BIDDING
By placing a bid with Our Auction House, you are entering in to a legal and binding contract. No bid may be retracted unless approved by the Auctioneer. In the event of a disagreement regarding bids, the determination of our Auctioneer shall be final.
CAPITALIZED HEADINGS & LOT DESCRIPTIONS
The Capitalized (Bold) Heading is included in the printed catalogue for each lot. In addition to the Capitalized Heading, the on-line catalogue includes a detailed lot description for each lot. It is important to read the detailed lot description for a complete description of the contents, conditions, quantities, and details of each lot. Please call with questions prior to placing a bid on any lot.
ADDITIONAL TERMS
The title to each lot will remain with Our Auction House until payment has cleared. Our Auction House retains the right to withdraw any item in the sale prior to the closing date of the sale for any reason whatsoever and shall have no liability for such withdrawal. Any necessary corrections to the printed catalogue shall be published in the Addenda on-line. Our Auction House retains the right to cancel any sale if payment is not received within 7 days following the closing date of the auction. Our Auction House retains the right to revoke future bidding privileges for accounts that are not paid in full within 7 days following the closing date of the auction. If a winning bidder does not pay an invoice in full within 7 days following the closing of the auction, Our Auction House retains the right to cancel the sale, sell the given items to an under-bidder, re-offer the item(s) in subsequent auction(s) or for private sale, or any other means of disposal. Our Auction House retains the right to post-pone or delay the auction for any reason including for reasons beyond their control, without recourse from any account holder or bidder. By bidding in this auction, the bidder consents to the application of the laws of the state of Connecticut without application of conflicts of laws and the jurisdiction of the state of Connecticut in the county of New London. In no event, shall Our Auction House liability to a purchaser exceed the purchase price of record for the lot.
AUTHENTICATION
The provenance and authenticity of the items offered in this sale have been researched extensively. Our Auction House acquires information from third party authenticators, as well as those from relevant sources, as indicated in the lot description on-line. Please call Our Auction House for any further description or information regarding any lot.
AS IS
All property is sold ?as is? without any representations or warranties by Our Auction House as to the merchantability, fitness for a particular purpose, the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature, or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation, or assumption of liability. And the Auctioneer makes no representations or warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. Our Auction House and the Consignor are not responsible for errors and omissions in the printed catalogue, on-line catalogue, or any supplemental material or in regard to the failure of the auction program to execute any bids on behalf of the bidder.
RETURN POLICY
No Return is offered for uncertified property that is later submitted to a third party evaluations/appraisal service. Under extremely limited situations a winning bidder may request Our Auction House to evaluate voiding a sale. The winning bidder must notify Our Auction House of the alleged error by calling our main office to discuss the request for an item to be returned. The winning bidder has two (2) days from receipt of the lot to contact Our Auction House. Lots under consideration must be sent back to Our Auction House main office within 10-days once approval has been granted. If the lot(s) are not returned within those 10 days then they are no longer eligible for return. Lots must be entirely intact and in the same condition as when sold to the winner to be accepted and/or considered for return. No amount above selling price will be refunded for any reason. Late remittance for purchases may be considered just cause to revoke all return privileges.
The parties agree to submit any dispute that may arise in connection with the auction to arbitration in New London County, Connecticut. Agreement between bidder and Our Auction House shall be governed and construed in accordance to the laws of the state of Connecticut.
