SPRING DOLL AUCTION

1.) All property is sold AS IS. It is the bidder's responsibility to determine the exact condition of an item by personal inspection or by contacting McMasters Harris with any questions or concerns prior to placing a bid. McMasters Harris makes every effort to provide an accurate description of each item and to point out damage, if noted. However, neither McMasters Harris Auction Co. nor the consignor makes any guarantees with respect to the property, and neither shall be responsible for accuracy of description, attribution, provenance or condition of any item. 2.) Buyer's Premium: 20% will be added to the hammer price for Ebay Live Internet purchases. 3.) Shipping Costs: Buyers will be responsible for postage and postal insurance and a packing charge of $5.00 per item will be added to all absentee purchases, including and Internet. 4.) All accounts must be settled immediately upon receipt of invoice. We accept PayPal, Visa, MasterCard, Discover and American Express. NO OTHER FORM OF PAYMENT IS ACCEPTED FOR EBAY PURCHASES. 5.) Reserves: this is a public auction and, as such, items are deemed to be sold with reserve unless otherwise stated as selling without reserve or absolute. Please note that some or all lots in this catalog are offered subject to a reserve, which is the confidential minimum acceptable to the seller. Reserves are agreed upon with consignors or, in the absence thereof, at the complete discretion of McMasters Harris. The reserve amount will not exceed the low estimate, if any, on any having such reserve. a. The auctioneer may open bidding on any lot by placing a bid on behalf of the seller. The auctioneer may further bid on behalf of the seller, up to the amount of the reserve, by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. 6.) The auctioneer has the right to withdraw any lot prior to the commencement of bidding for such lot. Furthermore, the auctioneer reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has the final discretion to determine the successful bidder or to re-offer the lot in dispute. If any dispute arises after the sale, the sale record of McMasters Harris shall be conclusive. The auction company shall not be held responsible for any missed bids or bids unseen by the auctioneer. 7.) On the fall of the auctioneer's hammer or otherwise announcing the item sold, title passes to the successful bidder, subject to the conditions set forth herein. At that time, the bidder assumes full risk and responsibility for the item and agrees to pay the purchase price plus any pertinent fees and/or tax. 8.) If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, McMasters Harris Auction Co. may exercise all of its rights and remedies under the law including, without limitation, a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach and/or b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus any costs of sale. 9. McMasters Harris Auction Co. accepts no responsibility for any errors in the execution of absentee bids. All items sold AS IS. 10.) Live Internet bidding is offered as another means of participating at our auctions. Bidders shall not hold the auctioneer, his client nor his staff responsible for failure in execution of bidding or bid acceptance on this Internet bidding system. It is our best attempt to execute the bidding as timely and accurately as possible. Certain human and technical elements and limitations can have an effect on the process, such as computer experience, human error, loss of Internet connection, slow connection speed, and web server failure. 11.) Registration: All bidders must register their name, permanent street address and phone number prior to the auction. Internet bidders are required to register and establish an account with McMasters Harris Auction Co. All gallery and Ohio Internet purchases are subject to state sales tax unless purchaser possesses a sales tax exemption number. 13.) The auction company reserves the right to refuse service to any person. 14.) All announcements made day of auction take precedence over any and all written or verbal statements. 15.) The Uniform Commercial Code and the laws of The State of Ohio pertain to this auction. 16.) All auctioneers are licensed according to the Auctioneer Licensing laws of The State of Ohio. 17.) By bidding on any item, the bidder shows acceptance of these terms and all other terms announced at the time of sale.
