GENERAL TERMS AND CONDITIONS (For the auction) At the auction the following are the terms of business: The Toy Auctioneer hereinafter referred to as TTA and to include any person acting upon his authority. GENERAL - CONDITIONS OF SALE THIRD PARTY LIABILITY: All persons on the premises of, or at a venue hired or borrowed by TTA are there upon their own risk. They shall have no claim against TTA in respect of any accident, injury or damage howsoever caused. ADMISSION: TTA reserves the right of admission. CATALOGUE: All descriptions, whether printed or oral, are statements of opinion not fact. Intending Purchasers should satisfy themselves as to the condition, age and authenticity etc. of all pieces and lots. AUCTION: TTA reserves the right to accept or refuse any bid(s), regulate the bidding and amounts of any bid(s), rearrange, consolidate or withdraw any lot(s) or part of any lot without reason or notice. In the event of a dispute TTA has absolute discretion to settle such dispute. All transactions associated with this auction sale shall be governed by English Law. SELLER - CONDITION OF SALE INDEMNITY: The seller indemnifies TTA together with his servants and agents who act solely as agent for the seller. TITLE: The seller warrants to TTA and the buyer that he is the absolute owner of any lot and is authorised to sell the same and pass marketable title free of any encumbrance or claim. INSTRUCTIONS: All lots are sold at TTA discretion unless written instructions to the contrary are received by TTA more than 24 hours prior to the auction. Responsibility for receipt of such instructions rests with seller. PROCEEDS: The seller authorises TTA to deduct all monies due to him from the auction proceeds. TTA shall not be liable for settlement of any lot(s) for which he is not in possession of cleared funds. BUYER - CONDITION OF SALE ACKNOWLEDGEMENT: In making a bid for any lot whether in person or otherwise all persons acknowledge they have read, understand and abide by all these Conditions of Sale. TITLE: Responsibility for a purchased lot shall pass at the fall of the hammer, however, legal title shall not pass until The Auctioneer is in possession of cleared funds in payment for that lot. PAYMENT AND CLEARANCE: All lots must be paid for in full within 24 hours following the conclusion of the auction except where agreed by TTA in writing. No lot(s) may be removed until cleared funds are to hand except where agreed by TTA. Any lot(s) not paid for will incur storage charges calculated at the sole discretion of The Auctioneer and interest at 3% over LIBOR. PURCHASE PRICE: The Buyer will pay to TTA the hammer price together with a Buyer's Premium calculated at a rate of 15% plus Value Added Tax on the buyers premium, additionally any value added tax on the hammer price where noted in the catalogue. SELLERS CONDITIONS OF SALE As a seller consigning items for sale clients are asked to sign a statement to the effect that: ‘I certify that the above items are my own unencumbered property and that I am able to pass good title. I declare that I am not registered or required to be registered for Value Added tax and that the goods detailed above are to be sold at auction on my behalf. I am aware of any abide by all the conditions of sale. SELLER'S CONDITION OF BUSINESS TITLE: The seller warrants to TTA and the purchaser that he is the absolute owner of any lot and is authorised to sell the same and pass marketable title free of any encumbrance or claim. INDEMNITY: The seller indemnifies TTA together with his servants and agents who act solely as agent for the seller. INSTRUCTIONS: All lots are sold at TTA discretion unless written instructions to the contrary are received by TTA more than 24 hours prior to the auction. Responsibility for receipt of such instructions rests with the seller. PROCEEDS: The seller authorises TTA to deduct all monies due to him from the auction proceeds. TTA shall not be liable for settlement of any lot(s) for which he is not in possession of cleared funds. WITHDRAWN LOTS: TTA reserves the right to make a charge equal to the vendors commission based on the middle of the pre-sale estimate in respect of any lot(s) entered for an auction but subsequently withdrawn from auction prior to sale. UNSOLD LOTS: All unsold lots or withdrawn lots will be reoffered without reserve in a subsequent auction(s) unless collected by the vendor within four weeks following the auction(s) in which they were unsold or withdrawn. INSURANCE: Items consigned for auction will be covered prior to the auction against the usual risks at a value based on the middle of the auctioneer's estimate or vendor's previously recorded written reserve whichever is the higher figure. AUTHENTICITY: In the event of the authenticity of any lot being challenged by the purchaser and such challenge being justified in the opinion of TTA the seller agrees to the sale of any such lot being rescinded. DEFAULT: TTA shall not be liable in the event that a purchaser fails to pay for any lot remaining in the possession of TTA. DISPUTES: All these conditions of sale and any dispute arising shall be governed by English law. IMPORTANT INFORMATION REGISTRATION: Obtain a bidding number prior to viewing from the registration desk; new clients must produce acceptable identification. ABSENTEE BIDS: Complete the Commission Bid form and return it to TTA who will execute such bids without obligation. CONDITION OF LOTS: The condition of lots is mentioned in this catalogue. This is intended as a guide to assist potential buyers. It remains the responsibility of the buyer to satisfy herself/himself as to the condition of each piece and lot. PAYMENT AND CLEARANCE: Accounts maybe settled by cash(In House Only), Sterling cheque or draft, debit and credit cards (credit cards will incur and additional charge of 3%, Electronic Transfers should be sent direct to our bank for the account of The Toy Auctioneer: Sort code 50 00 00 A/C II 20615388 and by Paypal paypal@thetoyauctioneer.com with an additional charge of 3%. SHIPPING: Guidance prices for packages - UK - £18, EU - £27, US - £42 and Asia/Australia - £64+ 2.5% insurance. Where every effort will be made to ensure the items are properly packed and, where so instructed, insurance taken by the service provider, no responsibility can be accepted by TTA or their staff or agents for any loss or damage howsoever arising. Safe transit of purchase by hand, post, courier or shipper is at the sole risk of the purchaser.
