Auction Terms & Conditions PLEASE NOTE:The property offered for sale by Gift It Forward,Inc was donated to our 501(c)(3). The below Terms and Conditions constitute the entire agreement with the winning bidder. All bidders at Gift It Forward are bound by these conditions. If you do not understand any of these terms or conditions, please ask for clarification before bidding. In bidding with Gift It Forward Inc you are agreeing to be bound by the following terms: All lots - to be sold AS IS, WHERE IS. ALL SALES ARE FINAL Condition of items sold - Gift It Forward shall not be responsible for any omission or errors in the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith.. Descriptions including photographs, condition, weights, authenticity, manufacturer, artist, origin and measurements are based on the opinion of Gift It Forward and believed to be accurate, however, Gift It Forward makes no warranty or representations of any kind to the merchandise offered. All measurements and sizes are approximate No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods are sold ?as is? and without recourse 1. Identification - All purchasers are required to have a Bidder?s Number to bid and shall supply Gift It Forward with their full name, address and telephone number. A form of picture identification is required to verify information. 2. Buyer-The highest bidder shall be the buyer at the hammer price. 5% Buyers Premium is added on all lots purchased. 3. Manner of payment - All lots are to be paid in full by cash, Mastercard, Visa, Amex, Discover or Debit Card within 24 hours of the auction. 4. New York Sales Tax - will be paid on the hammer price and the 5% Buyer?s Premium. All purchases will be subject to 8.625% NY sales tax. 5. Minimum bids - (reserves) may be placed on some items. 6. Transportation of Goods are at the sole cost and responsibility of the buyers. Buyers are responsible for all packing and shipping arrangements. 7. Removal of Goods - All goods must be picked up within 3 days of auction close, and shall be at the expense, liability, and risk of the purchaser. Purchases will be turned over only on presentation of paid bill. Gift It Forward shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased. 8. Personal and property risk - Persons attending during removal of goods assume all risks of damage of or loss to person and property and specifically release Gift It Forward from liability. Neither Gift It Forward nor his principal shall be liable by reason of any defect in or condition of the premises on which the merchandise is located. 9. Records - The record of sale kept by Gift It Forward will be taken as final in the event of any dispute.
