Chapter 1 The General Rules of the Regulations of the Shinagawa Auction Fair in Japan are formulated in English and Japanese versions. In principle, the Japanese version shall prevail. These Rules are applicable to the laws of the State of Japan and refer to the prevailing international practice. This auction is an open auction organized by the Japanese Pinchuan Auction Company (hereinafter referred to as the "Association"), which has the right to amend these rules accordingly according to the actual situation. All clients, bidders, buyers and other interested parties participating in the auction activities of the Association shall comply with these Rules and shall be responsible for their own participation in the auction activities of the Association. If any loss or liability arising from the failure to read these Rules carefully, the actor shall be responsible for it. The right to interpret these Rules rests with the Japanese Pinchuan Auction Company. The authenticity and quality of the auction products are not guaranteed. The company's auction products are auctioned under the auction condition. It is not liable for any defects, dirt or scratches of the auction products. Bidders must personally examine the original auction products and bear legal responsibility for their own bidding behavior. The auctioneer's name is shown in the auctioneer's catalogue. When the author's name is identified after the transaction, the company is not liable for any refund liability and damages.
Chapter II Auction Chart Auction Chart produced by the Association is an illustrative description of the age, author, size, material, weight, technique, authenticity, origin, status and estimated price of the auction product. Text and picture materials are provided for the reference of bidders only. If there are any errors in physical objects and catalogues, and when there are differences in hues, colors, etc. between the catalogues and objects caused by printing and production, photographic lighting, etc., the material objects shall prevail. We shall not be liable for such errors. Auction catalogues sometimes change in the form of pictures or words at auction venues without prior notice. In the event of such a situation, the auction shall be subject to the changed content. We hope that bidders can participate in the preview as much as possible and make judgments by looking at the real objects. Once the bidding is established, the sale contract cannot be cancelled on the basis of the difference between the physical object and the auction catalogue. We will not accept any claims for damage to any commodity.
Chapter III Registration and Licensing Procedures Bidders must show valid ID certificates (such as passports, health insurance certificates, driving licenses, etc.) to the Association beforehand, fill in registration forms and get the bidding number plate. People who have not done the registration and licensing procedures can not become formal bidders. When bidders participate in the auction, they should pay a deposit (3 million yen) before receiving the bid number plate. When the auction is over and the bidding plate is returned, if the bidder fails to purchase the auction item, the full amount of the auction item will be returned to the bidder without interest. If the bidder buys the auction item, it can be used as part of the purchase price. If the balance is available, it will be returned to the bidder when he receives the auction item. The HKSAR has the right to refuse anyone to participate in the auction activities held by the HKSAR or to enter the auction site, and to prohibit the taking of photographs, audio recordings, video recordings and other activities at the auction site. If abnormal conditions at the auction site affect the normal conduct of auction activities, the Association has the right to deal with the situation accordingly, or even suspend the auction activities. If any dispute arises at the auction site, the HKSAR shall have the right to resolve it in a coordinated manner.
Chapter IV On-site Bidding for the Implementation of Auctions will only recognize the Bidding Board issued by the Association. The bidder participates in the auction by bidding for the number plate. After the auction, the bidder must return the bidding number plate to the association. The Association solemnly reminds bidders that they must properly keep the bidding number plate and not lend it to others for use. If the registration plate is lost, the association shall be notified immediately and the formalities for reporting the loss shall be handled. During the implementation of the auction, all the bidding activities carried out by the holder of the bidding number plate in the auction are deemed to be the actions of the registrant of the bidding number plate. The bidder shall bear legal responsibility for his actions unless the registrant of the bidding number plate has already handled the registration procedure for the loss of the bidding number plate to the association and the auction master announces the cancellation of the bidding number plate on the spot. The buyer shall not modify the contract for any reason except as specified by the Commission. The company has the right to refuse to register the applicant for the bidder who has acted against the company, and to revoke the bidder who has done so. Written and telephone entrusted bidding. Chapter V Payment and Acquisition of Auction Goods On the day of auction, cash (cash can only be used in yen), credit card or UnionPay Card shall be the principle of settlement. If settlement cannot be made on that day, please settle it by bank remittance within 8 days. When using credit cards to settle accounts, 5% of the Commission will be paid according to the purchase price (the Commission stipulated by the credit card company). There is no handling fee to settle with UnionPay Card. Within the prescribed period, if the buyer fails to pay the purchase price in full and the cancellation of the transaction formalities fails to take effect, we shall be entitled to collect interest on the mallet price at 0.1% of its daily interest rate. The buyer has no right to cancel the transaction after the auction is completed. If the buyer fails to pay the corresponding price on time and other disputes occur, the HKSAR shall be entitled to collect the cancellation transaction handling fee. The cancellation fee is 30% of the mallet price. In case no settlement can be reached through consultation, the ruling shall be made in accordance with Japanese law. The buyer and the recipient shall bear all the litigation costs, and the Association shall have the right to prohibit them from participating in future auction activities. No claim will be accepted after the settlement with the principal of the manufacturer has been completed. Receiving the auction item (1) The buyer must pay the full amount of the mallet to receive the mallet item. (2) The buyer shall, within seven days of the closing date of the auction, go to the place where the company is located or any other place designated by the company to collect the auction products purchased. If the buyer fails to collect the auction product within the prescribed time limit, the relevant storage, handling, insurance and other expenses of the auction product after the expiration of the time limit shall be borne by the buyer. If the period exceeds seven days, the storage fee of 1,000 yen will be charged for an auction product one day. In order to facilitate the buyer to introduce the transport company to the buyer, the buyer and the transport company should decide to insure, freight and packaging on their own and when the buyer requests the agency to pack and deliver the auction products. The relevant expenses shall be borne by the buyer himself. We will not be responsible for any errors, omissions, losses caused by packing and handling companies. If the buyer mistakenly receives the auctions due to the reasons of our association, we shall be responsible for the refund. The buyer shall return the mistaken auction items to the association as soon as possible. We will not accept any claim after the settlement with the principal of the manufacturer.
Chapter Six: Custody and Transfer of Ownership of Goods When the bidder pays the full amount, the ownership of the traded goods will be transferred to the Bidder from the moment the Goods are delivered by the Association. The bidder will bear all the risk factors brought by the commodity from the moment of falling mallet. In addition to the liability for damages caused by this association, the bidder shall bear all the responsibilities. Whether directly or indirectly, we shall not be responsible for the custody of commodities caused by natural disasters such as earthquakes, volcanic eruptions, tsunamis, typhoons, storms and force majeure such as wars.
