. No sales tax applicable in this auction. 8. PAYMENT - All items purchased via the internet must be paid for within 72 hours of sale close with Discover, Visa or MasterCard only. For items bought through e-Bay Live Auctions or live auctioneers, it is the buyer's responsibility to contact Rogers Auctioneers, Inc. via telephone at 919-545-0412. We will accept MasterCard, Discover and Visa only. Failure to honor your payment with Rogers Auctioneers, Inc. will result in a NPB being placed on your e-Bay account. See below for additional penalties. 9. SHIPPING: Packing and Shipping: Packing and shipping is the responsibility of the buyer. Rogers Auctioneers, Inc. will provide the information necessary for professional packing and shipping arrangements to be made. We may agree to assist with packing and shipping, but this is done at the purchaser's risk. (UPS agent to follow) Rogers Auctioneers, Inc. will have no liability for any loss or damage to shipped items The fee to the buyer will include actual shipping charges, insurance, and materials. Handling fee will be a minimum $10 per box or reasonable amount per lot not to exceed $20/hr of labor involved. Rogers Auctioneers, Inc. will make every effort to ship your items within 10 days of our receipt of full payment and all shipping information. Successful Buyers will have their credit cards charged TWICE. Once for purchase total and once for packing and shipping charges. Any successful bidders will have the shipping charges applied to their MasterCard, Discover or Visa at the time of shipping. 10. Rogers Auctioneers, Inc. reserves the right to withdraw any lot at any time before the auction without any liabilies. 11. A range of estimates is given on each lot with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price. This is an absolute auction and ALL items will sell to the HIGHEST bidder. There are NO reserves. 12. If any applicable conditions herein are not complied with by the purchaser, in addition to other remedies available to it by law, including without limitation the right to hold the purchaser liable for the total purchase price, Rogers Auctioneers, Inc. at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages. In the event a buyer initiates litigation against Rogers Auctioneers, Inc. for any reason, then buyer agrees to reimburse Rogers Auctioneers, Inc. for reasonable attorney's fees and/or costs incurred in any such action. In the event Rogers Auctioneers, Inc. is required to initiate litigation and/or collection actions against a buyer, then the buyer agrees to reimburse Rogers Auctioneers, Inc. for reasonable attorney fees and/or costs incurred in any such action, and further agrees jurisdiction shall be in Chatham Co., NC. 13. These terms and conditions of sale, as well as the respective rights and obligations of Rogers Auctioneers, Inc. and any purchasers or bidder at any sale of Rogers Auctioneers, Inc., shall be governed by and construed and enforced in accordance with the laws of the State of N.C. 14. All Bank wire transfers must be pre approved before bidding and a $20 fee will be assessed. Bidding Information: All lots will be sold in numerical order according to the catalog, and approximately 80 to 100 lots will be offered per hour. Bids will be accepted in whole dollar amounts only and using the bid increments listed below. All bids accepted at the auctioneer's discretion. Biding increments do not include buyer's premium, sales tax, insurance and/or shipping. All phone bids should be arranged as soon as possible, $100.00 minimum opening bid. Your bid is a contract.
Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. You should contact the seller to resolve any questions before bidding.
Ebay Bids: Live internet bidding is available during the auction. Current bids on the internet will be executed on your behalf during the auction by Ebayliveauctions.com. However, Rogers Auctioneers, Inc. cannot be held liable for live internet bids that are not sent, received, or executed by the administrator. If you are bidding live, real-time on-line, please bid quickly because there is a time delay in receiving live bids.
Payment: All items purchased in person must be paid for on sale day. All items purchased via absentee or phone bid must be paid for within five business days of sale date. If a buyer fails to contact Rogers Auctioneers, Inc. within 5 business days following the sale, the credit card used to secure the bid will be charged the amount of the invoice. For items purchased through EBay Live Auctions, Rogers Auctioneers, Inc. will contact and send an invoice to all winning bidders via e-mail at the completion of the auction. If an EBay buyer fails to contact and remit payment to Rogers Auctioneers, Inc. within 7 days following the auction, a NPB will be placed on their EBay account. If paying by check, Rogers Auctioneers, Inc. reserves the right to hold the item(s) until the check has cleared. Payment can be made by cash(In House Only), approved certified funds, Visa, MC, and Discover.
Ownership: Item ownership is conveyed immediately following the fall of the auctioneer's hammer. While we try to handle and store all items with great care, Rogers Auctioneers, Inc. will have no liability for any loss or damage to an item after the hammer has fallen.
Loading: Loading purchased items is the responsibility of the buyer. Arrangements for pick-up for buyers who wish to supply their own labor can be easily scheduled at the registration desk. Rogers Auctioneers, Inc. will have no liability for any damage while providing loading assistance.
Storage: Unless prior arrangements are made, pick-up within 5 working days of the auction is requested, or a $10.00 per day storage fee will be charged.
