We have been asked to liquidate all personal furniture and fixtures of FLAGLER ANTIQUES warehouse in Lake Wales Florida Including the entire inventory of fine French, European and American Antique furniture and Décor all of which was personally owned by Flagler Antiques of Florida and comprised over 20 years. Personal issues have forced the sale and eventual liquidation of the inventory and the entire contents has been assigned to the national Orlando based auction company Seller to stage and sell the contents in it’s entirety and all will be sold to highest bidder regardless of cost. This is an Absolute No Reserve auction, The sale will include live bidding, plus absentee and phone bidding may be arranged for those unable to attend or utilize the popular live internet bidding on being offered through Live auctioneers and EBay. The sale will be held at the Lake Wales warehouse located at on Saturday February 8 at 10 am sharp and Sunday February 9 at 11 am sharp Preview for sale begins at Friday February 7 . Live bidding only will occur on Saturday from 10 to 1 and Sunday 11 to 1 and for 1 hour at close of the sale on each of these 2 days. Internet Bidding and absentee bidding starts at 1 pm Eastern Standard Time each day of sale . Ownership of merchandise will be of the highest bidder at the fall of the Auctioneer's hammer. The buyer will assume all risk and responsibility of the lot purchased once ownership has changed. The Auctioneer will determine highest bidder. The auctioneer alone has the right to reopen the bidding of an item if deemed necessary in a dispute. 2. Condition of Items Listed ALL ITEMS ARE ON DISPLAY AND CAN BE INSPECTED PRIOR TO AUCTION AT THE LAKE WALES FACILITY IN BEAUTIFULL LAKE WALES FLORIDA. In publishing these auction descriptions, Seller has endeavored to accurately describe all of the items being auctioned, based on information known and given on each , all information provided is given the best of all parties knowledge. However, this collection was compiled over 25 years and it is impossible for Seller to verify these items and warrant all information assigned to each item. Therefore ALL LOTS offered and all property is SOLD "As Is , Where Is" with no guarantee as to the age, condition, size, quality, rarity, variety, importance, historical relevance or value of the items being sold whether verbal or written.– it is Buyer’s responsibility to assign value to the goods based on fact he or she can determine and no representation as to any item’s merchantability, use, or authenticity is being made now or in the future by any agent, employee or word of Seller. This is not an “Approval Auctionâ€. ALL SALES ARE FINAL. However should there be a sincere, legitimate dispute, you are asked to contact us and discuss a resolution. We will do our best to resolve the dispute in a fare, reputable and timely manner. Seller has ran 100’s of Auctions across America and has a top reputation for servicing and satisfying it’s customers with fair business practices. We are not responsible for typographical errors or for color differences between photo's and actual color of received merchandise due to variances of color in computer monitor displays.. Buyer Premium An 18% buyers premium will be added to the winning bid amount for all absentee / internet bids. Phone bidding will be allowed on specific lots , subject to availability. If you attend the auction in person you pay only a 10% buyers premium. 4. Payment The successful high bidder/Owner has given a credit card as a requirement of registration to make payment for all merchandise he/she successfully purchases. Winning bidders credit cards will be charged at close of sale unless previous arrangements have been made and authorized in writing by auction company. Buyers who prefer to pay alternatively must prepay a reasonable deposit in an alternate form prior to bidding for the purpose of this section 20% of the anticipated purchases would be the requirement for non attending bidders who do not have a working relationship with Seller as a cash deposit against successful bids and any unused funds will be promptly returned at close of auction. PLEASE NOTE this is unnecessary unless you request that your credit card not be used. We apologize in advance if this does not meet your wishes but we will have 100’s of transactions to process and it is impossible for us to contact all buyers and wait for payments to be sent in during this sale and we hope you will again consider bidding if not at this then at future Seller where time is not so critical to the liquidation of such an important collection. However for all multi lot purchasers or single lots in excess of $2500. We will only charge the card you used to register with , a 20% deposit of your total purchase including buyer’s premiums at the time of your placing and being declared the successful winning bidder by the auctioneer, to simply assure faithful performance of all obligations and they will have an additional 3 business days, to settle the balance and make alternative financial arrangements, buyers not performing will forfeit their deposits and/or their credit card will be further charged for all monies owed if not settled within 3 business days following receipt of final invoice. Notwithstanding anything to the contrary all accounts are to be settled within THREE days of the completion of the auction. Alternate forms of payment are PayPal, Money Order, Cashiers Check, American Express, Visa, or MasterCard. Taxes A 7% Florida Sales Tax will be collected from Buyers shipping to a Florida address unless Seller has a copy of the purchaser's resale certificate and a completed tax exempt form. All dealers should call or E-mail for more information at www.motorbiliaauction.com 6. Contract Your bid is a contract. Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from Seller. The Auctioneer will make absolute and final judgment as to who is the successful bidder of each and every item in the auction whether it be a live bidder, a phone bidder an absentee bidder or an internet bidder. Phone, Absentee and Internet bidding is not a perfect science and there may be unforeseen human or technical errors occur. Seller will not be responsible for any errors that occur with Offsite Bidding. All bids are irrevocable and shall be in accordance with the conditions of the sale and be governed and interpreted by the laws in Orange county in the state of Florida. By bidding at the auction, whether present, in person, or by written bid, telephone bid or internet bid or any other means, the buyer shall be deemed to the jurisdiction of the courts of the state of Florida. Any items which are damaged in shipment must be handled by winning bidder and the trucking company directly. Damaged merchandise or buyers remorse are not grounds for credit card charge backs or stop checks. 8. Shipping All items purchased by internet bidders must arrange for items to be picked up at the Lake Wales, FL facility on or before the close of business Wednesday February 6th. For those who need the item shipped a service is available that will provide transport and packaging for all Fed-ex items at $25.00 per item and items to large for Fed Ex at $100 per item back to Orlando, Fl for shipping to your destination address. Shipping Charges will be combined for all purchases during the sale and charged separately above the packaging and storage fee to those absentee bidders unable to pick up items at the facility. Shipping is handled by a third party whom we can assist you with getting your items delivered to the address of your choice. BUYER IS MADE AWARE AND UNDERSTANDS THAT THE LAKE WALES WAREHOUSE MUST BE EMPTIED AND VACATED IMMEDIATELY. BUY BIDDING HE/SHE HAS ACCEPTED THE RISK AND UNDERSTANDS THAT All merchandise must be removed from the LAKE WALES WAREHOUSE within 3 business days or merchandise will be moved to storage facilities and fee’s will be applied. All notices sent by e-mail will be deemed received for the purposes of all notices, the e-mail address identified and registered with ebay.com will be the e-mail used, for the purpose of fulfilling the obligation of notice contained herein, however participants during ebay live registration have the opportunity to change this e-mail address and this e-mail address will be used by Seller. Merchandise left in the storage facility for more then 21 days will be deemed forfeited and ALL MONIES PAID WILL BE LOST unless special arrangements have been made in writing AND IN NO EVENT WILL Seller be responsible for buyers failure to fulfill his agreed upon obligation or responsible for merchandise left beyond this time frame. Buyer is aware the sale can be attended in person and that he/she can pick up the merchandise at any time during the sale and within posted hours set for pick during the 72 hours at close of sale if he or she chooses. This absentee / internet bidding is being provided as an option for YOU to use for your sole benefit in absentee participation and is up to your discretion and ability to follow the agreed upon requirements for absentee participation. Buyer is responsible for all shipping costs and arrangements within this time frame. Packing, shipping and insuring items is available from a reputable third party shipper and Seller will assist all buyers in making these arrangements and offer sincere help to all customers but we are not responsible for any aspect of it. While many lots can be shipped via Federal Express or possibly truck line, there are items that will require special shipping and crating arrangements. Items that are shipped via Seller will ship FOB Orlando and ownership of merchandise is taken by winning bidder at the time of the Auctioneer's hammer. Any damages as a result of shipping will be handled by the buyer and the shipping company directly and damage is not grounds for a credit card chargeback or stop check request. Warning: The enormous amount of items being sold will cause some delays in shipping so be aware that you may not receive your items for up to 6 weeks or longer in some circumstances after the auction. We will do our best to get your items to you sooner. However, it is not promised and your patience will be required and appreciated at all times. If the winning bidder wishes to pick up their item(s) at the Seller Warehouse location instead of having them shipped, there will be a $15.00 per small item charge for packing and transportation from the auction site to the storage facility and larger items will need to be quoted and this can get very expensive , on road haulers will be available for you to contact and deal directly with and are better suited for delivery and storage if needed . All merchandise is sold FOB LAKE WALES FACILITY and can be picked up at time of end of auction. Notice Seller average selling lots at a rate of about 60 per hour. Sometimes, eBay Live software or the internet may not be able to keep up with the pace of the auction. We recommend placing a realistic absentee bid now as insurance to avoid missing the items you want to purchase. Occasionally, the auctioneer may eliminate or reject an eBay Live bid and the auctioneer may also reopen a lot after the close of the eBay Live bidding. Your bid may be rejected even if it shows you as the winning bidder after the bidding is completed. By bidding via eBay Live, you agree that Seller may award the lot to another bidder as its sole discretion under the circumstances described above or any other reasonable circumstances. Since eBay Live bids are not shown to us until we open the lot on the floor, we treat those bids just like the floor bids. In most cases, the floor responds before the eBay bid is presented to us, due to internet lag time, so for consistency we have made it a policy that floor bids are always considered first over tie eBay Live bids. Also, please note that all lots purchased through eBay Live, carry a 18% buyers premium. Please make sure you read all of the Terms and Conditions before you bid. 10. Winning Notification and Billing After the Final session of this auction, Seller will send an email with an invoice to the winning bidder. This process may take up to 24 hours. All final invoice information will be supplied to the successful purchasers timely by Seller. 11. Timing Please note that eBay's "Time Remaining" time stamp is not an accurate reflection of the hour at which the lots will be offered. Absentee bids left on eBay Live Auction are not the same as bids left with the auction house directly. They are executed from a proxy computer terminal in the room against other Internet Bidders. Other competitive bids include bidders on the telephone, bids from a live audience and absentee bids left with the auctioneer. Remember that eBay does not provide the ability for auction houses to incorporate left bids from the Internet with those left directly with the auction house. 12. Disclaimer Seller assumes full authority as to who can attend any one of its auctions and has the right to remove from the premises any person or persons who attempt to disrupt the progress of the event at any time during the preview or the auction. 13. Acceptance of Terms In bidding on any lot here offered, the bidder indicates complete and unconditional acceptance of these Terms and Conditions.
